Same here! I received a call on Thursday from a Christina, saying she was calling to see if I received paperwork about a Civil Lawsuit. No. She told me to call Benson & Associates and gave me a case #. I called the next day spoke with a Samantha. I only gave her the Case #. She went on to say that I owed $480 for a payday loan back in April, 2012. She had the last 4 of ss#, old job email and gave a bank that the check was written on. Told her it couldn't have been me. I was just released from the hospital and afterwards, couldn't walk for the next 6-7 months. I hadn't worked since 3/29/12. Told her I wasn't paying it and will dispute it in court. She became irriate and couldn't tell me when I should show up for Court. She hung up on me. I called again and she did the same. Third time a guy answered. He said he would it down as me disputing it and that I would be served by Certified mail or personally. I ask to speak to a Manager and he said that there qas only 2 Litigation Associates and he was one. Why didn't they send the paperwork Certified Mail at first? After the call, I realized that I had mistakenly written down the case # incorrectly and gave it to Samantha. How could she look up a file with the wrong case number? Total scam!!

 If the "paperwork" had already been submitted they would have been able to answer your question.  The answer would have been to go talk to a lawyer who would have told you that you do not go to court that quick.  You have 20 to 30 days to answer the complaint.

Whenever someone tells you that they are a "lawyer" or that they work for a lawyer or law firm, the first question you should ask is what state(s) they are registered in and their BAR number for that/those state(s).  Then go to that state and check them out, contact them directly using the information in the state registration, as these crooks have been known to research real law firm names and attorney names and impersonate them.

The fake process server/location finder extortion attempt usually consists of the following:

They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and must be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

Got call / voicemail from "Wendy Taylor" with local phone number showing on caller ID. It was morning here and she was calling from another time zone because she said- Good afternoon. Same vague urgent scam message about litigation being filed requiring mandatory phone call. Scam.

I have a civil suit filed against me

This stuff just happen to me 0ct 2 2020 some called say me from a 505 number I live in new Mexico tell me to call to Benson and Associates saying that someone was going to file a civil suit against so I called gave them the number she told me to give them and some broad got all fly with me she don't know me like that and couldn't give me no information on what money I  got from .me talking about we willBeing going to  court all I can say is bring how they got my SSN and phone but had a . iaddress that was from years again .she got one more timec to contact me she gonna get delt with

Got same call today they left message said to call Benson & Associates. 877-761-0207 Asked for address looked them up online website registered to Andrew Benson & Associates  with phone number 725-208-1760. Website was built Feb of this year and there "location" is rent by the month. I have received no paper work and was debt from when I was 18 years old.  this has scam written all over it

Like everyone else, I received a phone call from Jason Clark on behalf of Benson and Associates. He left a messaged and claimed that I had a pending legal matter that will be filed out of Alameda County and this is the second attempt to notify me. The first attempt was via mail. I got the call from an LA number 323-603-3975, but the guy left this number to call back 888-304-1026. The only things I get in the mail are the penny savers and other coupon mailers. At first I freaked out listening to this because the voicemail sounded legit. I googled the company and found this site with all the scam experiences. Last year I received calls - I finally called back & they said it was a creditor in a county I haven't lived in 15 years!  Had my former name too!  I gave the guy a hard time until he hung up on me!  lol  I just received another call asking for me by both names & left voice mail threatening me with legal action.. Knock yourselves out I'm still waiting for court documents from over a year ago!  lololololol

They have called my wife and daughter in law and me -I have no debt it is a scam

Scam caller. 14 years ago I closed an account that was in the negative $16.74. Claimed I owe the creditor $3,900. Knew my county, and my make and model of my car saying they would levy, possess, or garnish my wages. They called my parents who have private cell phone numbers not attached to the bank. I immediately spoke to the bank I owed, and they never sold the debt since it was so little, I naturally paid the bank itself since I didn’t know I actually owed them. They asked for Benson and Ass.’s Number and said they have received MANY calls about this and they were really concerned because they didn’t know how they got any of the information. DO NOT PAY THESE PEOPLE. Scum of the earth.

Did you report them to the Feds and the State?

I received a call from them and they also called my dad and my sister looking for me. The guy said his name was Jason Cox and he was calling from Benson and Associates. He said they mailed me legal documents (which they didn't) and since I hadn't responded, they were filing a civil legal action against me in my county (they knew what county I lived in).  I have no idea how they knew who my sister and dad was, I don't have them listed as such on Facebook.

I got the same call today , first call I didn’t answer from # 314-471-0439 left a message and another # to call back 877-380-0287 . They somehow do have personal info but I didn’t confirm any of it , they said they were going to serve me & I’d have go to court. I’m not even calling the court house because I know it’s a scam.

I received mail saying I had a debt with US Bank. I have never done business with them. I called US Bank and they said there is a lot of fraud and that I should not respond to them. Then I got a call from a "law firm" in Utah and they said I had a pending civil suit against me. I told them that I verified with US Bank that I had no obligation to them. Anthony got heated and hung up. Fraudsters. Used 725-208-1760 and 877 380 0273.

I got this same  BS call today and looked it up after I got off the phone with them.  They told me they have a civil suit filed against me in Delaware (I live in PA) and that it was from a creditor from back in 2006.  I said thats over 10yrs ago something like that should have been charged off and closed by now, they said yes thats true but this account was sold to another creditor and they have filed suit against you.  So heres the first thing I told them no, secondly I have been working on my credit for the last year and I know there is nothing on my credit report from all 3 of the major credit bureaus that has anything to do with this debt.  And 3 Benson & Associates is not a real company its a scam company dont let them fool you.
