if you don't pay a bill and a debt buyer buys that bill they have the legal right to sue you if they chose to execute that right they would file a small claims lawsuit against you and get a judgment then they can enforce that judgement by wage garnishment placing a lean against any property you own or freezing a bank account if you pay your bills on time u will never deal with this issue

    You forgot a few things.

    Lurkers, read this:
A phone call, email or text message from a supposed debt collector is not legally sufficient evidence of debt.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    * Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]

    Source:
    https://www.consumer.ftc.gov/articles/0149-debt-collection

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.

IF you wish to communicate with the supposed collector / creditor, visit  the following page, for example "Action Letters" to snailmail:
    http://www.consumerfinance.gov/blog/debtcollection/

If you KNOW you owe no money, or believe the call was from a fake debt collector, please take the time to read this:
    http://www.consumer.ftc.gov/articles/0258-fake-debt-collectors

Of course the debt buyer can sue... but they can't WIN that lawsuit unless they have written proof of the debt and that they now own said debt. So if a caller can't provide YOU with this proof they have no chance in court.

but what you all fail to understand is that we have no problem to provide such proof we can provide anyone with a notarized proof of debt showing the creditor and balance of such debt if people paid their bills they would not have these issues its simple if you get a call about a bill you failed to pay then do the right thing and pay that bill but before you pay anything ask for a latter witch u will get ask for validation  of debt witch you will get notarized instead of you guys educating people on doing the right thing your tying to find way to get out of paying your debts you should all be ashamed you yourself i bet you teach your kids not to pay their bills too my parents always told me to be a responsible adult and pay my bills so i don't have to deal with the issues of bad credit or getting sued cuz i don't pay my bills

Most of us are resposible adults who due to the economy ended up losing jobs, stocks, properties you name it and had to take on lesser paying jobs just to fill the basic necessities of being able to feed your families. Not everyone has the extra money to send to a bill collector when you must make a choice wether to pay a collector or put food on the table for your children. Besides there are other ways to collect a debt without using threats and scare tactics for people. Any halfway educated person can find their rights on a computer and know when those are being violated. So before you sit there and judge as to who should be a responsible "Adult" maybe you should sit back and think not everyone is as fortunate as you to be able to pay everything so responsibly. I hope you are never found without a job and without being able to provide for your family.

    >> we have no problem to provide such proof  <<

    Good.

    >> ask for a latter witch u will get ask for validation  of debt witch you will get notarized  <<

Um ... in what country did you learn English?
The called person need not ask for a "latter" or even a letter.  FDCPA rules mandate the collector snailmail the letter within 5 days of first contact.  They do not have to be a "witch" or even a warlock.

AND, the called person need not get anything notarized.  They have up to 30 days to reply to the snailmailed Validation Notice.

    Can you spell "FDCPA"?
    Have you read the rules?

Simple pay your bills on time and pay back money when you borrow it then no one will have to sue you or call you to remind you to be an adult and pay your bills the people we deal with are not 30 days or 60 days behind they are 1-2 years behind that's called stealing money in my eyes buddy

Oh good, then you can provide the following information of this so called legitimate business.  Provide legal Name, legal verifiable street address, city and state for us. BBB page and Web site should also be included.   This shouldn't be a problem since you work for them and its public knowledge.

got a call this morn. at 9:30 did not recognize it and did not answer.then I called back and got switched to several people and was told it was about a payday loan I never made,or paid. They said they have it showing in my bank statement in 2011. I may have clicked on one of the pop up ads for that type of loan ,may have actually applied to see what the terms were BUT NEVER ACEPTED ANY FUNDS. I'm checking my bank statements. no payday loan company would wait 45 months to collect if it was true. As I think they would notify you when a payment is due and you authorize direct withdrawl from your account.Be aware of
THAT PHONE NUMBER. I'm waiting for the bank to send me statements from that time period

Keep getting calls from a guy claiming to be named Richard Gabel saying he has made attempts by postal mail and doesn't be specific what it is for. Haven't received any mail other than for my light bill or internet service Lie #1. Then call a few days later saying that he has a docket for my state and such. Lie #2 . Calls a few days later again, with a different message saying he needs my signature on some sealed documents and will mark it as refusal and say this is my last chance. But calls again a few days later again. # Lie 3 Next calls saying he will show up at my work and make myself available between the time time of 12-5 and never shows. Lie #4. This person has been doing this for at over a month or so. Keep lying and calling over and over with these phone calls.

They called my aunts home line. In which I have no idea they can get. A letter saying that I needed to be present with a witness to sign. Or someone from HR at my work. Stating that I took a payday loan from Highland group in 2011. In which I never did. I keep all my records of any loan or money borrowed. When I corrected the gentleman  named Ryan. That the companies name was Holiday that I took the loan from. His response  was "well, what do you want me to do". Just to be clear on the issue I called my old bank to send me my statment from the month they are claiming. Banks hold that information up to seven years. Apparently they said they already had that from my bank. In which I doubt. Tell next post.

This just happened to me at around 11:30 this morning. There were 2 phone calls one from a blocked number a young girls voice saying she has a summons she wanted to serve me to appear in court on Monday. She couldn't tell me why but I had to call another number 8445641077 to find out.  She also added that its possible if I settle the matter I might not need to be served at all???. I called the other number and Im pretty sure she answered that number (same voice). She transfered me to a guy who was threatening me with court and a  $4000 judgement for a $500 loan he said I took out in 2011!!!!
I asked for the proof and he said they would email it over but he never did. I called back and asked about the email and he said they would do it tomorrow??? This must be a scam. I also requested  my bank statements from 2011.
    BE aware!!!
