    One additional: How about that bunch asking donations to the Police Benevolent Assn? I did some digging on Charity Navigator (sp?) and those donations ARE NOT tax deductible. They also list as such on the BBB website which merely relates tax deductible status.

    Tax exempt status vs. a donations tax deductability: If a donation is not tax deductible, does the solicitor qualify for DNCR exemption?

    An EIN is merely an Employer Identification Number and ANY employer has one, for-profit or non-profit. It means little or nothing regarding requirements under the DNCR.

    Being granted non-profit status gives them legal authorization for disregarding the DNCR as does a political or market survey company and those last two are definitely for-profit.

    Once you have the EIN you can look up that business. Tell all calls-for-charity you won't do business with them or make donations until they provide you with the company's EIN.

    Scammers won't have an EIN or they will make one up, thus blowing their cover.

    Unfortunately, most employees of most businesses do not have their employer's EIN memorized, and I doubt call-center computer equipment software shows the EIN of the businesses or charities for whom they are making telemarketing calls.

    I understand that having an EIN has nothing to do with tax-exempt status. I am trying to say that the EIN allows you to look up the company details and prove they are not non-profit.

    The papers I pulled up on justia seem to only be a ruling on liability filed by ADT.  i did however find another web site that says ADT settled for 15 Mil.  http://topclassactions.com/lawsuit-settlement ... -checks-mailed/

    Note how little the checks were compared to the $500 for each phone call the class should have gotten, which shows how much the lawyers stole from them.

    The booty could be larger still. Multiple TCPA violations per call are possible. Often it's two at least. That's before we get to count treble damages for a "knowing and willful" defendant. However, TCPA is like most federal stats in not shifting costs to the loser, reducing the incentive for "private attorneys general". Any time you let someone else's lawyers do all the work, you have to brace for a larger bite from the award.

    Exactly why I chuckle at all those "let's get a class action suit" posts.  The people that write that are looking at the huge awards figuring their ship will come in, but they have no idea that the class action lawyers take most of the money.

    While digging for a border along a sidewalk I thought I had dug up yet another earthworm. Nope, it was a tiny snake (less than 4" long) that looked like an earthworm but had far less flexibility than an earthworm.

    Any idea if this case (the Loveless vs A1, 2014)  was finalized or is it still ongoing?
