I got a call from NCO, I actually spoke with a Everett at the company.  He was extremely nice.  I just told him I got the call on my cell phone, I gave him the number.  He confirmed the person they were looking for was not me.  Explained that my phone number will be taken off the list, and the other person's account will be documented.  Just be nice and ask them to take off your number.  No need to get nasty with them.

Calls every day at least once. Leaves a voicemail saying it is MCO financial trying to collect a debt (I don't have any debts). I have answered several times personally, but get the same recorded message as is left on voicemail. If this were really a legitimate attempt to collect, I'm sure they would be talking to me live when I answer live! Have tried to return these calls, but am put on hold with music for at least 10 minutes, before I give up. Again if they were legitimate, I'm sure they would be more than happy to talk to me immediately when I call them back. How can I get them to stop calling me???

Thanks, but I can never get anyone to answer, either when they call me or I call them. How long did you have to wait with music?

I've been getting calls for over 3 years for someone I do not know.  I've told them repeatedly to stop calling me but they still call, or they sell the number to a firm in MI who eventually sells it back to NCO.  Does anyone have any luck with legal remedies?  If there will actually be an impact I will pursue it through their attorney general and/or the FTC, but I need reason to believe these agencies will actually do something.  Has anyone had any results?

A legal precedent was recently set, when NCO was successfully sued for TCPA and FDCPA violations:

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

    David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.

So what can you do if you receive "wrong number" calls from debt collectors?

    1. Sign up for the Do-Not-Call registry.
    2. Save the calls captured by your voice mail or answering machine.
    3. Contact a consumer lawyer.

Thank you for the info.  I'll look into it.  I've kept a text record of each call going back a year or so.

It's all about shifting the cost of the call to you rather than them.  They can keep their telephone people constantly busy while the idle time on the phone is the problem of the recipient.  This makes robocalling erroneous numbers a trivial cost to them.

We have been getting phone calls, recorded I believe, telling me they are a collection service and I should call them back.  I keep hanging up because I do not have any past due bills.  I am 99.99% sure it is some sort of scam. What if anything can we do?

I just got home and i see a voice mail on my phone! I listed to it and it was from NCL or NCO whatever they call their company. They said that if this was the number that they called. I told them what number were you looking for? They said a random name that i never heard before!! I said no its someone else. He apologised and said that they wont call again. After 10 minutes, i see that they left me another voice mail. What the hell is going on???? They need to stop that.

This number keeps calling and leaving a reference number to which I have already told them I do not know the person they claim have referred to me as a reference for them.  How do I keep them from calling?

Calls from this number repeated over the last few months. Just called them back today, it was for my boyfriend (we live together) from his (true and proper) doctor's office, two bills in collections from appointments in 2007 and 2008! I have no record of these doctor visits.  Don't know what to do.
