    I did and won. They had to pay my lawyer's fees as well as the penalty to me. There are many consumer rights lawyers who will help.

    Keeps calling stating they have a case pending against the "Gonzalez " family across the street and they want info. I ignored the first couple messages but lately they threaten me with obstruction chqrges if i don't cooperate. Number one, I have never so much as said good morning to them in two years number two even if they were my worst enemy I wouldn't tell their investigator a thing. Threaten me with obstruction. Good luck with that.

    These people have been calling everyone I know for months looking for my old car. It was crashed and I had them pick it up back in August. These people have been harassing me at home, and on my cell phone which I dont know how they even got the # because its pre-paid and I just got it 2 weeks ago. They have been calling my job, my mom, brother, my landlord too. I know that if they call me one more time, or anyone I know I'm suing them. So advice to them: contact gmac and reverify that the car has been picked up totaled in August you damn annoying [***].

    And if you really have no idea where the person is???? Then what get spam called every other day from them.... I've been dealing with them over 5 months!!!! Every other day!! I know the persons voice on the phone befor they even ask for anyone!!! And i don't owe them anything but im dealing with the head ach!! just because i don't know where the person skipped out to!!! 5 months every other day!!! And on going!!!! We brought are father in law in to help him since he had no where to go he ends up robbing my computer monitor as he leaves in silence and mooches for months!!! And now i have to hear his name every other day!!!! Hell yea be mad at him but Be really [***] pissed at them calling non stop even tho ive been completly honest!!!!!! It is wrong for them to spam call for a long period of time!!!! At least in my case ive been really nice up in till a few weeks ago!! They keep saying how there taken my number off and how they understand blah blah blah!!! i mean its gotten to where if i pick up the phone they sigh i mean who the [***] they thinks going to pick up its my phone not the person it dept!!!!!!!!!!!!!!!!   ive learned my lesson but don't act like what they do is right or something its not i have a life and i shouldn't have to suffer for any one elses wrong doings!!!

    Really? If you have been informed that you have incorrect information you will stop harassing the third party that has nothing to do with the debt or vehicle in question? I suppose that's why after being harassed for MONTHS by Windsor Equity regarding a debt that is not mine, people who do not even share my last name, have NEVER had my address or phone number and sharing this information REPEATEDLY with your "investigators" and asking REPEATEDLY for you to stop calling me, that you CONTINUE to call me. I was told by one of your "investigators" that she was aware you are not to be calling me and had called my number "in error" and that she was removing my number from the system and making a note that I am NOT to be called regarding this vehicle that I have NOTHING to do with. But what happens? I continue to get calls. From other reps who say, "But this is the first time I'VE called you." I DON'T CARE! It is ILLEGAL to harass a third party after being asked repeatedly to stop calling for a debt that they're not even associated with! And the guy on the phone today tried to tell me the company is not in legal trouble for this activity...take a stroll around Google. It's all over the Internet.

    Stop trying to say you're not bad people and blowing smoke up these people's [***]. You DO follow illegal practices and you DO continue to harass third parties even when you KNOW you're calling the wrong person. I'm a prime example. So stop spilling lies and start cleaning up your act before your company ends up being shut down by the FCC.

    The message was NOT for me but for someone I know. They tried to lie saying someone is taking out criminal charges and their representing that party and need to get ahold of my friend. I kept asking what's this regarding and I can pass the message and all she kept saying was she needed to contact that person before it went to the authorities.... I basically told her GOOD LUCK on that and next time you call someone's phone give a little more info instead of being a [***]. Glad I googled the #

    Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
    "§ 809. Validation of debts
    (a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
    (1) the amount of the debt;
    (2) the name of the creditor to whom the debt is owed;
    (3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;

    A Collection Agent May Not…

    Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

    Misrepresent Him or Herself

      A debt collector may not misrepresent himself as an attorney or law enforcement officer.

    Use the Telephone to Annoy or Harass

      A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

    Threaten Arrest or Lawsuit

      A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

    Use Abusive or Threatening Language

      A debt collector may no use abusive or profane language in the course of communication related to the debt.

    Publish a Bad Debt List

      Publishing the consumer’s name or address on a "bad debt" list is prohibited.

    Contact By Embarrassing Media

      A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

    Contact a Consumer at Work

      A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

    Seek Unjustifiable Amounts

      A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

    Contact a Consumer Represented by an Attorney

      A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

    Communicate With a Consumer After Receiving a Validation Request

      If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

    Communicate With Third Parties

      A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

    Can a Collection Agent Call My Cell Phone?

    I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

      No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

    A Collector Says I Will Be Arrested if I Do Not Pay

      This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

    Just got a second message from someone who called himself Steve.  He said we were named as a relative of a woman they were looking for, only we've never heard of anyone by that name, much less a relative.  I called back and told the receptionist (presumably) this, and told her not to call again.  Then I did what I always do after receiving more than one annoying call from the same number:  I blocked it.

    They Investigate, track etc. they are not the LAW nor can they break the law or LIE and say they are the LAW that is a criminal offense PEOPLE the LAWS are available to everyone GO READ THE LAW not listen to GOSSIP or PI's who are providing and COLLECTORS who title themselves investigators!! Of course they are Investigating tracking down people for collections they are the lowest of low!!! Your best bet, if you owe money go to court and talk to the judge, we all must pay our debt but if you are behind on something, and it has gotten to the collector then go to the court the judge is your ownlly protection for them NOT TO suck you dry!!

    I dont know where you got your false information but unless actual property or services were stolen or used and not paid for such as a vet bill, they can not arrest you. The only finacial institution that can legally detain you for not paying them is the IRS .
