- TimGot a call from these guys stating it was very important that i returned their call or legal action would be placed on me so i called em back and spoke to a mr. John Smith. he said he was calling in regard to an HSBC credit card i had back in 2004. H said i owed $1210 but i was certain it was paid off so i told him sue me. 4 week later a got a garnishment order form the HR dept for twice as much what he told me i owe. HR said the order was legit. what should i do.

- Kathy| 1 replyThese people have been calling me for weeks. I aready knew it was from a collection agency because the call was coming from an 800 number> In particular 1-888-217-2701. I finally called them and set up a payment arrangement with them to satisfy a bill which they said was placed in their office for collection. Then i missed one of my payments with them but i had already may 6 paments. Then I found this sight and other like it where some said i could reverse the charges which i had my bank do. Then i got a call from a Mr.Davenport who said he was in the fraud dept of Hearshe Kemp. He asked me if i had the payments reversed and i said yes.Then he said did i agree to these payments with a Mrs. Judd and i said i did not remember. He told that that i did because he had the conversation recorded and that all of their trans actions are recorded. So i said whatever and hung up, not realizing they had an office here. Now im being sued for fraud and stating false information to a finacial institution in regard to a credit card debit. Can they really do this. I can't afford to pay an attorney and now the bank has closed my credit card account. This isnt right

Your so-called "advice" is neither helpful or called for. You are also making boorish generalizations about an individual you know nothing about. Furthermore, it is Davenport's behavior that needs to be called into question here, for HE is the one who has broken the law by making false statements and accusing this lady of fraud:
807. False or misleading representations [15 USC 1962e]
A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
2) The false representation of --
(A) the character, amount, or legal status of any debt...
(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.
(7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.

Needless to say, they CANNOT sue you for "fraud" and "making false statements". Davenport is the one who is in trouble, and NOT you!
First of all, stay OFF the phone!
Second, go to the the FTC's website and file a complaint:

permission to debit her account and then after it was all paid up and she probobly got a letter stating her debt was paid. She then claimed then reversed the charges. If that isnt fraud then I dont know what is. Once you authorize a credit collections company to debit your account isn't that admisision tot the debt. Why do you think her bank closed her account. So Alfafa it seem your advice is only going to get people who really want to clear up their debts in more hot water. Think you should get sued for dishing out advice to people before you truly know all the circumstances. By the way are you any attorney. If and when this economy turns around, all the people who claim to be victims of unscrupulous debt collection practices wont have to worry because they will not be able to get a loan any where of the face of the planet with the new banking regulations which are current being drafted and hopefully put into law. I wonder if someone owed them the amounts of money which they owed their creditors, to what means would they got to recoup their money. Sure they probably be shooting one another. Recently I reviewed my credit report and found out that I had a collections account, I called the company and they said they no longer have the account and that it has been send to this so called hershey and KEMP, has anyone of you checked your credit report to see if they DO report to the bureaus? - GaryI also had an account which is is in default and on my credit report. It listed the original bank which i had the loan with but when i called the bank to pay the bill they said they no longer had the debt in their office and that i could not pay them the bill. I asked them who had my account and they said the same company hearshy kemp llc. They said if i wanted to remove the bill from my credit report i would have to call these hearshey kemp poeple so i did. They did have the bill in their office so i said what do i have to do to resolve this matter. They wanted me to pay all of the bill at first but then i asked can i pay a smller amount or a settlement as it is called. After going back and forth for about two days i finall got them to give me a settle payment for about 30 percent less than what i actually owe. They also sent me a letter saying that the bill is paid but it will be about 30- 45 days before they remove it from my credit report so ill see what happen
