- CWG40 replies to HollyTotal scam. No legitimate process server calls you up in advance and tells you he or she is coming by. In order to be jailed in a civil proceeding you'd have to ignore an actual order to appear. And this would be a part of an ongoing civil case.
In any event it is a total scam. If a civil law suit is pending against you, you'd have heard about it by letter from the attorney for the other side. You'd have a paper trail. You would NOT have first heard about this from some scammery-scummery debt collector who cold calls you up and starts demanding money. Ignore and block the call. Do not return the call.
Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a dime until the debt is validated
Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
You'll probably have to yell at them and talk over them. Tell 'em no scammy debt collector is going to push you around.

Local PD can't do much about a civil consumer dispute and debt collection is not the FCC's concern. Valid complaint channels include the CFPB, FTC, and attorneys general. We are not expected to take the word of strangers on the phone that we owe them, and that would be a correct posture even if the FDCPA was repealed tomorrow. Getting a few scary data points correct is not the same as documented proof that you owe, that the amount is correct, that the collector has a right to demand it, and so on. Bogus debt collectors don't need to be accurate or plausible, only convincing, like in any confidence scheme.
Compelling research on credit scoring was released just over five years ago by Federal Reserve economist Yuliya Demyanyk. The headline finding is that we have to quit calling it a "score", and supplant with the term "credit ranking". The FICO and Vantage numbers don't measure your personal best. They are more like snapshot grades on a curve. Your credit performance is compared with every living American with a credit profile before the digits are spewed. This is why you can do everything right for your credit rank and still come out wrong with a lukewarm number. This is also partly why I place no faith in credit "fixers" who may sell us on the idea of "cleaning up" bureau reports.

It is important to fixate on something if it means getting a home, which is why the cleaning started in the first place. I went from high risk to Excellent for all 3 bureaus in those 6 months. So now my main "focus" is knowing who is legit and not. Considering I have paid everything that was reporting, I now to tell them to send me something in writing if anything else surfaces.

- Ms. JonesI received a call from Steven Lewis, who claimed to be the legal manager of this legal firm called West Point Group. He said that I was being served papers for failure to show up in court for a debt that I didn't pay. He was a real [***]! When I offered to take care of my debt over the phone, he refused and asked me for my email address to send me some documents. I then looked up the company that I supposedly owe and realized that the company doesn't even exist where I lived. I called my local police department and I was told that it was a scam. The number I had to call back because I didn't answer the call because it didn't have a caller id was 424-210-8552. Please don't confirm any information or give out any information.

- Resident47 replies to ShannonThere are sadly many stories of major purchases held hostage by false derogatory tradelines in a credit report, and also of dirty debt collectors who use such lies as a weapon. You have a right to challenge anything on your reports which is untrue. The "big three" credit bureaus, however, don't take seriously their duty to the truth since we lowly consumers are not their primary customers. For some victims, trips to Federal court are needed to raise their volume. Your FCRA rights, if you use them carefully, enable you to sue an "information furnisher" and/or the credit bureaus to force the needed corrections and compensate you for having to pay more for credit.

That the hospital had filed bankrupsey and they bought both of ours debts, also had my husbands name and said they could do a payment arraignment with us.. the debt was almost 70,000 and they would settle for 5,000.. Yeah I bet they would, not going to happen...This kind of crap makes me sick..

- Stop!!!| 1 replyHe called me 4 days ago. Said his name was Jason. He said he sent a Validation of claim letter however I never received that. He said that I was going to be sued and I was not home to serve me papers . He said if it was something that I would take care of he would work with me. he was suing me for $5000 for unpaid medical bills back in 2008. I told him I don't have that kind of money with me so he said if I paid him hundred dollars this month he would take 1500 in February and that's the amount that he paid for the claim. At the time I was scared and I said yes I'll do it so the next day he called me and said he will fax me a paper and you have to sign and fax it back to me within five minutes of getting the paper and something in my gut told me not to do it. So I didn't. That weekend I started going through my paperwork because I keep all of my medical claim summary of benefits from Blue Cross and Blue Shield. From the date of service they told me May 2008 I had benefits of summary for my insurance showing that they paid their amount to an in network provider and that my amount due is $10 . I have a receipt showing that I paid back. None of it equaled up to $5000. So I called the guy back and told him that I was not going to pay him he got very rude and upset telling me I didn't understand the severity of the problem and that he was going to sue me. I told him he can't sue me for medical bills that have been paid and then never went to collections . He told me it doesn't matter if I had insurance I signed a paper at the hospital saying I will be responsible for any unpaid bills no matter what the insurance say. I told him he was false being that I work with insurance I know that is the network they pay for and you pay whatever they tell you your amount and the hospital has to write off the difference . He became belligerent yelling at me cursing at me and telling me that I didn't know what i was talking about and that he was going to sue me. I told him to send me another letter of validation so I could prove to him that I paid the claim he said I have to have a summary of benefits that has a claim number I called the hospital there was none. And he said that he was not going to give me that to give me an extra 30 days so I told him I will be at my house at 3:30 and he could have the papers there and he said oh that's cute that's real cute then hung up on me. He never called me back again. However the same day he called my husband and tried it on him. Beware he is a scam!!!!!
