- Ihave NodebtA robot named Carlos Venezuela (why does it give it's name?) keeps calling saying "This is an attempt to collect a debt." It calls me by my last name first. But I have no debt. so I called back and someone/something answered and disconnected. Is it a machine that a company is using to verify my name and phone number for some other reason? I'd like to find out if all the other callers who have posted on these sites have something in common, like political affiliation, religion, or social cause they are involved with. There are a lot of sites like this one where you can make complaints just like this. How can we all get together to compare notes? Does someone have an email address or facebook page they'd be willing to share? I'm becoming a bit of a conspiracy theorist lately :(

- Sacramento Medical AccountThese guys keep calling my cell phone. When I gave them my number they had my correct name. I asked what this was in reference to. They said UC Davis. I said, I just spoke with UC Davis. I have a credit on that account. They then asked for my personal information INCLUDING birth date and medical record number!!!
I said no. Please tell me what this is regarding.....they said again this is a debt and UC Davis asked us to call. I tried to tell them again that UC Davis said they didn't know why these folks were calling but she wouldn't listen and spoke right over me. So I finally said I DON"T OWE YOU ANY MONEY and she hung up on me.

- Charlie BrownThis is some collection company making blind attempts at collecting from anyone no matter what. They call my number all the time from a Carlos Valenzuela for someone else and I don't answer so it goes to voicemail. Now, the reason why they keep calling is because they are violating the law leaving voice mails assuming you are the person they are calling. They have a recording that leaves a message saying if you continue to listen to this message you acknowledge that you are the person we are calling. So wait a minute, how did I acknowledge this? Just because you are using automated robot calling this doesn't mean it gives you the right to assume you have reached the right person just because the call was answered by voice mail that you can leave details of someone else's private message. that's violating privacy laws.

I called becuz there was recent fraud committed re: one of my accounts so I wondered if I had been a victim of identity theft, maybe there was some debt out there that wasnt really mine. Last night when I called after hours it sounded like some regular persons' answering machine. I called again and spoke to "Debra" who ran the same hustle described in previous post. She wouldnt give me any info and I would give her any. So she threatened to note in my file that I refused to provide any info. Told her that works for me as I dont have any debt in collections, and therefore she probably doesnt have any legit 'file' to make note in. Glad I found this post so I know what really is going on, and will share with others.

- Getting Calls Too replies to Annie LeeThey've been calling my number for at least 3 weeks now. I suppose I'll have to call and accuse them of being a scam in order to get them to stop calling me and report them, because I don't have any outstanding debts either.

I called. they wanted my DOB, and last four of my social, told them I would confirm addy, but the rest was personal and since their phone should have recognized the number I called them from.. they shouldn't need that info. she told me "I can't help you then" my response was "then I can't help you" this is just plain old "phone phishing" at it's latest and greatest. number blocked and reported!

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

Misrepresent Him or Herself
A debt collector may not misrepresent himself as an attorney or law enforcement officer.
Use the Telephone to Annoy or Harass
A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.
Threaten Arrest or Lawsuit
A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.
Use Abusive or Threatening Language
A debt collector may no use abusive or profane language in the course of communication related to the debt.
Publish a Bad Debt List
Publishing the consumer’s name or address on a "bad debt" list is prohibited.
Contact By Embarrassing Media
A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.
Contact a Consumer at Work
A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
Seek Unjustifiable Amounts
A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.
Contact a Consumer Represented by an Attorney
A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.
Communicate With a Consumer After Receiving a Validation Request
If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.
Communicate With Third Parties
A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?
Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.
I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?
No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

- REMSame as all above. Call from this number at wee hours in the morning, they left a horribly garbled/distorted message. All could make out was something about attempt to collect a debt. Sounded fishy to me so I thought to check online about this, and sure enough it was a scam. Thanks to other people who also posted with their similar experience.

- JewelsGot a message this morning from some guy named Carlos. First he had my name wrong. Then he said I owed his bank money and that I needed to call back. I don't think so. I don't owe anyone anything. This is a total scam just like everyone above said. Don't call back or talk to these people. They're scammers looking for some frightened person to get fooled and send them money.
