They are very rude and and antagonistic and violate many of the fair debt laws established by the federal govt.  They have been hounding me about a Cell Phone bill that i supposedly had after being told numerous times I have never had a cell phone from Cellular One.....never had any but trac phones and prepaid.  I had Cell one wireless internet but the account was cleared when I got DSL.  I have sent them receipts over and over but the calls continue.  Service terminated and paid in full in jun o7, but they are insisting that I owe through September.  They call multiple times in the day (illegal), they leave voice mails (illegal), called my parents and accused my Step father of being me (ilea gal and recorded , happened twice), called my place of employment multiple times (asked by my Spvsr not to after the first time, ignored him, illegal), ignored dispute letters (illegal, not supposed to call till they verify the debt to you), refused to verify the debt in writing as required by law).  contacted lawyer about it and he spoke to them and told them all communication is to go through them as required by law, they ignored it. The last rep (Christine?....refused to let me talk to a supervisor or give her last name) told me "Your so stupid to spend money on a lawyer for a debt less than 150 bucks...just pay it and it'll be over with"

I told her that i paid the lawyer because I intended to sue them and Cell one and I was sure the punitive award would more than make up for it....I did not owe the debt and it was the principle of the thing"  She replied "there are no principles in business...this wont stop till we say it does".  Will see what a local Judge has to say about that!

I am guitar player.....when the call tommorow I think i'll be polite and ask them to wait while I change phones, then hold the amp up to my Marshall amp, plug in my Fender Stratocaster, turn the gain, volume and distortion all up to 10 and let loose with a power chord!  Hope Diversified is ready to buy an employee a hearing aid!

They called my DAD! They told him to tell me "Diversified", and I would know who they were.  I ended up having to search the phone # to find out!  Ha!  I have never given my dad's ph# to anyone, except as an emergency contact.  I have never even heard from them, personally.  Thank GOD they don't have MY phone# !!  What I want to know is: WHO IS GIVING THEM MY PERSONAL INFO??!!

I'm holding off on the CEASE AND DESIST letter, for now..  They don't seem to know where I am, and I'll be damned if I'm just going to send them my address and phone# !

On the plus side, folks:  It's REALLY EASY to change your phone #, especially on a cell.  You can do it in like 5 minutes. :)

Do not call does not pertain to collection agencies. They are not considered solicitors, they are collecting debts. Report them to the state regulatory agency in your state that licenses them.

The relief act pertains to the amount of interest that can be charged while the active duty person is deployed etc. It does not mean that the soldier does not have to pay his/her debts, they cannot be dunned,or that the debts cannot affect credit. Usually, if there is a lot of debt the armed forces aren't too crazy about that. Having debt and bad credit reports tends to disqualify people from certain security clearances, etc. Arrangement should be made if possible

Again, do not call does not pertain to collection agencies. You can file all the complaints you want and nothing will happen. If you get repeated
calls, however, you can hold them liable under the Fair Debt Collection Practices Act for repeated communications, because if a collector knows or has reason to know that the third party does not know where to reach the debtor- they cannot keep calling.

I have talked to LOTS of bill collectors and this company Diversified Adjustment is by far the nicest and most professional bill collectors I have ever dealt with. After I explained my situation they are allowing me to make monthly payments on my bill until I get back on my feet. If the other bill collectors that called were as ethical as these guys they might get some of my money too!

    Of course

Of course a collector will be nice if you agree to everything they say...especially the statement that you owe them money. It is only when they are told you dont owe the debt or are the wrong person that they get pissed off. I know it is a shock but many collectors try to collect debts from the wrong person or from accts that are bankrupted or beyond the SOL. I have no problem with any collector who abides by the law. If someone disputes the debt provide them with written proof first before you continue your harassment tactics. All this is about is greedy collectors who are too lazy or stupid to follow the law. Prove it or shut up!!! Otherwise you are no better than a homeless person demanding money on the streets (no disrepect to the homeless intended, disrespect to collectors IS intended).

When a collection agency calls for someone else, the Fair Debt Collection Practices Act states that a debt can only discussed directly with the debtor or their spouse. Yes, they will ask questions like if you know the person or how to reach them, but they cannot tell you why they are calling. Just because the number is not listed to the person does not mean to the debt collector that the person doesn't live there. The best thing to do is to state that the person is unknown to you if they are, or if they have moved that they no longer reside there. If you start asking why they are calling, they can't tell you.

If you never call them back, and you don't answer the phone, they will never know that the person doesn't live there and will still keep calling you.

Maybe our electric, gas, telephone and medical, bills wouldn't be so high if everyone paid their bills like responsible people. Who do you think ends up paying for all the people that don't pay - me and you! I am thankful for bill collectors, at least they collect a portion of the money that is owed which ends up saving you and I some money in the longrun.

If you will read the majority of these posts, you will notice that they are harassing people about someone ELSE'S debt and the few here who have admitted to owning the debt have PAID it.

More than likely when you filled out the application with the phone company you put down your dad's name as a contact number, or you were at that address and a reverse directory was done. Your personal information was given them on the application you filled out for the cell phone.

Call comes from 800-279-3733 and says to call 800-504-8612. My guess on this has to do with cell phones purchased by others and your number is given out as a secondary contact number. The cell phone doesn't pay the bill and the cell phone company calls you about a hundred times. When they can't collect they send the info here so this company can continue to harass you. I was getting calls prior to this from US Cellular about "my account". I don't have US Cellular. Good luck.

The above is an example of the intellect of collectors. Somehow they feel that they can call and be rude, condescending, and obnoxious, and then argue that someone should be in jail for not paying a bill. "employee" above seems to have lost the gist of this thread, that the agency is calling a wrong number and being rude to third parties and should not be calling these people at all.

Again, I know that collectors are mentally challenged, but let's get the argument straight. The agency Diversified Adjustment Service is calling a wrong number and they have been told several times. They continue to call. They are wrong. Collectors believe that everyone is a liar, that everyone is a deadbeat, and they get their kicks out of beating up on people on the phone to take their minds off of their own bad debt and limited social skills.

    Also, regarding this quote:

"why should we be in jail? because people dont pay there bills now its our fault? yes we are all americans maybe you should question yourself!!"

This is also a poor example of writing, which again points to the intellect of the person writing. The lack of capitalization, the misuse of "there" for "thier," not capitalizing "americans" and putting two sentences together and the lack of a hyphen in "its" and "dont."It would be better written thusly:

"Why should we be in jail? Just because people don't pay thier bills does not make it our fault. Yes, we are all Americans." Maybe you should be questioning yourself?"

This again proves how shockingly limited the thought processes are among most agency collectors. They tend to be challenged intellectually and emotionally.

That is all I have to say about this post. Thusly huh? Is that really a word? I don't think so, in fact that sounds exactly like a word that someone with little intellect states to sound intelligent. Also, it is "their" not "thier" Joe Fairdebt. I doubt you have ever collected bills, if you had to put up with what collectors put up with on a daily basis you would be probably be insane. In fact, if every person that has posted on this topic sat a day in any collector's shoes they would be hard-pressed to complain about a little attitude. As a collector treating people with respect is necessary and a part of the job, here are a few tips for people to get calls to stop or to make life better for both parties..

    1. Treat everyone with respect on the phone
    2. Be honest, it is pretty easy to tell when someone is being less than honest on the phone. If you know the person say that, give info if you want, or don't.
    3. Don't pry for information. If it's not your place then don't get involved. If it's the wrong number simply state it's the wrong number, don't ask what the company does, etc. this will only make a collector thinking you are witholding infomation, which can lead to further calls since the FDCPA clearly states you aren't to call a number unless you believe they have contact infomation (adress, home phone, or place of employment)

I will guarantee if you act accordingly then these phone calls will be quick and painless. There is no need to make a huge deal out of a wrong number, it happens. Just remember that the one call that you get is quite possibly the 400th call of the day for a collector.

I know this may not be in the perfect format, but being arrogant and belittling shouldn't be a way of life Joe Fairdebt.
