It is not us that owe anything, they are trying to find my ex-daughter-in-law.  the first call from 'Holly' referenced her.  We are retired and owe very little and things I do owe, I am up to date on, such as one credit card, one gas card, car payment, etc.  I know they are just trying to get a line on her, and I can't help them with that, but the tone of voice and tactics make me angry.  Holly mentioned 'issues in Texas' and 'notifing all parties involved', and then this Greco person sounded very forcefull with 'business we are currenty involved in'.  They are making it sound like we owe them, I know it is just scare tactics, but it is wrong to do this to innocent people, especially the elderly.  If this were my mother, she would really be scared.

I'm reposting my experiance with SRS because the last time I didn't get to go into detail about my experiances with them. I got a call from them a couple weeks ago saying I had a 'claim' I needed to deal with. I asked them what it was about and they said it was for the company Fast Cash Now. I told them I've never heard of the company and they said the company actually goes by Apple Cash. I said 'OK I haven't heard of them either'. They asked for my account number and my name. I gave it them and said I owed them $800. I said 'Excuse me?' I told them if the money was mine I would work out payments with them. They told me I had two weeks to pay the full amount. After I told them I had to spread it out between paychecks they got an attitude and said by that time I would be in court. So I told them to start recording the conversation because I'm giving my dad power of attorney over my account. My dad called them up and asked them for proof that I signed on a loan with my signiture and proof that it was deposited. They said they would give us the paper work in court. (Meaning they refused to hand over documents) Big no-no. So we aren't going to be giving them any money. When I go to court I won't be in there that long because the judge will dismiss it because this would all be settled if they could just give us proof that I made this agreement. I got my documents from my bank and saw that an Apple Cash place deposited $300 in my account. So now I'm also dealing with someone who has my bank account information. Yay!

Well the people I talked to were overly rude to me. They were nice when my dad called them the first time then they started getting an attitude saying I just need to pay my bills. My dad told them I do and that identity theft is common these days. Then the woman went on with how anyone would know what my birthday is and what my brothers name was. Wow... so hard to figure that out. So now I'm calling this Apple Cash place and getting proof that I signed this document and I'm going to my bank to dispute charges. =] I hope SRS likes talking to me because this could go on for a while. I'm not too scared to go to court... I'll just win the case anyway.

I think it's illegal to not hand over documents. They are liars and I couldn't care less what they think they can do. And this has nothing to do with me owing on a debt I would gladly pay if they would show me that I indeed did this, but they won't. I understand that this happens to people all the time, but the people that are trying to get money don't need to be rude. My dad said that after I talk to the bank and Apple Cash we will be calling an attorney and may press a law suit against the company.

And to those of you that are saying 'Don't be stupid, pay your bills' This isn't a place for you, you're an idiot. Have a great day. <3

It's pretty comical the way they leave messges like they are a huge corporation.  I laugh when I hear a very deep and loud voice say "this is the CEO".

Also, don't they have 5 days to send out a letter after they first leave a message ?

I've heard about that before. Also that's great. I've been looking for the address! Does anyone know the zip. I'm going to be filing a complaint with the New Jersey division of consumer affairs. =]

    ONE MAN'S OBSERVATION
I was just guided to this web site and it made for a very interesting read. I was asked to give an unbiased opinion by someone who also received a call from this company. I thought I'd share my opinion with all. It's just that. An opinion! My friend was notified that she owes some money on a credit card. She agrees that she owes it and knows it's probably time to address the issue. When I suggested she just pay it...even suggesting she try to 'work a deal' with SRS, she was hesitant to do so because of this forum. My advice was if she knows she owes it, what's the reason for not paying? She returned the call and asked 'Ms Fox' about a settlement. Ms Fox told her if she's ready to take care of it, she would waive court costs and attorney fees and even shave off some of the interest. The amount owed was $1149. But Ms Fox offered to settle it for $804.30. Needless to say, my friend jumped on it. It was all professionally handled. Even to the point of transferring her to accounting to give her check info because not all of their employees are privy to check info. They offered to put the agreement in writing and sent her a copy through email as well as the hard copy by mail.
I say this here and now to advise those of you who are willing to admit that you have a fair and just outstanding bill, to call them and offer to work with them and save yourself some money and aggravation. If you listen to these people, it can not have a good outcome. Guess it depends on what your game plan is.

For the record, I did ask to settle my balance with them. They told me that I had to pay it all at once. I told them I couldn't do it and they then said that I would have to see them in court if I wasn't going to pay all of it right away. So apparently the people who work there are very flaky. Of course they are going to be nice to your friend, she paid it off all at once. That's all they want everyone to do, when you start talking about making payments that's when they get aggressive. And if you have read many people are admitting to owing some sort of bill, they are just commenting on the rudeness and illegal actions the company is taking. Along with them lieing about what their positions are and what they can actually do. I also understand it's your opinion, but that's all it is, the things these people are stating are facts since they have actually been in contact with this company. =]

for answers to your questions g to www.creditinfocenter.com

thy have a really good forum and police the site like a mother.  they don't let people that would be abusive or untruthful about who they are post stuff there like they do here.

Like I have said before this is really just a site to garner information like what Dick is letting you know.  They actually have lawyers that can answer your questions etc.

btw you can ask on the phone all you want but best to put it in writing it is called a Validation of debt letter and they have that on the website.  also threating to sue you is a violation, they have to advise you that you are being sued, where-when-what why and the docet number.  I would go on but there are some people within our midst who would like to be spoon fed this information to use it against you so I suggest going to the website.

    good luck

if it gets too nasty get an attorney you should always consult one any way.  alot of bar associations have free legal advice evenings where you can call and ask questions like you have.  Also just don't threatin to record do so.  Just let them know, of course if you live in a one party state you don't have to let them know.

find the informatin that Dick posted below.  go to www.creditinfocenter.com and get the cease and disist letter form.  Be sure and send it cert. return receipt.  If they keep calling after you get the information they recieved your letter go to a lawyer, some do pro bono and also you might want to call legal aide since you are retired.  If they are trying to find out about your ex-d-i-l they are in violation of the FDCPA rules and can be held accountable for the harrasment.

always consult a lawyer and be aware of your rights.

Looks that way to me. Like said before, majority of the people on here have actually dealt with the company. It's easy to spot who's working for them and who has been a 'victim' of them.

The bad thing about making a 'settlement' with debt collectors instead of paying the full amount, in case anyone is interested, it will go on your credit report as a 'settlement' rather than that the debt was paid in full.  I would guess that the 'settlement' amount is what the collector paid when they bought the original debt.

you can actually have them agree to put it as paid.  you have to make sure that they send you a notarized letter stating they will do that and then IF it shows up as anything other that what the the parties agreed on you can ding them

They use many different aliases and phone numbers, but it is the same company.  They already had many suits brought against them for this type of illegal practices.  You cshould call the attorney General in New Jersey and file a lawsuit to protect yourself.  Some collectors will only play by the rules when forced to.

    Jackie,

you might want to go to a lawyer and see if you can get a vacated judgement due to factors of hardship.  If you were properly served you may have problems.  However, there are several factors that are involved, one being that you are sued in the county you originaly made the cc agreement in.  Go see a lawyer at legal aide.
