- This Just In...Consumer Alert: Attorney General warns Kansans of debt collection scam
January 29, 2010 -- Attorney General Steve Six is cautioning Kansas consumers about telephone calls from apparent fake debt collectors who are impersonating law enforcement officers in an effort to extort money from consumers. Consumers are warned to not submit payments to these fraudulent debt collectors.
When calling, the scammers most often state they are attempting to collect a debt related to an internet payday loan obtained by the consumer, but which the consumer never repaid. Consumers state they have never obtained such a loan or paid off the loan years ago. The scam artists have most recently identified themselves as ACS, National Affidavit Processing Department and United Financial Crime Division, but may use additional phony names. It appears the phone numbers used by the scammers are “spoofed” numbers, so that the number appearing on a consumer’s caller ID is not the actual number of where the call originated. It appears the calls in question may be originating from outside the United States.
When questioned, the individual calling refuses to disclose the full name or address of the collection agency they claim to represent. These scammers have been able to provide consumers with identifying information, such as the consumer’s social security number, home address, e-mail address, names of family members and the consumer’s computer IP address. Since the callers are able to provide valid personal information, consumers may become confused and believe they are being contacted in regard to a legitimate debt.
If the initial debt collection scam is unsuccessful, consumers have been re-contacted months later with the scammers posing as law enforcement officers or officers of the court. Typically, the consumer is threatened with arrest for fraud or some other fictitious crime unless the consumer agrees to immediately wire money via Western Union. The fictitious officers strive to frighten and confuse consumers into compliance by using legal sounding terms such as “We’re filing an affidavit against you” or by stating a lawsuit has been or is in the process of being filed against the consumer.
A hallmark of each scam has been calling consumers repeatedly at their place of employment. This scam hit home when an employee of the Kansas Attorney General’s Office was repeatedly called both on her cell phone and at work. Despite the employee’s repeated verbal disputes, the caller refused to provide any identifying information to allow her to send a written dispute. The scammer also continued to call her numerous times a day regarding a payday loan she denied obtaining. Two months later, she was again contacted by telephone by an individual identifying himself as an “officer”.
“I denied owing the debt and refused to pay without being provided validation of the debt. I was then told, ‘If that’s the case, I will have local law enforcement come to your place of business and drag you out kicking and screaming’,” stated the employee.
“It is important for consumers to know their rights under the law,” Attorney General Six said. “If a consumer is receiving calls from a debt collection company and believe it is a scam, I encourage them to contact our office immediately.”
Under the Fair Debt Collection Practices Act (FDCPA), collectors are required to send consumers a written notice within five days of the initial contact. The notification should contain information such as the amount of the debt, the name of the creditor to whom the debt is owed and a statement informing the consumer they have thirty days to contact the debtor in writing to dispute the debt or request validation of the debt. In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer’s arrest, or using the threat of violence.

- Kimberly| 1 replyA man, with a foreign accent, by the name of "Bryan Smith", from ACS Debt Collection Agency (a company that does not exist) had left me a message (Friday Morning) stating that I had a debt that I needed to resolve.
I called "Bryan Smith" back (on my lunch) and there was a lot of background noise of other people talking, they also had the same foreign accents as well. I had a very hard time understanding this man and asked several time to speak with someone who didn’t have such a strong accent. I was then transfer to a women, by the name of Della Dole, with the same strong Middle-Eastern accent, whom she stated to be the supervisor.
She asked my name, which I gave. She then proceeded to tell me that I had an online payday loan debt in the amount of $621.00, though Advanced Cash that she was attempting to collected. She gave me my address, phone number, e-mailing address, birthday, social security number, my references, my employment address, employer phone number, and my banking information. I had told her that someone has stolen my identity and applied for this loan. I told her I’ve never, ever, applied for any money through this company in my life and I would not be paying for this. I tried several times giving them my lawyer’s information and she wanted nothing to do with it.
"Della Dole” told me if I didn't pay the $621.00, over the phone via, Western Union they would have a warrant for my arrest for failure to pay debt. I demanded the number to Advanced Cash and she stated she could not give me that information. After argueing with her, she gave me a number 323 410 2877. I told her I would no longer be dealing with her and that I would be contacting Advanced Cash.
I’d hung up on her, called the number she had given me and it said, “the extension 50001 is currently not available please leave a message.”
Well, there was no way in hell I was leaving a message. I found in funny that it didn’t have a professional company message machine, like most payday company have. So, I figure I would call later on that night to get this issue resolved. So around 6:30 that night, I called the 323 410 2877 again, just to hear the same Middle-Eastern man—named, yet again, “Bryan Smith”.
So at this point I knew I was dealing with a scam artist. I had pretended to be just a random woman calling to speak with the manager of Advanced Cash. The man stated that he was not Advanced Cash. That he was ACS. These people were a joke. You would think if they were going to lie, they would all continue to keep the same story. Then he asked my name. I stated I will not give you my name. He then out of nowhere said, “Is this Kimberly Sandelius?” I about [***] my pants. The number that I called off of was no number that they would have known. So that mean that they had tracked the number I was calling off earlier today. Too scary. I told him that I’ve reported this scam to the police and that the FBI was involved and hung up on him, after calling him an [***]. He kept calling me back on a 000-000-0000 number. He wouldn’t leave a message. Around the 7 time of him calling, I answered the call, asked who was calling, and he stated, “The [***] YOU JUST HUNG UP ON, SWEETIE!” I couldn’t believe what was happening. I kept hanging up and ignoring his calls.
If this ever happens to you please go to your local police, as I did. Make a report. I ended up being lucky, unlike some other individuals. I contacted my lawyer, closed all my banking account, placed a fraud alert on my (3) credit reports for 90 days, had my SS# checked, changed ALL of my passwords and pin numbers, including: my e-mails, , my Face Book & My Space, my Pay Pal & E-bay, and took my banking information off Pay Pal & E-bay. We’re getting our home & cell phone numbers changed and 100 percent unlisted.
I’ve always been a firm believer, “that everything happens for a reason.” I believed I was a victim to help inform others to stay alert and keep your personal information to yourself. Don’t ignore these calls. I know for a fact that if I didn’t take the steps as I did, these “sick” individual could’ve done a lot worse to my life, then what they did. Thankfully, I acted fast and stop them dead in their tracks.- Caller: ACS

If you are targeted by these criminals, be sure to report them to all the following federal and state law enforcement agencies (most of which you can do online or over the phone):
1. The U.S. Secret Service is responsible for protecting the country's financial infrastructure and payment systems from international and domestic threats. Call or write your local Secret Service field office to alert them to the details of this attempted extortion. The addresses and phone numbers for the local Secret Service field offices are listed at http://www.secretservice.gov/field_offices.shtml or in your phone book.
2. Alert the FBI at https://tips.fbi.gov Be sure to tell the FBI that you are being targeted by extortionists over the phone. And if the crooks claim to be law enforcement or lawyers, officers of the court or bankers, be sure to include that information in your report.
3. File a complaint with your local police. Most police departments will take a report over the phone. Be sure to tell them that you're being targeted by an extortionist and give them all the details.
4. File a complaint your state's attorney general, the contact information for whom is at www.wvago.gov
5. File a complaint online with The Federal Trade Commission at https://www.ftccomplaintassistant.gov/FTC_Wizard.aspx?Lang=en
If these crooks call back, promise them nothing, pay them nothing and tell them nothing other than that you know they're a scam and that you've reported them to law enforcement. (And be sure to report them to all the agencies above each time they call you.)
By the way, here's just a small sample of numbers used by this particular group of scammers. Read the reports and you'll see the same pattern time and again -- phony organization names, thick foreign accents, and oddly worded threats that are so melodramatic and ridiculous that it's laughable:

Consumer Alert: Attorney General warns Kansans of debt collection scam
In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer’s arrest, or using the threat of violence.

http://www.ksag.org/page/consumer-alert-attor ... collection-scam - Unhappy CamperI just received 2 voice message calls tonight around 6:30pm from some Indian accent guy. I couldn't make out his name on his voice message he left me. He said he was a police officer investigating a case against me and that their is a lawsuit filed against me from a financial institution regarding my current home address (which he did state the exact address and street number), and also quoted the last 4 of my social security number. He said if I dont call him back immediately, I would be in serious trouble with the law. I tried calling the number back, but it keeps ringing, and no answer.
- Call type: Debt collector
- Middle Eastern Indian CrooksWatch out for calls from this number. They claim to be police officers investigating a case involving you and if you dont respond and pay, theirs going to be a warrant issued for your arrest. People need to understand what real police officers and investigators don't do that, and payment collection over the phone is not one of them. Thats something the court system handles.
Be on the look out for numbers that call with the following number on your caller id: 000-000-0000 or numbers with just area codes like these: 919-000-0000. They are either telemarketers, or scammers. Either way, none of them are legit. I did an online payday loan application once, and before the night was over, I received at least 15-20 text messages and emails saying I was approved and to call to get the money. I called, and it was all a bunch of middle eastern crooks trying to get more info from you. I was a nightmare trying to cancel all those text and emails. For 3 consecutive weeks, I kept getting unwanted calls emails and texts from these crooks. I personally think the US should issue an order to india that if we continue to get this kind of crap from them then we should boycott doing business with them in any way. - jeannine fuentez replies to darakhi i got the same phone call from that same #. they told me i theyre sending me to court.but [***] them i have all there stupid names and i called them back and they didnt like what i said to them.
- CatriceI was contacted also from that # and was told they were a debt collector. They 1st contacted me about a month ago. I believed them and made arangements, they called back the next week and said they did not have any arrangements and the man I spoke to was not authorized to make any arrangements. The conversation ended with alot of hollering as well as cursing. They called back a month later and I was told he was officer so and so and my story ends like the other person. He had all of my info from my email address, my job info, a couple of close friends and personal info. I set up an arrangement with him and he said he would fax me an authorization form that night for me to fax back,I was not able to open it.I will be reporting it to the Attorney Generals office tomorrow...

- JTBSame scammers are targeting me both on personal and work #. It's annoying because all calls get routed through the front desk, so the woman there has to deal with them too. I contacted the creditor they claim that they represent, and I guess they're getting tons of complaints about these guys (who have nothing to do with them). Was told to under no circumstances to pay them or give them any information they don't already have about you. I'm labeling the call type as Debt Collector because Scammer isn't listed on the drop down list. Be VERY aware - they CLAIM to be debt collectors, but they are con artists. - CodyThey left me several messages as a Kevin White. I finally called it back and was given another number to call. 347-435-2180, also a New York number. I call and talk to someone named Danny or Donny (also of Indian descent) and he told me I owe 612.00 and I can either pay it or go to court and pay out over 5,000.00.
I told him I would call him back on Monday after I had time to do some research. I found all of this information on the internet about this being fraud. Needless to say, I called the 914-930-3200 number back today for giggles, and what do you know, it's disconnected.
I will be calling Danny or Donny on Monday... To give him a piece of my mind. I just don't know how they think they can do this to people. It's disturbing. He knew my bank name, social security number, work email address, home address. I've seriously been in tears because of this. I have fraud alerts on my social security number.
If you go to experian's website, you can put a 90 day fraud alert on your social. They will contact equifax and transunion for you and you will get emails from them, or you can do each one separately. I feel a little better since I did this.- Caller: ACS
