So, they go to a website that shows people who have not paid some bills, or whatever. They get a #, and then they try to collect the debt. No they do not have to show you proof that you owe the debt. I went to court, and the judge dismissed the court reporters, and when I asked to see the information of the original contract with my signature on it and receipts from the stores I allegedly purchase from, as was requested in my original written request filed the first 30 days of response, the judge said the collection agency didn't have to show me anything. I told the judge I would be happy to take the responsibility of paying them off but I wanted proof of my indebtedness to them. The judge put the judgement against me anyway. They have to show proof you owe it to them, all they really have to do is show a number they pulled off a website of debtors, and that number could be incorrect anyway too.

She told me no they would not take less than $60. I told her to do what she had to do. Amazing we want to start paying this off and they won't let us. I guess we will see them in court. Yes they do. Before this issue got to court, you should've demanded proof and they should've supplied it.

I sincerely have no idea how this could be. The onus for legitimacy of proof falls upon the debt collector and they have to provide proof of debt if you demand it. I really don't understand. All I can tthink of is that there are circumstances regarding your situation that you haven't mentioned here.

It's possible that this was a corrupt judge. But, it's disturbing that this agency was able to get away with not producing proof of debt. Have you talked to an attorney? The SOL for filing law suits for violations of the FDCPA is short - a year? Don't quote me on that - but if this is as cut and dried as you've written here, there are some serious FDCPA violations taking place. Talk to an attorney. Please. If you've suffered damages beyond the basic $1000 per FDCPA violation and the amount exceeds what your local small claims court will allow, you might be able to claim a variety of different sorts of damages in civil court and for this, you really need an attorney who knows this area of the law. Contact your local AG and ask them. They usually have contact information for lawyers who not only specialize in this, but who also take on cases on contingencies. At the very least, you can get a free consulation. It sounds like, for some quixotic reason, you got snowed but good. - Consumer replies to Not HappyYes, trying to bargain with a collection agency is a losing proposition - they are strongly motivated by profit so that even if they came to possess your account for free, they'll still try to milk every cent that they think that you'll allow out of you. If I were you, I'd try contacting the original creditor for the medical bill. If it's not an ambulance bill, you might be able to work out something with them. In fact, I'd guess that your chances of being able to work out some equitable agreement with the original creditor will be 100% easier and your chances for success at least that much more.
This is one of my biggest problems with debt collectors. Because their sole reason for being in business is to make a quick, easy buck, you can't get an honest deal out of them. The only way to do that is to work with the original creditor. I've said this several times and I'll say it again, 3rd party collections should be outlawed. In one of the last conversations I had with them, a representative told me that he was gonna rape me & my kids and spank my ass until it was black & blue. Then they text you from your own cell phone #. It's crazy people can get away with this. Luckily for me, my dad is in the FBI and we have located their office and they are under investigation right now.

- ElizabethThis is a collection company for Ebay or they buy debt from Ebay. Ebay refunded money to a person I sold something to. My listing clearly said New Item Not Returnable Once Opened. I also sent the person an invoice prior to sending the item repeating the terms and asked for his agreement to the terms. Ebay did not care that I had all of that as proof that I was not refunding the money. So, Ebay refunds the money to the guy and has spent countless hours trying to get me to pay them back. I will go to court before I pay them one penny. The item was a brand new electronic device still sealed in the plastic packaging. I took a picture of what the buyer sent back. The EMPTY plastic case with a note that said HAHAHA. I sent the photo to Ebay. They do not care. That buyer was a crook and Ebay helped him get away with it. They can take the loss on the chin and rot in you know where.

- FranI recieved a call from this number AGAIN. I dispute the bill but actually offered to make pay 1/2 the bill next week just to make the calls stop. NOT ACCEPTED!!!!!! She was very rude. Naomi Cruz was her name. She must be some MISERABLE woman. Now I am glad that she didn't accept the money because after reading the internet posts this is a scam company!! She was so rude!!!!!!!!!!!!
