    Message saying a 1099c and SSN has been filed for the 2015 tax year. This phone number was on the message 1-855-528-8454 to call back. The phone number they called in on was 1-334-649-6588.

    I have been receiving numerous calls from a Jason Headford.  He states that he is calling in regard to a 1099c that is going to be attatched to my address, social security number and 2015 taxes by M&S Associates.  I am supposed to call him back ASAP in regards to this matter.  He calls from a (501) area code so it looks local. I am in Arkansas.  If you try to call that number back it says it is a unworking number.  The number he gives me to call back is 855-528-8454. I haven't been answering any of the calls.  I have blocked the number on my phone so it doesn't ring but it stills goes to my voice mail and he leaves several messages a day.  I figured it was a scam and googled the 855 number and found this message board.  Looks like I was right.  There has also been a few calls with from a woman with basically the same message.  I cant remember what name she gave.

    I just got a call 1-13-2016 from (513) 815-4913.  Man identified himself as Marshall Wilcox with MNS Associates.  The message was demanding that I call him by 5:00 pm about a statement and filing from his client.  He did not ask for me by name, just left his information call back at (855) 528-8454. Did not divulge client information or what it was exactly regarding.  With so many scams happening, I don't answer calls unless they leave a detailed message for me to check the validity of the company and phone numbers.

    This is a common ploy by criminals masquerading as debt collectors who are attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this,  all for an alleged or nonexistent debt.  One of the tricks they use is to call your work place, friends, or relatives repeatedly in an attempt to shame you into paying.  They also use the “process server” ruse who calls and claims he is going to serve you, but then says you could avoid it by calling another number

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    *Keep all messages
    *Take a picture of your Caller ID
    *Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
    *Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
    *Check your SOL for your state as well.
    *Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

    A Mitchell Wilcox from mns & ass. Called was very rude said they had a conjunction  agents me. But never said for what gave me till 5p. To call him back. It was 430 alaska time so it was past 5p every else.

    This company has called me on several occasions from several local phone numbers and then from an (855) number.
    I do not answer phone calls from numbers I do not recognize.  I listened to the voicemail message and this time they left a message about filing a 1099-C against the residence, SS number and this year's filing.
    Since I do not have any past due debts, I called the number back.  I ask the guy who he needed to talk to.  Seems he was looking for another person within our family and they are calling everyone associated.  I told the guy he was calling the wrong number, I did not owe the debt.  He immediately got abusive.  I told him I did not have to put up with his attitude since I was not behind in any bills and he just kept arguing with me and treating me like crap so I hung up on him.
    I have read complaints about this place and how they treat people.  I don't owe this place anything and they need to stopping calling.

    Two calls from M&S Associates: 855 529-8454

    In a very stern police like tone...   The first message was as follows  "THIS IS MARSHALL WILCOX AND A MOTION IS BEING FILE AGAINST YOU !!! Press #1 to speak with me...."

    Then a few days later (1-20-2016) a 2nd call.....  "This is Jason Headford, and we are filing a 1099-C against your 2015 tax return.....call us now !!!"

    The 1st guy posing as a Marshall is not a Marshall because his voice was the same exact voice as the 2nd guy who said his name was Jason Headford....!!!!!!

    Will someone please investigate this SCAM !!!! and stop these criminals ???!!!!!

    I had a voicemail from a guy claiming to be a Jason Bradford today as well! He claimed that mns recovery solution was Filing a 1099 for my 2015 tax return& it would be attached to my address and SS #. These scammers need to be stopped

    Basically a debt collection scam.  Read the other posts.  Ignore and block the calls.

    Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.

    If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated

    Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

    If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

    You'll probably have to yell at them and talk over them.  Tell 'em  no scammy debt collector is going to push you around.

    You have to get tuff with these people because,  being akin to thugs, brute force is (metaphorically speaking).   the only thing they understand.

    This MNS and Associates is going around contacting people and waving around IRS Form 1099Cs.

    Total scam.  An IRS 1099C is a report of a cancellation of debt  by a creditor in favor of a debtor/taxpayer.  The amount of the debt becomes gross income for the taxpayer.

    The rules are complex for the entity forgiving the debt.  Only certain entities can issue a 1099C.

    Unless the debt collector actually owns the debt and falls within the categories listed, they cannot issue a 1099C.

    It is unlikely that the person calling you has any authority to issue a 1099C.    What is happening is that more and more of these fly-by-night debt collection companies are calling people up and waving around IRS 1099C forms  in order to frighten people into paying them something.  It's stupid and self-contradictory.  Why would a creditor/debt collector issue a forgiveness of debt, in an attempt to collect the very debt they are trying to forgive?  But of course the debt collector isn't interested in logical niceties; his or her interest is basically scaring money out of a debtor.

    A 1099C is not attached to anyone's SSN.  A 1099C is not connected to anyone's bank accounts or other property.    No more so than any other form representing gross income to the taxpayer.  The form just lays out the amount that has been forgiven and must be included in the taxpayer's gross income.

    I'm an Enrolled Agent with the IRS (inactive) and I can tell you that the persons  calling   have no idea what a 1099C is and have no authority to issue such a document.  They are  basically using the magic words "IRS" in order to scare money out of people.

    Ignore and block these calls.

    They are not filing anything, so far as I can see.  One of the reasons they won't file anything is that the creditor/issuer must also fill out the name, address and federal tax number on the form and they must file it with the IRS.  This is something they are not going to do.  They want to keep their physical location secret.

    This is just a total scam.  Ignore them.  Block their calls.
