Dont believe anything they say. Check your credit report and go off that solely, do not return any calls and record every call that you make to them. Make sure to listen for " This is an attemmpt to collect a debt and any information obtained will be used for that purpose only"
If they dont say that - then they are not a real collections agency and if they dont say it - YOU ARE NO LONGER responsible for the debt!!!

    thanks

    Viktoriya,

I'm glad I came across your information. I too received calls from this Miranda Lewis just today at work. When I asked her to send me whatever info she had in writing, she stated that 'they' had sent several letters to which i replied i did not receive them, and would remember if i had. Several times she tried to get me to give her my account information, but I stated i would prefer to mail it to her, noting that the last time i did that with someone they took out more. So then she put this person Steve on the line who told/suggested to me that i could call my bank and tell them to give me my account information over the phone and call them back in 30 minutes because he couldn't hold it until 5:00pm; although Miranda had already told me that could be done. He seemed taken aback when i told him i don't carry my check book around with me, and would prefer a debit card info. Long story short, he kept telling me that he had 'higher ups' to report to, that she (miranda) was doing me a favor by splitting the payment and that it would only take 2 minutes to get the info from my bank, and then they would email/or fax me confirmation. To which i replied my place of employment did not like employees using facility for personal business. (had already told him several times i was at work, but he kept talking over me, so i just became quiet because i knew i was reaching the point of telling him something. needless to say 30minutes have passed, and if i do call it will be on my terms. i refused to be bullied by anyone. Thanks for your very informative information.

    Poohbear,

Thanks for reading, these people are scammers and like i said before - bully you into paying a bill they cant confirm in writing. Another message i will pass on to you, that it is against the FDCPA regulations for them to call you at work, next time you talk to them, if you do, make sure you tell them that they are violating the FDCPA and see how quick their "so called" nice attitude changes within 5 sec. Report this fraud to FDCPA, me and my friend are already pursuing a lawsuit b/c of the numerous FDCPA violations and it will help to bring these scammers down.

    Thanks

I have an update on the situation with my friend. She hired a lawyer, which i have stated in my previous post and her attorney advised her to get in contact with Hearshe and Kemp. She was told to call them to give them her mailing address so they can send her the Settlement Letter they have been telling her about. When she called them, Steve character got on the phone and told her in these exact words - that she was FULL OF [***] and hung up on her, she tried calling back numerous times and they kept hanging up on her.
Her attorney sent them a representation letter and after she called them to let them know that they no longer have the legal right to contact her- they called my friend at 8:58 pm to tell her that they were willing to settle the debt. How can they call her at 8:58pm when their hours of operation is 8-5pm? Like PoohBear stated before that Steve could hold the payment until 5pm - so they still claim they operate until 5pm, yet call debtors at 8 and 9 pm....

    Interesting, right?

I fell for the same thing.  Admittedly, I had debt from my previous marriage.  A large majority of which was incurred by my ex-husband.  I have been taking baby steps to get back on my feet and pay this debt off.  Hearshe and Kemp hounded me for months while I was working to pay off one debt.  I paid that off and agreed to pay $390 that Hearshe Kemp stated I owed.  They took $100 out of my check account with the agreement that the final $290 would come out at the end of the month.  If, for any reason, I could not do that, I was to contact them immediately.  I did contact them on May 27 to say that I would not have enough funds in the account to satisfy the $290 withdraw.  I asked that they put it on a credit card that I use for emergencies only.  They agreed.  While on the phone with them, I was told the check withdraw was cancelled and checking information deleted.  In addition, they took my credit card number and would place the charge on there.

On May 29 my credit card was charged the $290.  I thought everything was great and taken care of.  On June 3 a debit of $290 appeared in my checking account!  Imagine my horror?!  I then emassed overdraft fees in the amount of $185.  I was livid.  What happened to them deleting my checking account information?  I contacted them on June 3 and was told that there was a huge error.  One of their new employees placed over $20,000 into other clients accounts.  As if and not my problem.  I told them I wanted a credit of $475 placed in my account immediately to cover the $290 and $185.  I was assured that would happen.  It would take time.  The $290 was credited....no sign of the $185.  Guess what?  On June 11 the $290 was debited again from my checking account!!!!  I called all day and finally refused to be placed on hold or hang up until I spoke to someone in authority.  Finally I was spoke with Steve Devereaux (who is supposed to be the owner).  He assured me that he would personally take care of everything and that "heads are going to roll" and "someone is getting fired today."  He even went so far as to give me a transaction number and batch number for the $475 and personally guaranteed it would be taken care of.  Yeah, no....didn't happen.

On June 12 I called asking to speak to Steve.  He was available.  On June 15 I called again asking to speak to Steve.  He was available....and of course, he is the only one that can handle returning ones money into a checking account.  On June 16, I called again.  I was directed to Miles Davenport (who is supposed to be Steve's assistant).  This person said he was sorry, blah, blah, blah and that he, himself, would personally take care of this matter right here and now.  He gave me transaction numbers and batch numbers for the $290 and $185 that I'm still owed.  He stated that he would take my checking account information off of my record so that nothing else could be debited from my account.  The $185 did appear as a credit in my checking account the next day.  Where is my $290 you ask?  I'm still asking the same question.  On June 17 I call.....no one knows who Miles Davenport is.  I say he is Steve's assistant.  I spoke with him yesterday.  Nope, don't know him.  I ask for a manager....I get Wilbur Randolph.  Wilbur doesn't know who Miles Davenport is either....but then he doesn't work over in the checking division.  I call on June 18, I ask to speak to Steve and I do not want voice mail, I do not want placed on hold and I will not hang up until I speak to Steve.  The guy says "I'm looking right at him, I'll send you right over."  I get voicemail.  Surprised yet?  I didn't think so.  I called back immediately and some other guy answers.  I say that I want to speak to Steve.  The guy says....are you ready for this....he's not here!!!  I say what do you mean he's not here.  I just talked with a representative that says he was looking right at him.  The guy hung up!!!!  I call back again and ask to speak to a manager, someone in charge.  I am now directed to Paul.  Paul assures me (as they all do) that he'll take care of this mess tomorrow.  I have his word that he'll stand over Steve (who is supposedly the owner by the way) and watch him credit my account the $290 and make sure this whole matter is closed.  Paul says to call at 11 AM and not hang up or take no for an answer until he gets on the phone and he will take care of all of this.  By the way....when I get home from work there is a letter in the mail...from Hearshe Kemp saying that I owe them $2970 by May 29 and the letter is dated June 12.  Tell me this isn't a scam!

On June 19 I call and ask to speak with Paul.  Steve isn't in yet...although he was coming in just to take care of my situation and one other persons situation.  Paul says if he doesn't call me back in 45 minutes, that I should call back after lunch.  Of course, no call from Paul so I call back after lunch.  Guess what....I keep getting a busy signal to both numbers I have.  Wow...I'm not surprised.  I remember this website which I stumbled on after being in the 5th or 6th day of this nightmare.  I pull one of the numbers that someone so kindly placed on here and guess what ladies and gentlemen?.....Paul answered.  Paul says that Steve isn't there yet.  He's supposed to be but it's Friday.

I have, in good faith, been trying to take care of every debt that I have...whether it was from my own doing or my ex's.  I feel taken advantage of and violated....all in trying to do the right thing.

One more thing.  A note to Gary...kiss off.  There are wonderful, hard working people who are trying to do the right thing by paying off their debt and then there are incredulous scam artists out there trying to take advantage of us.

Man, this company is too much. I have never received anything in writing about my so-called debt and asked them for a copy of the contract which I never received. On 6/18/09 a woman named Natalia Coleman(? - could not understand her)Said HK will file a case part (?) in my county - she didn't name the county I live in - as a part of a portfolio (again - ?) and said I was the named prospondent (?). She left a reference number and a number, 512-501-2240. I have checked with the Division of Finance and Corporate securities here in Oregon and they are not a registered business. Any comments on this judgment they are alluding to? Viktoryia, you seem to have some knowledge about them. Thanks everyone.

    Hey,

I spoke with a guy named Jason Burke at that same number in late March. I knew that I owed money, so I tried to do the right thing and pay them back.  We settled on two payments; one to be debited on 4/3 and the other on 5/3.  I preferred to send a money order because I told Mr. Burke that I frankly did not trust that my account wouldn't be abused. He says, "Oh , don't worry, it's safe and we wouldn't do something like that" or words to that effect.  I found out several weeks later that the [***] went in THREE MORE TIMES and took out more money!! It made my rent check bounce.

I call Burke back the first week of June.  He actually answered that phone number! He also actually remembered me and setting up payment arrangements. Then claims he doesn't know "what may have happened", and that he'll bring it to his supervisor's attention, call me back in a half-hour and refund my money within 48 hours.  That was June 9th and I'M STILL WAITING! Obviously, I've called him a few times since. No surprise he hasn't returned. Evil...

They'll be sorry they f'd me over. 1. Don't trust this company. 2. Don't talk to anyone. 3. Definitely don't give them account info. 4. If you must- send them a money order, CERTIFIED.

T - i dont know much about them because noone seems to have record of them, but i do know that they are not a real business and that it is only a few people who work together in SOMEONE'S HOME, who call people like you and me and call themselves different names. It is funny how we all call different numbers but they all go to one place, because half of the people that posted something here either spoke to a Paul, a Miranda, a Steve and a Miles but yet we are calling different area codes...Interesting HUH?

Tammy- my best suggestion to you is to keep calling them and threating them with FTC, BBB and the Attorney's generals office, tell them you are recording all of the calls and they will be forwarded to the agencies named above. This will definatelly get their attention - it worked for me, they stopped calling. LOL and tell them that you know they are full of you know what and that you have already filed a complaint with your attorney... As far as the transaction i would contact your bank and see if they will issue a credit due to the fact that it was a double transaction being that the second one you did not authorize...They will work with you..

Viktoriya - That seems to be the consensus. I had a non-profit lawyer look into them and they couldn't locate them either. I don't know if you saw this... http://www.oag.state.ny.us/media_center/2009/june/june23a_09.html
but this is the same type of heinous company and in BUFFALO of all places. Wouldn't be surprised if they were connected.

yes, I love how they all have the same last names too. Must be a family business? :) And the threatening legal call was from Texas?? Interesting but really irritating.

T- I havent seen that article but its too bad that they do not list the names of the companies that were shut down. Also let you in on a little secret, :) Hearshe and Kemp's corporate office is based in Buffalo, NY. How funny is that? I called the attorney generals office for that state and they would not let me know their physical address, (so i could send them an official cease and desist letter) and they said they would mail me a complaint form that i could file against that company. Which it has been 2 months now and i am yet to receive it. Isnt that interesting?
My advice is to file a complaint with the Federal Trade Commision, there were already 4 filed against this company but it references a PO Box in Buffalo, NY. Their MAIN fax number that they given me is a NY area code. Im not surprised but i understand the frustration, because i am a victim and it wasnt even my debt, it was my friends. Yet they called me like i was the debtor. try to reflect back on the conversations that you had with this company and see if you can remember if they read your miranda rights to you. "This is an attempt to collect a debt and any information obtained will be used for that purpose only." If they didnt - find an attorney that handles FDCPA violations, because that is a MAJOR one.

    Thanks

Viktoriya ~ That's weird that the AG office wouldn't give you the address. I would bug them via email and see if they have any results on the investigation.

I have filed several complaints with the FTC, BBB and AG offices in Ny and Oregon because they had very sketchy information about me and I wasn't sure what debt they were referring to. And especially after the last one where they DID NOT make the statement about collecting a debt. The woman just introduced herself and named the company, HK and went on to tell me they were filing the case on 6/22. I have not received anything in the mail before or after that message. There is an attorney I had mentioned and I think I'll email them again about the 'rights' statement.

They initially called my cell phone leaving messages "regarding case number blah blah blah" and never stated that it was about a debt like some of the other posts. Maybe they were actually following the rules and not disclosing information. Take care.
