    If you go through your local phone book, find a Legal Counseling group or Counseling Attorney. They can file a stay of motion and stop the garnishment if they can prove you are head of tyour house-hold. In addition, you may be counseled to file chapter 7 to alleviate the judgement.  The only other way to satisfy the Judgment is to pay it and than you will be issued a "Satisfaction Piece" through the county where the Judgement was entered.  Honestly, paying your creditor is always the best case scenario when possible. If you are unable to pay than always seek counsel and see if you are a candidate for Bankruptcy.  Good Luck!

    I was called 2 month ago right b4 chrstmas for a loan I had through "Check & Go" by SRS and Associates Inc and they offered me a lower amount to pay out of court or there client was going to sue me but it wasnt check & go it had been purchased by another entity. They apparently forwarded the debt to an attorney in my state who works for them and sues like hundreds of cases for them gets a judgment and than tries to garnish the persons pay check.  I worked at a gas station as a cashier. The attorney who got the judgment through SRS and Associates for this other company who bought the debt started garnishing my wages!!!! I quit my job and currently work somewhere else.  My question is can those [***] find me again and start garnishing me again or am I safe??

    A Mr. David Grecko called me today regarding "business you're conducting".  I guess his last name is no longer Greckline.  I called their number (18008010065) and left a message saying that they need to call back with more information for me.  I didn't give my name seeing as David didn't say who he was calling for in the message.

    that is not a law anymore. Congress passsed a law that says they can leave a message like that because it is to be assumed that they are reaching the right party. sorry guys, but maybe you should just pay your bills.

    This is one of the best companys I ever dealt with regarding a debt.  I actually had this debt for years that I left unpaid because of my situation and my health.  I came into some inheritance the woman was very polite and courteous and actually allowed me to pay less than I owed!!!! She was so nice and I actually was appreciative for her kindness. I can only imagine doing her job what type of people she deals with and I assured her I wasnt one of THEM.  Anyway sometimes its nice to say something nice and I actually found this when I did some research myself. Sometimes we are angry with our situation and take it out on the messenger because it forces us to look in the mirror and see who is really the problem, and than we learn itas ourself and it aint pretty!!! Just food for thought

    This company allowed me to actually pay less than I owed. Miss Cats was very nice and after hearing my situation, even allowed me to pay the lesser amnt in three payments. I think you people miss the point. If you owe the money, why are they the bad guys?

    I am documenting my experience with SRS Associates aka Secure Recovery Services for others benefit.  I am NOT complaining about having to pay a bill I owe. I simply want to bring to attention the practice of unfair and illegal debt collection by this company.  I hope this helps some of you and at the very least entertains the rest...

    I received a voicemail a few days ago from "Marie Parks" ((856)691-3636) about a "pending claim" in my state.  I ignored it due to the vagueness. The next day I received a voicemail from "Cole Turner" ((856)691-3636) about a pending civil suit. He went on to say that he was wanted to go over documents with me so I am not  surprised by the events to come. I returned the call to (800) 801 0065.

    I asked to speak with "Cole Turner".  The man on the other end did not give his name but asked for my case # (referenced in the voicemail) and my name. He did not transfer me to Cole but asked if I could settle the debt.  I told him not today but I could make a payment in 3 weeks.  He then hung up on me.  I did not get disconnected or drop a call. I actually head the phone hit the receiver.

    I called right back and explained that I was hung up.  This time I spoke with "Donna Fox".  She told me unless I could take care of my loan today, I was going to be served with papers next week for a payday loan obtained a year ago.   I explained my situation further and after pressing some more, she offered to reduce the debt as part of a settlement and to call her back in a couple of days to make the first payment.  I agreed and hung up.

    I then right away googled SRS and the only thing I found was this forum and a website "under construction".  After reviewing these posts, I decided to perform some due diligence.

    I called my original creditor - they informed me that the loan had been sold to AIS Services and they could not help me.  I called AIS Services (888) 920 1300.  "Kevin Kettles" told me that his company also had my account and they had never heard of SRS.  I was then transferred to the supervisor, "Debbie Meyer".  Debbie told me that my account was red-flagged and unless i paid it today it would be sold to another company for litigation.  I asked what company and when and she could not tell me.  I brought up SRS and how they said they have my loan and she instructed me to call SRS (although she'd never heard of them) - ask for my original account # to make sure it was the same loan.  She then went on to say that the loan had "probably" already been sold and gave me an actual date.  I told Debbie how SRS had threatened "civil" litigation against me and she said they cant do that because it was acquired last week and I have 30 days BY LAW to clear up the balance.  (again, my intention is to pay back the loan in 3 weeks).  

    I called back SRS and asked for Donna Fox.  I asked Donna for the original account number - she said she didnt have it.  She then asked if she could call me back since she was going into a meeting.  I said well I have one more question and she hung up on me.

    I called right back - I asked the unnamed woman what the full name of the company was.  She said she wouldnt give it to me until she knew who she was speaking with.  I told her my name and asked again what the full name of the company was.  She asked for my case number - I gave it to her and again asked for for the full company name.  She finally replied "Superior Recovery Services".  I then asked to speak to a manager and she rudely said "Hang on".

    "Holly Cohen or Cowen" picked up the line.  She said she was a manager.  I explained the situation and said I have a couple questions.  I explained to her how I was threatened with a civil suit and being served papers next week.  She said no one would have said that to me. And I said that I had a voicemail saved that says otherwise.  I then said that I had consulted with an attorney as well as the original creditor who both stated I had 30 days to pay a debt to the new company who acquired it and she said that is not true.  she then raised her voice a bit and asked "Are you going to pay the loan or not?!"  I said that is my intention but Im having some trouble with some your collection practices especially threats of a civil suit. When I told her I had consulted an attorney, she said to have my attorney call her. I explained that I was merely consulting and did not wish to pay an attorney for tasks that I could complete myself.  She said then said "well I am my clients attorney". I said, "you're an attorney?". She replied, well no im not an attorney, Im a paralegal." She said she would "review the tapes" where it was alleged that someone threatened a civil suit and get back to me coz she had to leave to attend a meeting.

    Not too much later, I received a call from "Marie Parks" - you'll remember her from the very first voicemail.  She claimed that Miss Cohen asked her to call me.  Marie had reviewed the tapes but couldn't tell what was said because they were "muffled".  I said well I have a saved voicemail that is not muffled.  She said "How can I help you?"  After that I was able to make the necessary payment arrangements. I told her I would call her on a certain date and make a payment on the settlement offer and in the meantime I expected no calls from her firm threatening me with lawsuits.

    So, here are some points I would like to make.

    1) If you have a legitimate debt, be prepared pay it back or make arrangements to pay it.. Legitimate creditors will work with you and not threaten you.  If you find you can not work with them contact an attorney.
    2) companies like this will use any means necessary, push the limits of the law and sometimes cross them to get money out of you. The laws referred to here are the Fair Debt Collection Act.
    3) A company like this will uses phrases like "case no." or say they are attorney's to make it sound as if they are authorized to handle legal matters or to seem like a law firm. They are not.  
    4) The last woman claimed that she would review the tapes.  Never once was I told that these calls were recorded.  They HAVE to tell you that or its not admissable in court. However, a Saved Voicemail Is.
    5) The second company that the debt was sold too said they had over 180 affiliates. 180!!!!!  the message is here, when in debt ALWAYS go back to the original creditor.  Ask for documentation.  They have to provide it. If they won't - contact an attorney.
    6) If you are able to make payments to these collection companies. DO NOT give them you're credit/debit card number or checking account information.  Arrange a wire transfer or a cashiers check.  These companies will abuse the privilege and draw out funds without your authorization - claiming you owe additional fees etc etc.
    7) Be Smart Everyone - I went through a rough time last year financially and unfortunately had to take out a loan.  It happens.. When you can, pay your debts BUT do not accept mistreatment from collection agencies and research your rights!

    sidenotes:
    1) When you see a post on one of these consumer forums - who post insults to other posters or saying "don't shoot the messenger", "pay your bills", etc - assume they are most likely hired by the said company to rebutt posts by consumers who really don't understand the process.  Another intimidation tactic on record.

    We live in Ohio, We got a loan from a payday loan here, and My husband had a heart attact and they found out that he had sugar diabetic,they put him on alot of medication, it was expensive, we are on disability and was unable to pay the loan in full, I set up payment arrangements and paid 4 payments to the payday loan, the fourth payment this month they sent it back telling me they had turned it over to Alliance Asset Management, I called the number they had sent me and they refused to set me up on payments, the next day I received a call from Donna Fox, she was very rude and disrepective, she flat out refused to make any payment arrangements, she threating us with a civil suit, to put a judgement against our house, and our bank accounts, but I was told they couldnot collect on a checking account when it is disability, but if they would take payments they could collect alot more, and would save them more money in the long run, I have talked to three differt people at the SRS office and one told me he was a vice president and refused to give me his name, only that they would file the law suit on Tuesday this week. I can only go to court and ask for a payment arrangement. The court will give you one year to pay it. You can prolong the case but you have to work with the court.You can't just let it go. Also talked to your attorney general in your area. You can file a claim with them, and the FTC. The Ftc rules are on the internet. I got a address of SRS ASSOC. INC. PO Box 97 Glassboro, New Jersey. I ask for a supervisor, to them everyone is a supervisor. These kind of collection practices gives a good collection a bad name. I called the FTC and filed a complaint on them.

    How many times have you been late or didn't pay some of your bills, have you ever lost your job, or had a illness that cause you to default, if you haven't be sure you will at some point in your life unless you, are rich. Every dog has its day, what goes around comes around. So be careful what you say about other people, you end up eating your words.

    I got a caLL FROM SRS and Associates regarding my pay day loan.  I had originaly opened this loan and than lost my job and my checking account was closed.  I received a call from Kristen Hoffman who explained the situaiton and that they now represented NCA I guess the compay who bought this debt.  I owed roughly $1,100 with interest thaT HAS accrued.  I was able to settle the debt for $800 which I was greatful for. It was my fault but was not intentional as I truly forgot about it. THE representative was very willing to work with me to resolve it and I was actualy surprised at the courteousness of the phone call as I settled other debts where ther person was a complete idiot (screaming & yelling) etc...you know the type.  Anyway she even followed up with me after it was resolved (cleared my bank) and voluntarily offered to send me a Release for the issue.  I guess sometmes for whatever reason we all see things differenty and have a different experience.  I seemed to have no problem and in fact wrote a letter to them thanking them for there professionalism and helping me. It is like anything else I guess some have good experience and bad experiences all the time with different things!!! I had bad expereiecnes with priests before in my religion, and I am sure for my bad experiecnes witrh the priest there are others who would say the priest was terrific etc.... thats why there is vanilla and chocolate.  I also know people tend to exagerate or stretch the truth for excitement purposes.  Thats just thre personality.  My feelings are just do the right thing and dont worry about the symanitcs.  I cant imagine if someones agenda is to call to pay a bill there would be a problem?? I mean why would there be if you call to offer to pay?? that doesnt make sense, it is obvious that the caller had other agendas to fuel there needs!! Anyway I thought I would write this about kristen (srs) since I see oppisite opinions on this site!

    I got a call from this number (1-800-801-0065) a couple weeks ago from a woman who seemed like she needed a vacation. She was extremely rude and pushy when I called her back. I asked her for my documents of the claim and she said I would get them in court. I told her I didn't want it to come to that and that I just wanted proof of these transactions. She told me I had another week to get my proof from my bank that the loan was given to me.

    I finally got my dad to call them and they worked out everything with him. We aren't giving them any money til they show proof of my transactions.

    Well I got a call.  Called them Back and the lady who answered the phone was plesent when I asked who this company was she did not answer.  Is that not illegal???? Do you not have to identify yourself??  Anywhoo I told her that I had recieved a call from this 800 number and yes I gave hjer my name etc.  She searched her data base and told me I wasn't in there.  That it may have been a wrong number.  Still didn't identify her company but she was very nice.

    Maybe you work for some company and they would like you to misdirect the consumer.  Under FDCPA rules a collections agency (NOT the original creditor) has rules and regs they must follow.  One of those happens to be a mini miranda.  EVERYONE do your homework.  This person even accusing you of misdeeds.....is in the wrong.  Many collections agency have bought your debt at pennies if not a penny on the dollar.  Even after the original creditor has signed off (IE gotten a tax break from your default.  Sometimes they let you know sometimes they don't.)  Always check around and if you have the opportunity  to speak with a lawyer about it do so.

    Also lists of the FDCPA regs.  If they are harrasing you and making you ill etc etc you can actually sue them for each incident.  Also they only have so many days that they can threaten a lawsuit and not follow through with it.

    Record all your conversations with them (per your state laws) most states stautes allowing recording without notification as long as one person in the recorded conversation knows they are being recorded.  

    Also if your being collected on by a payday loan check your states regulations.  Some say if you default on a loan all you owe is a certain amount.  

    BUT ALWAYS CONSULT A LAWYER AND BE AWARE>

    Check with your states laws about payday loans in some states if you default they cannot accrue interests and are only allowed to collect a certain amount.

    I have come up with a sure fired way to put these bullies out of business but everyone has to be on board!! This bullying is their bread n butter. The more they can squeeze out of us, the bigger their commission check. My plan ....(I should run for President)....is that if we all pay our bills, they will have NO WORK, and therefore, we will shut them down!!! HUH??? Who's with me on this??? Dont offer them 'job security! DAMN THEM!!!
