Book: How To Sue A Telemarketer
Steve Ostrow has just published a book "How To Sue A Telemarketer", which could be an interesting read. It appears the book offers a DIY approach to suing the telemarketers. It has samples of legal complaints and forms, as well instructions on how to prove your case.

- telecom manager replies to dhTelemarketers scam everyone, including their own employees. Few pay a decent wage and the sweat shops that they run are more like 3rd world country jails than honest businesses. I've worked in telemarketing and for third-party call centres, and it's the pits without a doubt.
The individual who calls you is probably struggling to pay off debts or a mortgage. Don't take it out on them, sue their employers who create or perpetrate the annoying scams that plague this country. - EddienineB_B_Brother could you spare a dime?
- jennyI havent register with DNC yet, can i able to sue telemarketer sending me sms text
- GE Baker replies to Telemarketer| 1 replyyou still don't get it,do you?when a person is at home ,relaxing, playing with the kids, having a intimate conversation with a loved one,we do not want to BUY anything!!If I wanted to BUY something I would go to the damned store and BUY it.Your calls are unwanted intrusions into our already too busy lives. And,when the economy is booming the calls are even worse! Stay out of my home with your unwanted, unneeded and usually worthless junk.Or you can pay me for bothering me at my home.Thanks.

- 2L84U replies to mike| 1 replyFor anyone out there needing to get these leeches off their back, there is an online complaint form in most states. It is rather easy to fill out, if you have their # it really helps and to like one guy posted, you can get quite a bit of money from these people who hassle you without checking the no call list, make sure you are on the one in your state before filing or it is a waste of time. HERE IS THE IMPORTANT THING TO REMEMBER, Before George H. Bush, the first Bush President left office, he signed a piece of legislation that makes this worth while. It most cases when you sue someone, the state or county gets the money, in the DO NOT CALL LIST, he signed it to where the person making the complaint gets the money, all of it. Some telemarketing companies will pay more than the $400 fine, they don't want to get on the list of harrassing callers and get a worse rap. I saw an article a couple yrs. back where a guy in Colorado had collected $2700 by July of that year, one settled for like $1100 and others settled for more than the minumum fine. My state has the form online on the ATTORNEY GENERALS WEBSITE, it is a pretty easy form to fill out and yes it can be hard to get a settlement in small claims, but it is still disobeying an order from a judge by not doing so, that is contempt of court and can lead to more charges and if pushed they will pursue it. People have the right to be left alone too, for these poor telemarketeers out there trying to make ends meet. I don't need you calling me in my home at dinner time or any time I don't want to talk to you, it is invasion of privacy. I asked one to give me their home # and they asked why, I told them I would call them at 6:30 in the morning and discuss buying their product, they were like I don't want that, I told them exactly, I didn't either, quit bothering me.
- LA Pilot replies to 2L84UThanks 2L84U
Thank you for that sound information. I appreciate it. I am sure it will be helpful to many with this same problem on here. Often one hears bits and pieces or a news story on TV of how "someone" did this, but never the full, laid out details.
Your description is great. I intend to use it with one Nevada number that keeps calling my cell phone with a Spanish computer message and phone tree. I checked here and they are linked to M4Sunset Group, who is also Marketing 4 Sunset Group. Apparently the sell "scam" vacations to places like Cancun. From other posts related to their number, some have taken the bait. THEN... there are the extras, add ons, fees and the price is no longer under $699.00, but over $2k.
I have all my numbers on the Federal Do Not Call List. Prior to reading your post I did not know that states have their own. I am in California, so I'd be certain we have one here. I am not the type to "fall" for these rotten scoundrels who often prey upon those who don't understand and/or might be among the millions in the U.S. barely able to get by with income and expenses these days (including $3.39 unleaded gas in LA), who think a nice vacation to someplace like Cancun for $699. is something they might be able to do, or stretch to do. Then they are taken, and their lives made more difficult by deceit, lies, and greed. I am 55 years old, I remember when companies, for the most part were honest and decent. I also remember when any interest rate over 22% was called Usury and was a Federal Offense - a FELONY. I am now the age of saying, gee, those were the "good old days"!
Thanks again - Jay replies to Telemarketer| 1 replyThere's no need to get all testy over telemarketers. The guy's right -- they are just trying to make a living. The focus should be on the telemarketing company itself, not some student trying to work thru school. That's just plain idiocy. Calling the BBB is as useless as calling the Chamber of Commerce. They don't do crap but record a complaint. There is no clout in the Do Not Call list because there are too many things people do that unknowingly exempt themselves from the list. Don't be so stupid as to think this list will help and then enter sweepstakes, contests, buy mail order products and all kinds of other stuff that makes your listing useless. Getting a judgment in small claims court is nearly useless unless one files for a judgment entry and attaches something of the defendant that gets their attention. HOWEVER, small claims is excellent for thwarting so-called bill collectors that dig up your personal info and then threaten to have you arrested. I have one right this minute that says I defaulted on a $200 loan in 2007. They now say I have a balance with interest and penaties of over $8000. Sure. They call using VOIP from Pakistan and say they are Deon Thomas or some other fake name. With the aliases and threats they now owe me over $5000. Other than that, quit being a slave to your fricking phone and your Blackberry and your cell phone, you morons. You are not that important. Turn the bells off, and all of the toys, too and nobody can wake you up or mess up dinner. Try actually talking to each other for a change...right around the table.
- Jay replies to GE BakerNO...you don't get it. If you don't want unwanted intrusions, then close the door. Turn the bells off. There is nobody dying tonight that won't be just as dead in the morning. Do you honestly think that the calls you absolutely feel you MUST answer are not equally intrusive to the kids you say you are playing with? Get over yourself. You are not a big deal. Unless your name is Barack, your phone can be turned off.
- OS replies to TelemarketerTelemarketers ARE the lowlifes. You are so pathetic you can crawl under a worm. There is a reason for a "DO NOT CALL LIST" is to keep scum like you and the company you represent away.
- OS replies to mikeAlso go to the Attorney General's website. Enough complaints and they will be knocking on thier front door.
- Darrell replies to TelemarketerNo, telemarketers are low life scum sucking punks.
- Chris replies to Telemarketerok but if someone asks you to not call them then you don't cause if you do it is then considered harassment and also if the number that you are calling is a cellphone then not only are you harassing the person then you are also costing them money for going over in their cellular minutes if the person is trying to keep the bill down by having a small amount of minutes a month so no matter how you look at it, if someone asks you to not call them again it can and will cost the company that you work for which in turn could end up costing you your job cause they can't afford you
- Chris replies to JayJay you just need to [***] cause not everyone has a cell and landline and yes telemarketers are lower than dirt cause there are other jobs out there that pay better and don't make every person that you talk to hate you
