    got a call yes I own try to work something out with a small pay I have got told go out and find work or get cans and refund then for money you have 24 hours. I told them I'm trying to get work and that things are hard , I have being sending $10.00 a month ,  or more if I have it ,does not make a different . So if you are trying they don't care at all. I get go find work and get money to us. I'm at the end of my rope over it
    Talk so fast I get lossed with them. I work for myself and I'm in my 60's yes I'm trying just hard these days.

    First Source Advantage is a legit company that works with Credit Card collections - my card is Capital One.  I've been making payments through First Source for a couple of years...if you have a credit card through another company (BOA, Cap. One or other), then they sell the rights to First Source for collections.

    First source advantage left a message the other day, mostly of a man breathing very heavy into the phone. They never said in the message that they're a debt collector or anything, so I think I'm going to file a FTC complaint to let them know they violated debt collection practices. Talk to the hand, nobody home.

    so are these people really real? I have read the comments. they have not called my cell but they have called my job and I told them do not call my job.. honestly not understanding this at all. really don't know who they are or why they are calling me. and i still dont know  what it is about. this is my first time getting a call from this number and it was on my job. so i decides to look the information up online and then that is when i saw all of these comments about this place..

    Telling them to stop calling does not cover you under the FDCPA. That's called a Cease & Desist and it must be sent in writing to the collection agency. And most states are a 2 party state, so if you record them without their permission, you are in violation of federal law and anything you record isn't admissible in court anyway.

    They called here asking for someone who does not live here. How they got my unlisted phone number I don't know. They better not call again. I believe that is harassment  isn't it???  just because we have the same last name that's a reason to CALL ME WHAT'S UP with that !!!! Good thing my last name isn't SMITH they'd be busy calling.

    They call everyday and they leave a message saying that if you are this person and if you are not hang up and call us right away. they even call at night which is very wrong. See every time they leave a message it is different people calling they give reference number and a few of them have called me back but they say it a debt i owe and any information i give them will help them and will be recorded and they do not say what the debt is and i try to call back the number they leave which is toll free with the reference number

    Yesterday on cell phone + residential phone/never left a message,
    Thentoday; this morning looking for me. I did not recognize the number & party so,
    I used my alias on Cell Phone & Residential phone.
    The party says that they will remove my numbers from my list & conversation was being recorded for quality assurance purposes.
    I also went on to say that I was conducting a legal investigation into this matter & this conversation was recorded. Then I heard an abrupt "CLICK".
    Obiously, they are some sort of a fraud.

    Your wrong dear. You have in backward. Most states are a one party state.

    Even if you live in a 2 party calling state. Get your attorney to check into getting a warrant to tap your own
    telephone for harassing and threatening calls.
    No one on here can disagree with that. What judge would deny a court order for you to tap your own
    telephone.

    Hey dear,

    You are mixing state law and federal law.  Two totally different things.
    It is not against federal law to record your own telephone as long as your telephone is in your own name
    and your name only.

    Now to states, most states law allows the owner who's name the phone number is in to record incoming calls. As for proof. After you send a cease and desist letter telling them to stop calling you.
    Call your phone carrier / company and order detailed billing. There will be a small charge but well worth it.
    Make sure you tell the carrier you want ,  out going called numbers as well as in coming numbers listed in detail on your bill.

    You will not need a recording, they should'nt be calling you for any reason after you send them a ceasse and desist letter.

    But  Rachel,  your  mixing  state and federal law. Two TOTALLY DIFFERENT things.

    A one-party state requires one party (you) to be aware the call is being recorded. No confirmation of recording is necessary to the calling party.
    A two-party state requires both parties to be aware of recording.
    Federal guidelines adhere to the one-party rule. This comes into play when the caller is calling from out of state.
    To avoid any technicalities simply inform the caller that the call is being recorded.
    Debt collection firms routinely record their calls. As a business, they are required to inform you the call is being recorded. They rarely do, which is a violation of federal law.
    When dealing with a suspected bogus or fraudulent debt collector record all of your calls. Tell them you are doing so. If they object it's a sure sign that they're engaged in unlawful practices. At this point you tell them to put it in writing and put it in the mail. Not e-mail or fax. They object, they're frauds. Simple as that.
    Be safe. Be aware.

    every day several times these people just keep calling, no messages ever left, I will be looking into suing for harrasement. Even if I do owe money I have none, both my wife & I are out of work, canhardly pay the rent so GOOD LUCK getting anything out of me - cannot give you what I do not have
