Those complaints contain accusations that describe an outfit that regularly violates every regulation under the FDCPA. If you're employed by this outfit, give it up. You're done here. No one reading this thread will fail to realize that the first thing to do, if called by someone using this number, is DEMAND a full, complete notice of validation be delivered to them by MAIL. NOT via e-mail or fax. As per federal regulation under the FDCPA. DEMAND the full name & physical address of this outfit. NOT a box number. The physical address!

If you were not appointed to that office there is no way a suit for fraud could be undertaken against you. In any event fraud is a crime and is handled by public prosecutors, not debt collectors. If there was a valid debt and the creditors did not make some sort of claim against the estate during the period of administration, then they are just out of luck. This is harassment pure and simple. This SIMM and Associates specialize in this sort of debt scamming.

This is the number I give to all debt collectors and then they stop - JWinn| 2 repliesi had a debt and they offered to settle the debt for 62% of the balance due. i called and spoke with a nice lady who took my information down and declared my account to be settled, closed and cleared. everyone i spoke to on the phone regarding the matter was nice and cordial.... i'm not sure where everyone's animosity is coming from, these people are only doing their job, and they're only trying to help you clear your debt. if you say you have no debt, please be absolutely sure that you have not signed or cosigned onto anything or anyone's car, house, or loan.
You can also kindly ask them to not call / harass you on the phone, they should stop, and if they don't then you can take the necessary actions to file reports against them. Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
