- momma6catseven after i called and told them i couldn't make the payment because of no income and as soon as i knew when my disability would be approved and i would get my money i would pay the bill, they have continued to call everyday, leaving messages on a phone number I did not provide them with (caller id?) and is not in mine. It took me over 4 months the last time i had problems (when my husband & i separated) to get them to finally agree to modify my mtg (after threatening me with foreclosure even though I was paying the payment and said they didn't have to work with HUD guidelines. It took me threatening to get my US Senator, Congressman, and State Attorney's involved before they finally modified my mortgage. Now I know if I told them it is against the NC State law for any creditor to continue to call after being told not to and to contact me via mail, I am sure they would insist they are above the law. Thank God my disability has finally been approved, just waiting on the money to come in and if it's enough may just pay off the mortgage to get these people off my back.

- Craig| 1 replyGuys are calling me but are looking for somebody with a different middle initial. I have no business with them, have asked them to place me on the DNC list, to amend their records, etc, etc. In light of their unwillingness to follow the laws that govern their activities, I am getting ready to spend some time fighting back via the Attorney General's office, the BBB, and Social Media such as FB and LinkedIn.

- Don't Call MeThis number has called me several times. I DO NOT have a loan with this company. I don't know anybody who does! So WHY are you calling me? I asked them to stop calling and they say they can't. Because they need the loan holder that they are calling me about. Since I don't know anybody who has a loan with their company they can't help. They HUNG UP on me. BEWARE!!!! Before you take out any loan with Vanderbilt Mortgage // Clayton Homes be very aware of the fact they will randomly call your neighbors about you and the fact you may be late with your mortgage payment. REPUTABLE companies don't do this. Companies like Vanderbilt will and spread your business all around.

- AlbaThis number calls repeatedly on my cell phone asking for Linda to call them. No Linda here and I have no connection or business with this company. I sent them a text message that they were calling the wrong person but the message was ignored as they keep calling. I have never answered their calls or responded to their voice mail except to send that text message.
- RobertRecieved call today, no message. On National DNC list. Currently renting and have had no mortgage in over 8 years. Why call me?
- Caller: Vanderbilt / Clayton Homes
- Lee KnightI have been getting calls from this number after I switched to t-mobile and didn't get a new phone number assigned to my account. My voicemail clearly states my name. I finally answered the phone this morning and a very rude woman asked if I was Mary. I said no. She said I'm trying to reach Mary and Otis are they there? I said no they are not. Then she had the nerve to ask "Well do you know them?" I said no I do not and hung up.
Recently a collections company was sued. The person who sued them won (I believe a million dollars was awarded). They were a neighbor of the person the collections company was trying to contact, and the collections company somehow obtained their number and started harassing them. This type of behavior is just ridiculous and should be illegal.- Caller: not sure, might be Vanderbilt Mortgage and Finance
- RobertI am receiving calls asking for my step-dad. they usually call during the day when I'm asleep. I have no idea how they got my number but pretty sure my step-dad didn't give it to them. is there anything I can do to them to get them to stop calling me?

- Alfalfa replies to Gregg SmithLet them them know the next time they call they are violating the TCPA and FDCPA by harassing a non-debtor and you will take legal action against them if the calls don't stop.
Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.
Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.
This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc. NCO Group is a debt collector that uses automated prerecorded collection calls. In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc. Mr. Watson filed suit under both the FDCPA and TCPA.
David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors. Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call. Judge Davis wrote;
[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.
Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.
So what can you do if you receive "wrong number" calls from debt collectors?
1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

Calling asking about an employee...Very nasty woman (not lady because she is definitely not a lady). I would think twice about dealing with any company that is so nasty to someone who simply answers a phone for a living and is following company procedures. Do not do business with this company.

- SharmayneCalled asking for an employee. Employee doesn't work on location and doesn't come to the office. Yet, caller was insistent upon speaking with HR. Caller announced name of company after asking and I knew that was a creditor. We do not take personal calls from these companies nor do we pass on these calls to any employee that doesn't have extension. After offering our fax number and email for HR, they persisted in wanting to speak to HR. We don't do any type of verbal verifications and unfortunately this made caller very irritated. So, we played the game for a while with her threatening me and telling me how I COULD NOT deny her access to HR, etc. Well, I don't think I denied access when I offered up the email and fax number to them...... can't please them all. Bottom line, this is a place of business, not the place to conduct matters dealing with personal debt. Do not do business with these people. Think it through very carefully. So many complaints does make you wonder......

- LindenFemale called asking for someone that I've never heard of at my place of business. Don't know if this person works for us or not but could not forward her call since he isn't listed on our phone directory. I notified her of such and she then asked if there was any way I could give him a message. I told her "no".

- Deb replies to JohnHAHA...."Event reminder" Pretty funny but I know you work for them. You try to use skip tracing and call anybody you can with the same last name, their relatives, their neighbors, relatives of their neighbors, their second cousin twice removed and even call and ask ro speak to their talking parrot.
You are harassing people who have no account with you nor are they aware of your existence. Cut it out before you get in serious legal trouble. - HopeThey called me and I answered and the girl on the other side said hello and I just hung up on her.
