    No more Garnishment for me
Last year, after being on garnishment for over a year.  Trying constantly to get someone at ECMC to work with me to get myself out of garnishment, and to start paying the monthly amount (didn't have the additional money, because they were already taking it out of my check).

One day after spending over 40min on hold (no person ever), I was connected to the company voice-mail.  I did not have the direct number of anyone, but entered Richard Boyle's name.  I left a rather scathing message about ECMC's lack customer service, and how I wanted to clear up my account with them,  but they made it impossible by not working with me.  I left my number and asked that he call me back.

30 minutes later, Richard Boyle (the Pres. And CEO of ECMC) called me back.  We discussed issues with their hold times, fees charged, general customer service, and rectifiing my account.  He gave me the names and direct numbers of two VP's of their Califorina (where I live) branch.  He also said he would have them call me within the hour.

They called.  They worked with me to bring my loan out of garnishment.

If you are having issues with ECMC and they are garnishing 15% of your paycheck and a 25% fee (making it impossible to make any payments on your own), go as high as you can on the food chain.  Call Richard Boyle up, leave him a message.  Tell him how you feel.  Tell him what garnishment is doing to your life.  Make him understand that you are not just a number.

Meanwhile, Obama is bragging about how the student loan business has been reformed. Doesn't seem like that to me after reading this story.

FOR THOSE OF YOU THAT SAY DEBTORS SHOULD PAY LET IT BE KNOWN THAT STUDENT LOAN DEBT IS A DEATH SENTENCE FINANCIALLY.  UNLESS, SMART ASS MOMMY AND DADDY PAID FOR YOU AND MOST LIKELY YOU LIVED AT HOME ON THEIR DIME, YOU JUST DON'T GET IT. THEN AGAIN I BET YOU NEVER WENT TO COLLEGE BUT STILL LIVE WITH MOMMY AND DADDY OVER THIRTY AND STILL RIDING THE GRAVEY TRAIN WITH ALL OF THE ABOVE GOVERNMENT THEIVES. SO GET REAL AND MAY YOU EXPERIENCE FINANCIAL HARDSHIP IN YOUR LIFETIME.

That's not true....just because it is a student loan doesn't mean that the debt collector can break the law.

Last year, I wrote back Dept of Ed 3 times (and enclosed copy of their notice so they'd know who, what, where, etc) after receiving notices I was about to default on my student loans and told them I'm on disability and had heard there's some sort of special something-or-the-other where disabled people unable to work do not have to pay their student loans as long as they are disabled and I needed that paperwork, whatever it was called (something that the borrower partially fills out and borrower's doctor has something to complete as well). I never got an answer - guess they couldn't put forth the time or effort to drop the forms in the mail. Of course, they did find the time and put forth the effort to keep sending me more notices! When I finally called and explained the situation and all the requests to send the paperwork and put me on deferment in the meantime, the lady said she would take care of the 1 year deferment right then while I was on the phone. Less than 3 months later I started getting notices again. I ignored them at first but when they started coming more often I called and told them I'm on deferment for a year, guess what I found out? She put me on deferment for a Month (!!) not a year! I never heard of a 1 month deferment!
Hopefully, President Obama's initiative to reduce student loan debt will take care of at least some of the low-down tactics used to collect student loan debt that would be illegal if it were any other collector and will put some checks in place on these idiots (no political comments against the President please - we are only talking about the student loan issues)! I know 2 people who have so much student loan interest and some other kinds of fees (not sure what they are) that those charges/fees are more than triple the original amount of the student loans! Let's start our own student loan collection agency - then we can use all the money we make to pay off our own loans, lol!

Criminal proceedings ... Uh, right, Buffalo Bob.

    Jeez, what a moron.

Guess what, student loans are collectible until the day you die.  And state guarantee agencies like this one are exempt from the Fair Debt Collection Practices Act.

So guess again, Buffalo Bob.  You sly dude, you.

They're not "breaking the law," and you're 100% wrong.  The FDCPA does not apply to this company.

In court??  Buddy, they can go straight for your tax refunds and your wages and your bank accounts, they don't have to go to court to get you.  Federal student loans collected by state guarantee agencies are a whole new ballgame.

This is the very first well-reasoned and intelligent post I've read here about this company and the subject matter.  Good for you.
