    If you asked them to validate the debt, and they can't do that, they can't force you to pay. I learned that from a credit counselor. I was getting calls too from companies that bought and sold debt. First of all there's a statute of limitations, usually 3 years. If the company that holds the original debt hasn't contacted you in 3 years, they have passed the SOL. Also, if you request validation for the debt, and they can't provide it, just keep disputing it. Tell them you want proof it's your debt. The thing is these companies buy and sell so many debts they get lost, combined with similiar names / places, etc. Require proof before you pay.

    Write them a short letter demanding they provide 1) a certified copy of the contract under which their demand is made, bearing my signature, and 2) provide a complete Statement off Account with all transactions, purchases, payments, and all interest and/or fees charged to said account, and finally 3) demand is hereby made that you DO NOT CALL ME AT HOME OR AT WORK, EVER, UNTIL THE FOREGOING LAWFUL REQUESTS MADE UNDER THE F.C.R.A AND OTHER APPLICABLE LAW ARE FULLY COMPLIED WITH.  Send it Certified or Registered Mail and get proof of delivery.  ALWAYS RECORD ANY CONVERSATION WITH A "COLLECTOR" OR OTHER SCAM ARTIST - otherwise you have no proof.  If they call any more, before providing REAL CERTIFIED DOCUMENTATION - which they will most likely be unable to do, you can sue them in Small Claims Court and collect $1000 per phone call - BUT YOU MUST HAVE THE PROOF YOU SENT YOUR LETTER AND RECORDINGS OF THEIR CALLS.  It also a good idea to put "All calls are recorded for my records and calling me constitutes your knowledge of and consent to the same."  Good Luck!

    This company also uses the number 800-895-3345.  They ask for people by incorrect names, Don't listen when told my number is on the "do not call list" and I do not have an account with them.  Would like to find out their "correct" address to send them a Cease and Desist letter as the previous one I sent to the address listed online was returned (PO Box 11029, Carson City, CA 90749).

    Brackfield and Associates is under investigation in Arizona and specializes in getting old/outdated collection info, often without the knowledge of the the company the debt is owed too, then tries to collect on these old debts.

    What a bunch of scam artists!  We have received about a dozen calls from these idiots, claiming to be Casey Fox at Brachfeld Law Group.  The calls have come from several different people, some male, some female, some with a British accent, some with other accents, all claiming to be Casey Fox.  Did some online investigating, and it turns out Brachfeld Law Group is in trouble with several State Attorney Generals offices for attempting to collect on old debts, invalid debts, and using various illegal collection practices.  REPORT THESE SCUMBAGS ASAP!

I have received many voice messages from Casey Fox a lady with a very obnoxious British accent(I mean very obnoxious accent, it makes my skin crawl) she states she is a non attorney debt collector.Not sure what they want, have never received any documents in the mail.

    What is a debt collector?
    A debt collector is any person who regularly collects debts owed to others and the attorneys who collect debts on a regular basis.
    Tries to recover the debts that are:
        Personal, family, and household debts are covered under the Act
        Money owed for the purchase of an automobile, for medical care, or for charge accounts.
    A collector may contact you in person, by mail, telephone, telegram, or fax.
    A debt collector may not contact you at inconvenient times or places, such as before 8 a.m. or after 9 p.m., unless you agree.
    A debt collector also may not contact you at work if the collector knows that your employer disapproves of such contacts. You can stop a debt collector from contacting you by writing a debt dispute letter to the collector telling them to stop. Once the collector receives your letter, they may not contact you again except to say there will be no further contact or to notify you that the debt collector or the creditor intends to take some specific action. Please note, however, that sending such a letter to a collector does not make the debt go away if you actually owe it. You could still be sued by the debt collector or your original creditor.
    If you have an attorney, the debt collector must contact the attorney, rather than you. If you do not have an attorney, a collector may contact other people, but only to find out where you live, what your phone number is, and where you work. Collectors usually are prohibited from contacting such third parties more than once. In most cases, the collector may not tell anyone other than you and your attorney that you owe money.
    Within five days after you are first contacted, the collector must send you a written notice telling you the amount of money you owe; the name of the creditor to whom you owe the money; and what action to take if you believe you do not owe the money.
    May a debt collector continue to contact you if you believe you do not owe money?
    A collector may not contact you if, within 30 days after you receive the written notice, you send the collection agency a letter stating you do not owe money. However, a collector can renew collection activities if you are sent proof of the debt, such as a copy of a bill for the amount owed. What types of debt collection practices are prohibited?
    Debt Collection activities are strictly regulated against the following:
        Use threats of violence or harm;
        Publish a list of consumers who refuse to pay their debts (except to a credit bureau);
        Use obscene or profane language; or repeatedly use the telephone to annoy someone.
        Falsely imply that they are attorneys or government representatives;
        Falsely imply that you have committed a crime;
        Falsely represent that they operate or work for a credit bureau;
        Misrepresent the amount of your debt;
        Indicate that papers being sent to you are legal forms when they are not; or
        Indicate that papers being sent to you are not legal forms when they are.
        State you will be arrested if you do not pay your debt;
        State they will seize, garnish, attach, or sell your property or wages, unless the collection agency or creditor intends to do so, and it is legal to do so; or
        Actions, such as a lawsuit, will be taken against you, when such action legally may not be taken, or when they do not intend to take such action.
        Give false credit information about you to anyone, including a credit bureau;
        Send you anything that looks like an official document from a court or government agency when it is not; or
        Use a false name.
        Collect any amount greater than your debt, unless your state law permits such a charge;
        Deposit a post-dated check prematurely;
        Use deception to make you accept collect calls or pay for telegrams;
        Take or threaten to take your property unless this can be done legally; or
        Contact you by postcard.

    They have recently called me as well on an old debt that I have paid (and have that proof).  I have been dealing with this paid old debt with collection companies for the past 5 years!  I have a file about an inch thick of letters to the "collection" companies (all certified) do validate this debt and have never had any of them validate or contact me again after they received it.  They just sell it to someone else.  What a joke!  I am so tired of having to prove that I don't owe this debt over and over again!  The original creditor has no knowledge of these companies and didn't "hire" them.  Most are scammers who are buying old debts or out dated debts and not taking the time to make sure they are valid because so many people fall for their threats.  Learn your rights!  If I owed it, I would pay, but I already paid it!  I noticed that they put this debt on my credit report, I disputed it through the credit reporting agencies and it couldn't be "validated" so they removed it.

    This letter is being sent to you in response to the letter I received dated November 1, 2012. Please be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

    This is NOT a request for "verification" or proof of my mailing address, but a request for VALIDATION made pursuant to the above Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.

    Please provide me with the following:

    1. What the money you say I owe is for
    2. Explain and show me how you calculated what you say I owe
    3. Provide me with copies of any papers that show I agreed to pay what you say I owe
    4. Provide a verification or copy of any judgment if applicable
    5. Identify the original creditor
    6. Prove the Statute of Limitations has not expired on this account
    7. Show me that you are licensed to collect in my state
    8. Provide me with your license numbers and Registered Agent

    At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major credit Bureaus (Equifax, Experion or TransUnion) this action might constitute fraud under both federal and State Laws. Please have this removed immediately.   Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate in bringing legal action against you for the following:

    1. Violation of the Fair Credit Reporting Act-reporting inaccurate information
    2. Violation of the Fair Debt Collection Practices Act-continuing collection activity on a debt which has not been validated

    Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes listing of any information to credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.

    REQUEST FOR CEASE AND DESIST OF CONTACT BY YOUR OFFICE: I would also like to request, in writing, no further contact, either in writing or telephone be made by your office to my home, cell or  to my place of employment, unless it is to provide validation or release of liability of the debt. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with third parties, it will be considered harassment and I will have no choice but to file suit.


    It would be advisable that you assure that your records are in order before I am forced to take legal action. This is an attempt to correct your records; any information obtained shall be used for that purpose.
