Book: How To Sue A Telemarketer

Steve Ostrow has just published a book "How To Sue A Telemarketer", which could be an interesting read. It appears the book offers a DIY approach to suing the telemarketers. It has samples of legal complaints and forms, as well instructions on how to prove your case.

I understand making a living. So go get a job that does not make I like missrable. Do you mean to tell me that you like being called at all hours of the night multiple times daily after you have asked to be left alone. That's called harrasment and it won't ever get a sale from me.

"Telemarketer" is personally liable once he/she calls you a second time. Each $500 violation [calling # on DNC, calling cell phone, no written DNC policy/or refuse to mail it, not haveing an internal DNC list/refusing to put one's name on list, refusing to give out address or phone number, not stating one's full name, no DNC training for telemarketers (only the employer is responsible for this one)] can be trebled to $1,500 for "knowing and willful" conduct. Spoofing Caller ID may only be collectible by FTC.

Go to www.tcpalaw.com for a list of attorneys in various states who take on these cases. Good luck!! Going to court is the best way to stop the abusive, harassing calls.  And be sure to sue the individual employee if that person has called you more than once, for the employer in most states is required to defend the employee in court by paying the employee's legal fees, etc.

    Q
Here is the bottom line for the dumb [***] who insist that telemarketing or any aggressive marketing is a use full way of increasing business. I will never buy a product or use a service from any company or individual who uses tactics that are obtrusive and over baring. I will not support or indorse a product or service if I feel assaulted by its over aggressive methods of promoting the service or product. If you cant respect us as a potential client(s) and choose to view us a "Mark" then you do not deserve to have our business. You deserve to fail!

Do you happen to realize that while you are making your so called "living" the people you are calling maybe doing something important or someone may be trying to call me for something that really matters, like my health, my families health or sadly a death.
Stop calling numbers multiple times and go on to the next number, not mine, I am on the Do Not Call List, but you don't seem to follow the rules.

    Harassed by phone
The fact that a small number of people respond to telemarketing claims, and an even smaller number try to renege on their agreements later, does not excuse bothering millions of other people who do not in the least want your products or appreciate being harassed by your calls.  Unethical work and inconsiderate sales tactics have no justification, and we have no obligation to condone them.  There are other jobs available, even to the relatively unskilled.

We pay for our phone lines, and should have complete control over who can call us, for what purposes.  The No Call List should be expanded so that we can additionally specify whether we wish (not) to receive political messages, surveys, or charity or religious solicitations on our personal phones.  In fact, rather than having to opt out, new subscribers should have to opt in to receive such calls.  Should we not have the right NOT to be disturbed by well-funded organizations that don't give a rat's [***] about our time or peace and only seek to exploit us?

I have NEVER bought anything from a telemarketer, have been on the Do Not Call list almost since Day 1, and I STILL receive at least 1 call a week.  So before you say "Y'ALL", look at the people who are actually complaining!  Yes, there are one or two who were stupid enough to give their credit card numbers out, but the majority of us are ON the Do Not Call list, which means we don't want to be bothered by YOU or ANYONE ELSE!!!!  I don't NEED a better interest rate on my credit card because a) I don't carry a balance b) if I did, I'd call the credit card company and ask for it myself and c) it's already pretty low.  I have asked these people to stop calling me and they still call (unless multiple companies are using the exact same recording for their robocall) and, in my book, that's harassment.  My home number is unpublished and unlisted, which means I don't want people calling me.  How would you feel if I got YOUR PRIVATE number and called you continuously, even after you asked me to stop?  I imagine you'd be pretty FED UP with it after a while....I've reported companies at least 56 times in the past year alone and still receive calls...47 of them are "robocalls" offering me a "better rate" on either my credit cards or my mortgage...this is the 3rd from this number!  See why I'm FED UP???

Actually, most people who work as callers for telemarketing companies are either child molesters or wannabe child molestors.  That's why they work there.....the machines call, and they can monitor, and if a child answers the line, then they take down the phone number and now they have a new target - a child alone and answering the phone.  So they get paid for telemarketing, which is just a bonus compared to their real goal.

    You seem to be confused.

No one is saying telemarketers cant make calls, but they must follow the rules, and not call the people on the "do not call list".

Get a job working inbound calls, and you wont have to worry your little brain...

people like you who have no education, skills or repect for others are the scum. You call during dinner, you call before I wake up, you call after I go to bed, you call at work. Don't blame the rest of us with real jobs for your crappy "career". So I see no way of you being able to buy even one single book, since you are very likely broke. Anyways, give me your home number so I can "train" for my new "career"
