- Jay SuttonHi All:
I got a call from this company at work as well. Funny thing though. I do not owe anyone any more, well, with the exception of my student loans but I have a deferment because I am in school.
Any who, let me share some news with you. Debt Collectors have no legal right to your debt. They are not your original creditor, you did not enter into a binding contract with them, and as such you have no obligation. No they are a private business and can post negative reporting on your credit report, but before that happens respond with a letter asking them to produce an agreement that they have a legal right to collect a debt from you. In addition, request that they return your file to the original credit and then file a complaint with the BBB (you can do this online). If they persist then sue them in small claims. The limit is $5,000.
Lastly, my credit score is good again based on what I learned in the Credit Secrets Bible manual on the Credit Secrets Bible forum, which I pay $49.99 to learn the latest credit/debt strategies that 97% of Americans know nothing about.
Good luck.

- Karen MasonI have gotten 4 phone calls from this number in the last 24 hours. They ask for Christine. She has not lived at this number for 20 years. How can I get them to stop?
- AlfalfaUnder the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.
Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.
This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc. NCO Group is a debt collector that uses automated prerecorded collection calls. In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc. Mr. Watson filed suit under both the FDCPA and TCPA.
David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors. Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call. Judge Davis wrote;
[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.
Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.
So what can you do if you receive "wrong number" calls from debt collectors?
1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

TCPA: What Is It & How Does It Affect You?
The Telephone Consumer Protection Act of 1991 (TCPA) does many things - including prohibiting debt collectors from calling your cell phone without your permission. Each unauthorized call could result in the debt collector paying you up to $1,500. Here's some helpful information on the Act and how it might affect you.
What is the TCPA?
The TCPA, which was signed into law in 1991 under the first Bush Administration and codified under 47 U.S.C. 227, prohibits calls using any automatic telephone dialing system or artificial or prerecorded voices to:
•Emergency telephone lines
•Telephone lines of any guest room or patient room at a hospital, health care facility, elderly home or similar establishment
•Telephone numbers assigned to paging services, cellular telephone services, specialized mobile radio services, other radio common carrier services or any service for which the called party is charged for the call
•Any telephone call to a residential telephone line
•Send unauthorized faxes
The only way that a caller won't violate the statute is if express consent has been given - and violations of the TCPA are steep. An unintentional call carries a damage amount of $500; an intentional call carries a damage amount of $1,500. That's per call and regardless of the purpose of the call. In other words, if they call you using an automated dialing system without your consent, they've violated the Act and you are entitled to damages.
How does it affect you?
Most debt collectors use automatic telephone dialing systems to contact debtors. You'll recognize this when you go to pick up the phone and there is a slight hesitation on the other end. In fact, most debt collectors are calling nearly 100 people at a time just waiting for someone to answer. Although many have stopped calling landlines, cell phones are another story. Since more and more people are using cell phones either instead of, or in addition to, traditional landlines, debt collectors are finding their cell phone numbers using skip tracers, calling them and hoping that they don't realize that the TCPA has been violated.

I - chuckI've been getting calls from this "business" as well, telling me I owe money on my Verizon bill. I do not have a Verizon account under my name; my cell phone is part of a business account under our business, which is in my wife's name. The woman that called me spoke very fast and did not enunciate her words, and when I asked that she repeat what she said, she replied in exactly the same way. But I saw the number, and I had check it out before and read the postings on this site, so I told her off, saying I know this is a scam and to lose my number, and hung up. It will be interesting to see if they try calling me back.

- cat replies to someone who knowsYou obviously haven't had a phone number that some scam artists use as "their" phone number. I am constantly getting calls for Maria Sanchez. I don't know a Maria Sanchez. No one that knows me knows a Maria Sanchez. or any of her family that has also used my telephone number. When I try to call the collectors back, they say that they will remove the number, but soon the SAME COMPANY KEEPS CALLING AND CALLING AND CALLING AND CALLING, AND THEY DON'T MAKE A NOTE THAT THEY HAVE THE WRONG NUMBER. WHAT THE HELL ARE WE SUPPOSED TO DO WHEN THEY DON'T LISTEN. THEY SOMETIMES CALL 5 - 10 TIMES A DAY. I WORK ALL NIGHT, I NEED TO SLEEP DURING THE DAY. GET REAL
- someone who knows better replies to sad sad"if you don't believe the company is real, do a little research."
people are on this website because they ARE doing research. and have found a great deal of negative testimonials about the shadiness of the business and how much of what it is doing is against the law. If you have read the majority of these posts, most people are receiving a crabby attitude from the bill collectors from the start of the phone call. - Palafoxia replies to AlfalfaYou are correct, they are in complete violation of the Fair Debt Collection Practice Act. I believe that the Fair Trade Commission still governs collection agencies in this country and all you have to do is call them and they will send you the form to file the complaint. Keep accurate records because there are several attorney's out there that love to pursue FDCPA violations and you could end up getting the debt paid by the collection agency themselves. Everytime they call me, I lock in their number in my cell phone so that I can prove the times that they call. I do this because I have an unlimited plan and it does not keep track of my incoming.outgoing calls.
Here is just a blurb from the FTC websit:
In 2008, Academy Collection Service, Inc. and its owner, Keith Dickstein, paid $2.25 million to settle FTC charges that Academy collectors violated the FTC Act and the FDCPA while collecting debts, and that Dickstein failed to stop the violations. The settlement order announced today, negotiated by DOJ and the FTC, imposed civil penalties of $375,000 and $300,000, respectively, on Albert S. Bastian and Edward Hurt, who oversaw Academy’s Las Vegas collection center. The judgments were suspended upon payment of $7,500 each, based on their ability to pay. The full judgments will become due immediately if the defendants are found to have misrepresented their financial condition.
Here is the website that has the complaint and an assistant to help you file it: https://www.ftccomplaintassistant.gov/
I myself plan on following through with the multiple violations, please help stop these people and file a complaint yourself. All it will cost is time. - not even closeWe have been getting voice mails from this number almost daily. They always say they are calling about "an important business matter for shawn barnett". We are not the barnett family and have no knowledge of them. Of course, the message is always left by an automated voice, so picking up the phone would do no good anyway. I'm glad we've never tried calling them back. Sounds like bad news all the way around!

- AnnoyedI just recieved a voicemail from a person named Jamie. They were asking to speak to my accounts payable department. LOL -- Seriously! I deal with local small companies. I dont purchase anything outside of office suppies from officemax. so there is def. no ground to this call. Nor do I invest or spend big with my business. I mind all matters and pay cash, so again.. no grounds.
they called and gave number of 1-800-405-5085 for return call. (Jamie).- Caller: 1-800-405-5085

- Steve Johnsonthis number kept speed-dialing me with automated responses about an unidentified "important business matter." No indication of who they were, what company they were with, or even a reference number to call back with. They call every day, several times a day.

- chrisMy son has gotten numerous calls (on his cell phone) from this number over the last two weeks. The phone is listed and under contract in my name. Our cell service is through AT&T. He has not answered any of the calls, the calls come up as "Unavailable" . I have not called the number back, so I can not identify the company or type of call. I've registered with the "do not call agency" several months ago. How can I eliminate this aggravating situation?

- No Name replies to miscThe name of the company is called "Diversified". They do a little bit of everything, including debt collection. I would suggest reporting calls you get from these people to the Better Business Bureau, Federal Trade Commission and the Attorney General of your state.
- KONGMONG LORThis # keeps calling me at all time of the day, no answer just quite, very annoying and makes me upset, need this to stop
- ROBBY replies to miscI get these calls and they want to speak with accounts payable. To call Linda back at that number. I have no more information than that. No company name is left and no other information.
- vsMy sister started receiving calls from this number not stating where they were from but asking for me-- I've never even listed my sister's number as an alternate contact, so I'm confused on why they can't contact me directly if they were able to find her number and not mine. However I found this posting and seeing "Diversified" I knew I had bills from Verizon and Xcel sent to this collections agency. I tried to call them to correct their contact info for me and let them know they should still be able to send communication via mail instead of bothering my sister. I was on hold for 30 minutes, with an automated voice chiming in ever 15 seconds to let me know an operator would be with me in just a minute-- suddenly the automated message looped very fast for a minute, then chimed in a new message saying they were not available and to try again later, then it hung up.
I plan to send them a letter informing them they may only contact MYSELF on this matter, not my family, and that I prefer a document in the mail in writing as opposed to multiple harrassment calls every day.
Hope this helps others!- Caller: Diversified

- Duh - - - My name is not John DoeI keep getting these voicemails from (800) 405-5085, for a gentleman I don't even know. My voicemail states my name (which is not John Doe and is the wrong gender too) alone. I called back the number, to inform them that they have the wrong # and person, the guy on the other line kept asking me what my name is. I told him its not "John Doe" (Duh) and he kept pressing me "what is your name" "I can take care of this if you give me your name" - - - so I gave him a bogus name (what would having my name assist them), thinking it would stop the calls - - -WRONG -!!!!!

This lady left behind a voicemail message:
"This is a message for Illiana Amanda, it is important that you return this call. This is Katie."
I am happy I checked the number out first before picking up the call.
I hope they do not call me back again!- Call type: Debt collector
