    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  


    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    Same as everyone else, robo type message that says there are several complaints about me and to call the 844 number, they called me from a local phone number 913-214-1288. If they have my phone number, then they must have my address - mail me something and put it writing, otherwise they need to go away.

    I received a call from this number and got the same recording.  I googled and read the comments above before calling back so I was ready for some bull****.  However, my experience was the quite the opposite as others.  The first person to answer was Lillian and she explained to what the call was in reference to after I verified the phone number they called and my name.  She was very nice and the debt they were calling about was about 6 years old but it is valid.  She provided me with  the settlement amount and offered the opportunity to set up payment arrangements or counter the offer for even less.  I was then transferred to Kalee who was able to provide a Validation of Debt Letter and Settlement Offer Letter.  I got things cleared away quickly, received a paid in full letter and look to have my payment noted on my credit report in about a week.

    and how were those letters sent to you? By email or USPS mail?

    You claim Kalee was "able to provide a Validation of Debt Letter and Settlement Offer Letter". Did you receive these letters in the mail BEFORE you paid this company? Because if not, you paid a scammer and have set yourself up to be called again and again. You see, phone calls are not valid methods of debt notification. Nor are faxes, texts, or emails. And they also lied to you about the payment being noted on your credit report "in about a week." So which are you? Gullible victim or pathetic shill?

    You don't have to believe me. I posted my experience just like everyone else did.  I had my fair share of horrible experiences with companies like these and was surprised to talk to someone that wasn't rude and obnoxious like yourself.  In my case it was a legitimate debt they provided the proper documentation to support it and it has since them been resolved.  So Yoda next time you should trying being a little more polite and perhaps you'll get a better response too. Judging by your reply calling me silly for not having the same experience as others.  Perhaps this is why people never post good things and only negative.

    I sure did get letters and I ignored them.  I also got calls directly from the lender years ago noting the same amount as well as letters.  Ignored those too.   When I called and talked to them they mailed both documents via certified mail.  So no, i'm neither gullible victim or a pathetic shill.  I'm trying to responsible and taking care of a debt.

    This will be my last time replying or checking these posts as some people are simply looking for negative information and excuses to continue to ignore the debt.  I'm sure the next person will say.  "Only a shill will take the time to respond to these messages" followed by "only a shill would think that would be someone's reply".

    Pattern of Complaints
    BBB files indicate that this business has a pattern of complaints concerning the billing and collection areas.

    Specifically, consumers are alleging that company representatives failed to abide by the Fair Debt Collection Practices.

    On March 9, 2017, Miller Stark Klein and Associates was informed of this concern and invited to discuss the pattern of complaints and determine ways in which the pattern might be alleviated. The owner of Miller Stark Klein and Associates met with BBB staff on March 22, 2017 and discussed the allegations made by consumers. The business reported the following:

    -Consumers are incorrect in reporting harassment, threatening comments, or statements regarding the consumers will be sued.
    -He reports that all Miller Stark Klein and Associates employees are aware of Fair Debt Collection Practices Act and adhere to it.
    - He added that recommendations from his last meeting with BBB (during which time the pattern
    of complaints for Omega Mediation Services, Inc. was discussed) have also been implemented for
    Miller Stark Klein and Associates.
    - He stated the telephone conversations are also being recorded. When invited by BBB to
    provide recorded calls between Miller Stark Klein and Associates staff and consumers filing complaints, he stated that due to data storage issues, recordings are only kept for a short time, and he no longer has these recordings. BBB staff suggested he consider updating his data storage frequency.

    When asked for Miller Stark Klein Associate's recommendation's on eliminating the pattern of complaints, there was little information or suggestions offered. Therefore, it appears that BBB's original suggestions (below) will remain in effect in addition to the continued recording and archiving of complaints.

    Suggestions to eliminate pattern of complaints:

    1. Remove the problem people.
    2. Add a new manager to bring order and hold employees accountable.
    3. There will be no tolerance for retaliation to consumers who are not responsive to information provided by Miller Stark Klein and Associate employees.
    4. All employees are provided with the Fair Debt Collection Practices Act, are asked to read it, and sign they have received a copy of it.
    5. Record all calls to ensure compliance of Fair Debt Collection Practices Act.
    6. Continue training of employees.

    The invitation to correct or modify this information was extended. However, as of this date, Miller Start Klein and Associates has not contacted BBB to request any corrections or modifications.

    As of this date, there has been no response from the company.

    UPDATE:

    On May 16, 2017, BBB received a response from Miller Stark Klein & Associates indicating its willingness to take under advisement all suggestions that have been made by BBB and to implement each and every suggestion within the company's infrastructure to build a better business.

    The company reports that:

    1. It has made efforts to record all conversation going in and out and recordings will be on file. Company reports this is phase one of the company's customer service.

    2. Miller Stark Klein & Associates employees including management have signed a new agreement under guidelines of FDCPA under penalty of termination

    UPDATE:

    On June 30, 2017, BBB received a complaint alleging that on June 6, 2017, they were contacted by Miller, Stark, Klein and Associates and informed that a warrant would be filed with the local court unless proof of satisfaction of the debt could be provided.

    What made you suddenly decide to not ignore this call? You ignored all other contact about this debt but suddenly decided to pay these people instead of the original creditor. You say you got letters about the debt - did you get a letter from this company, proving they could legally collect the debt? Your story is full of holes, hence the declaration you're a shill.

    Called me twice in a row using different numbers. They used my maiden name which I haven't gone by in 27 years! Says there are complaints against me. Since I have no debt,  this is B.S.! They've called several times in the past using various numbers. Gotta be Scammers, never leave a name, never give you a specific issue. Block if you can!

    Got a call from 307 area code, which is the same as mine. I think they change their number based on what state they're calling. But the number left to call was 844-243-7870. Definitely a recording as I only got half the message so it starts speaking as soon as my voicemail starts and I have a long outgoing message for these scammers.

    I received calls from 844 243 7370 several times.  Googled the number and it showed the number is from a company, CiDrep, Atlanta, GA.  The company also lists 770 212 2260.  I never answered.
