Right Annie. Just tell them that you're not that person, and they will stop calling. You're so incredibly naive, and from your posts, I'm guessing you work for this outfit. Sure, people need to pay their bills, but for people like me who have ZERO debt, and get calls from these places, its quite annoying, and should be illegal.

If these folks are debt collectors, why are they not using the mail for a paper trail?  If you refuse to have the call(s) recorded, then it's a "he said/she said" case.  They cannot present any recorded conversations as evidence if it DOES go to court....good luck.

A debt collector isn't about to use the mail just to skip trace, which is the subject of a majority of NGI complaints here. Too inefficient, too much risk of privacy violation.

Most states allow single party consent for recording. A voice recording may not be admissable but written memorialization *based* on a recording is usually just peachy. This of course holds for both ends of the phone. Please do let a scofflaw collector record, and I'll roll my own tape. Maybe some costly violations will be preserved.

Every 3-6 months, the debt of whomever had my cellphone before gets sold and the calls start up again.  Must be that time again.

I let the call go to voice mail, but they didn't leave a message.

WRONG TONTO!  About 23 of the 50 US States ALLOW phone calls to be recorded without asking permission, or sounding a beep or any other noise to alert the other person. Check the ACLU website for your states laws on recording conversations.

Many people think it is illegal everywhere because the bimbo who gave a BJ to Billy Clinton was recorded by her girlfriend telling her about the whole sick event.  The 'friend' released the recording and then got in big trouble for illegally recording the conversations. That was in Virginia where lots of  crooked congressmen and other politcians live, so to protect themselves it's not legal.

However  in NJ  NJSA 2a:156a  states that recoprding conversations is legal provided the person recording it is NOT acting under color of law (means not a cop or other law enforcement) and the person recording it is involved in the conversation.

I have used taped conversations to win several matters in court  against the objections of lawyers for the defendants and  even had to argue with a couple judges who said it was illegal, but after they had their clerk look up NJSA 2a:156a  the judges changed their opinions and my tapes were always admitted

2 things I suggest  *69 to record the offending phone number with date and time and record it . Even in stateds where it's illegal to record a conversation ,  recording the info about the call is not illegal. Then  look in the fron of your phone book for annoying calls  and you'll find another  *?? that reports  the last call to police as an official record of date and time  you claim you got an annoying call. It takes about 3  offenses to prosecute but get as many as you can.

If you speak to anyone who says they are recording your conversation  or "this conversation may be recorded for quality control purposes'' or any other reason simply say fine I'll record it also! more often than not they hang up..

Find out if your state alloows recording conversations by checking out the ACLU web site where they have all 50 states listed telling which ones allow or do not allow recording of conversation.

Radio shack has the devices to record  your phone conversations . Get one

you are making an assumption that is baseless  each state has it's own laws  and the laws for each state involved must be examined . who recorded the call? The caller in what state? The person who got the call in what  state?  Which of thge 2 states will the trial be held?

The best information is never trust another persons opinion of what is or is not legal. Ask a lawyer in your state  and double check his opinion by reading the law yourself . Lawyers, judges and cops  constanty misapply laws, issue tickets for a violation that does not exist by law, twist the meaning of the statute and basically screw up much of the time. They get away with it because  almost no one ever checks to see what is correct  or wrong. i had a case thrown out of court due to the defendants lawyers claiming the statute of limitations was 2 years and my  suit was filed on the 3rd year from the first instance. The judge agreed and dismissed the charges. 1st it was a continuing violation and therefore within the statute and 2nd the Statute of limitations for trespass is 6 years here not 2.

ALWAYS check the laws yourself even if you use a lawyer and make sure you get copies of everything your lawyer does and double check them. they do make mistakes and some are HUGE mistakes
