    actually you can ask for a Validation of Debt (and you should) a dunning letter is only a first step in collection of the debt.  You can ask for the DV they don't have to provide it but if they take you to court you can show that you asked for evidence that they did not provide and that may make a difference.  When you send anything by mail to a credit collector always send certified return reciept and DO NOT let them have the original copy even if they ask for it....send a copy.  If you go to court you can produce it then as evidence.

    actually there are laws about attachment of fees (especially in payday loans) consult a lawyer if you are taken to court because YOU can also ask for your legal fees etc to be paid by them then have your lawyer go after them for fdcpa violations.  what these people are not telling you is that your debt has probably been cahrged off the original creditors books (and yes we all paid for it in the end with our taxes because the oc got to take it off their taxes) and the debt collector is probably the proud owner of your bad debt for which they paid pennies on the dollar for.  Tabby had posted a great information link through the Boston Globe very interesting reading.

    which is why you should always send a validation of debt.  and the judge is human too.  he does not have the multiples of west law stored in his head.  your assignment is to provide the judge with the case law refuting what the debt collectors are trying to get and yes if you let them run all over you that is what will happen

    BUT if you get sued go to court they get most of their judgements from the fact that the other party did not show up.

    They are also prohibited from garnishing government checks for disability etc. (even though it happens ALOT) which is illegal and if it happens to you or has happened to you go back to court to vacate the judgement.

    Not true. We call you, to HELP you before it goes to court. It costs money for our agency to file a lawsuit, so yes, obviously, if we can solve out of court, we will, if not, no biggie, we will just sue you for the full balance and every penny the law allows. I truely cannot believe the mentality of most of you. Talk about true deadbeats..always trying to figure a way to get out of paying someone. Do you all steal money from your family and friends too?

    Also, do they have the right to keep calling someone that they think can put them in touch with the person who owes the debt?  I got a call again yesterday, decided to answer and tell them I don't know the person they are looking for and it was 'Adam Solomon' and was a recorded messesge.......citing this is concerning the business we are currently conducting.  The Line makes me made, we are not conducting 'any business' with anyone, we are retired and tending to our own personal business. If they call again, I will once again try to answer, but I will not call them.

    Collection Agency's try to collect fom people that they have been told owes a debt.  Being a third party, they have no prior relation to these people and have no idea that the information given to them is correct.  Then they start their phone game of trying to harrass people via telephone and break FCDPA laws.  I understand that they don't fear breaking the FDCPA laws because the penalty is small and many don't hold their feat to the fire.  

    Just remember to send a letter to the Collections Agencies (within 30 days of initial contact) and demand that they validate the debt and also tell them that their calls are not convenient.  This written proof is really mandatory before a penny changes hands.  They will also be forced by law to then communicate via mail, which is a lot less obtrusive to our daily lives.

    I wouldn't even pay my friends or family a nickel just because they called me up one day and demanded I pay them that instant....would you???????

    So what is up your butt if people want to validate the debt and only deal via mail and not by telephone ?

    You sound a bit frustrated with your chosen industry.  Maybe you should think about a career change.

    This practice will only be curbed somewhat if everyone files a claim with the FTC and NJ Attorney General.  Otherwise they will gladly pay the small fine to break the FDCPA laws.

    Don't pay the bottom feeders any money.  If you owe money to a creditor and tell them that you want to deal with them only.   If for some reason they do not want to deal with you, then send the collection agency a ceas and desist letter. The judge will be very curious why the original creditor chose not to try and work it out with you.  You shouldn't deal with collection agencies, especially ones that choos no to follow FDCPA rules.

    Where exactly are you getting your information from? If anyone listens to you, they are stupid. First of all...you had your chance to deal with the original creditor. Once they retain a collection agency, they usually WON'T deal with you. If they are paying an agency to collect on a debt, then why would they want to talk to you? They will most likely refer you back to the agency.

    As far as the judge goes...he/she will not be "curious why the original creditor chose not to try and work it out with you." He knows debtors mindless games. He will, indeed, order you to pay full restitution.

    But keep doing what you are doing. No loss to our agency. We will get paid in the long run. So, be my guest, ignore my calls, don't pay me, and go to court and pay three times your original balance. Who will be laughing then? Its people like you that keep my in business. And for the record, I LOVE MY JOB!

    Not true...I had an original creditor offer me a 75% discount after they already retained a CA.

    Also, because you chose to break FDCPA rules, we will both have to pay if it goes to court.

    I got a disturbing message on my phone today from SRS Associates. Of course the number came up as Inf Provider NY 1-719-999-1430 on my caller ID but they asked me to call 603-866-521-2611 (ext. 601)
    It was Mr. Matthew Reynolds (so he says) of course they change their name all the time. The message referred to my 25 year old son and something to do with court. Being a concerned mother, I called back. This man was VERY rude, insensitive, and gave me way to much information (which was false but also illegal for him to do so.) I knew who he was because this company has called me before (under a different identity) Dave Grecco I believe it was. This is concerning a (false) debt that is more than 7 years old and definitly not any money my son every got or owes. My son was actually going to pay them at one time until the guy called him an F*ing Looser. They have also called him at work and called me and my former husband telling us we were going to be sued along with our son.
    NOT!!!
    It's all lies. They are not Lawyers, they have no right to call us, and they broke all kinds of laws. They've been harrassing our entire family for many years. I told this guy to send the court papers to me and I'd be there. I called back several times to try to get a address but they kept hanging up. HA HA why am I not surprised? Mr. Reynolds from SRS is actually a woss who knows he is doing wrong. The only thing he doesn't realize is someday it will come back to bite him. Too bad he gets paid to be a total jerk and he can't find a better job. I did a search online and I only found one court case concerning SRS Associates. They were the deffendants in the case and it was SRS Associates being sued. I guarantee someone from that company will be on here posting right after I post this. They are good at threatening people but change their names often because they know they are breaking the law and someday someone is going to find them and go psycho on them. It is inhumane the lengths they will go to, to belittle people and kick them when they are down.
    I'm talking about innocent law abiding people. I'm sure he doesn't realize I am a Justice of the Peace and would just love to swear out a warrant for HIS arrest. Too bad he can't share his REAL name. He also SAYS he is in New York but that's probably a lie too.
    NEVER pay a collection agency. Pay the original debtor ONLY!!! If they threaten court, let them. If by some slim chance you get an actual court date, go! Be prepared with all the facts, times you were contacted, family members that were contacted, slanderous remarks that were made, if they called you at work, ect...
    A legal professional collection agency will be nice. You'll notice a huge difference and they will be willing to settle for a reasonable payment. They are not nasty at all and they usuaully get better results.

    Sorry the number on my caller ID is 1-716-999-1430 Either way if you call that number it comes back as disconnected. The otehr number works, but who knows for how long. When a company has something to hide, they change phone numbers real quick!!!

    Here is SRS's contact info (which they try and hide).  You can also send them a dease and desist letter here and use this address when contacting the NJ attorney General or the FTC to place a claim.

    I just got a message from a Donna Fox also, when I called back she was gone and a Frank Shapiro (who sounded African American)said he was the paralegal and asked me questions. They have my social security number and a credit card amount I'm late on, they also said the exact words as the others above about being blindsided. They really scared me but I started to wonder if this was phoney, I just don't know how they got my information. What should I do?

    Way to go, accidents, death of bread winner, sickness, loss of jobs, etc. come to us all at one time or another in our lives, we can't help getting in financial trouble at some time in our live. Most people are reliable to pay their bills, but life upsets happen. Remember it comes to us all, if you are rich you are lucky, but the majority of the nation is paycheck to paycheck especially in todays world.

    I received a call this morning from Frank J. Shapiro, Sr. stating that my daughter is named in a civil suit by MBNA for non-payment of a credit card debt.  He claims she is being sued for $6,986.13 with an immediate payment amount of just over $5K.  This caught me completely by surprise and the more I thought about the matter the more I began to wonder about its authenticity.  Everything has to be done in a hurry so that there is no time to check into it.  What should I do?  Should I contact MBNA and will they verify that they have brought (or about to bring) suit against my daughter? I really don't have 5 thousand dollars to throw away.
