First I received a phone call from a blocked number. The guy said a certified letter was mailed to me two weeks ago which is a lie. I am receiving all my mails and never received a certified letter. The block number individual left a phone number 866 614 1911 which belongs to Dalton and Associates. I called the number this guy was rude as hell. I was speaking in my normal tone of voice and he said do you mind lowering your voice. I told him I was speaking in my normal tone of voice then he had nerve to tell me I was rude. I told him the person who had left the message from the blocked phone number left a rude message. Very arguementative. These people wasted mh personal time.

USPS makes 3 attempts to deliver, leaving a paper orange or yellow notice in your mailbox. The letter does not get returned until at least 21 days has passed by.

They called my two sisters and one brother in law. Said they knew that my parents were deceased. My sister called me freaked out and I called them this morning. Austin, Dalton, and Associates. Spoke to a man who transferred me to another man who said his name was Franklin Parker. They had an old address from five years ago plus my mom's old address for a house that has been empty for years. I had worked for a collection agency a few years back and asked them some questions about if they used Lexis Nexus or Reuters to do address traces. They didn't what that was. Anywho, they said the debt was about old payday loans from 2014 that I had not paid for about $640 worth but since I missed their calls in April as well as a letter that was mailed out,  it was now up to $1792. Franklin said he would settle with me for 4 easy payments of $240. I told him I hadn't had a payday loan since 2000. He said he would email me a docusign form to get the payments set up. I gave him an old email address I don't normally use. They tried sending those docusigns four times from some guy named Daniel Matthews. I then got off the phone with Franklin and found this site and found out that the FTC has put out warnings about zombie credit related to payday loan debt that is bogus and that is being used by scam companies like this one to get credit and debit card numbers. I deleted the docusigns. I also found out their physical address is to a UPS store in Riverside, CA. Yeah, this is a scam.

That doesn't make any sense.  What do you mean
    Quote:
send me the sheriff 3 time till i call back!!
    ?

You paid them $800?  Why?  What
    Quote:
    refund is on the way!!!!
    ?

If you paid them by credit/debt card you can still try to dispute it with the bank but they are not obligated to do anything about it since it is more then 60 days.  Since you did not make them follow the letter of the law, you are now considered a very easy mark and can expect lots more extortion attempts disguising themselves as debt collection in the future.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1

Also file a complaint with your State Attorney General's office.

Presumably you received this letter/email before you paid them, yes? Yet it's poor wording did not clue you in that it was a scam?
