    UuuuuuuH Alfalfa if the debt wasnt hers then why did she pay it in the first place. The rules state u must dispute the debt when it is brought to your attention within 30 days. If she made 6 paments on it then at what point did she come out of her coma and realized the debt was not hers. Tell ya happened. She read someones dumb advice and decided to be the scammer herself. got the debt listed as paid and then went back to try and further defraud whatever collection company she was dealing with and they caught her because they were smart enought to follow common practices of recording every telephone transaction. If that were not the case then why did her own bank shut down her account. Again Alf, yer not an attorney. Wonder what would do if someone owed you money and refused to pay you back. Oh yeah thats right ur a broke azz Debtor who is well informed on how to scam honest lenders. You never lend any one any money or anything else, you just do all the borrowing from any one that will give u a dime and then u complain when its time to anee up. Your the worst kind dude.

    This is amazing. I recieved a call from a Mr. Gaines back in Feb 0f 09 stating that he was a claims processor attempting to contact me in regards to an important legal matter. I disregarded the call for a while but the calls kept coming.I finally answered the call and Mr. Gaines told me he was in the process of filing legal papers for a payday loan which i never had. He asked me if I was aware of the debt I said no it must be fraud. He then asked me was i disputing the debt and i said absolutely he then informed me to send his office a letter by certified mail disputing the debt. He said he would put the account in dispute so they would not call me for thirty days after which His office should recieve a police report from me claimng I was a victim of Idenity fraud. So far so good no more phone calls but i did get calls from othe collection agencies inquireing about other debts I never created. I guess i take mr gaines advice as someone out there is definitely using my identity.

    I received a call from Hershey Kemp also calling for my sister.  The number they called me from is 512-501-2240.  I called back & spoke to a Maranda Lewis.  After she had left a very detailed message on my home answering machine, she refused to give me any info other than to tell my sister, or her attorney, to call her.  When I went to verify the company name from her, she hung up on me.  I called back & the man that answered the phone eventually varified the company name & told me they were civil court prosecutors.

    I don't know if this is going to helpanyone one out there, but you have to be careful what advice you take from people who post some of the advice on these sites. Reason is I took the advice of some guy name Calvin
    who posted info on another site. These people at Hearshey Kemp record all of their phone call. They use them as evidence in civil claims courts and you could end up paying them alot more in court costs if you loose. Then they place judments on your credit reportand if  ur lucky enough to be working in this econony they can possibly garnish ur wages. Just be careful.

    I was contacted by these people- they sent me something in writing because I requested it. The even emailed it to me---they quoted me a price of $95.00 which was the actually debt amount owed from a bill from back in 05 that was lost in the mail when I moved. The stated if it wasn't paid and was sent to an attorney the fees could increase which is true because of court fees..I didn't have a problem with him once I made them understand if you send me something in writing and give me a chance to verify--that I would pay whatever I needed to pay...he was ok--verified my email and sent me my request. So I am not sure why everyone else is having a bad time with them.

    file a complaint with the ftc the more people file will cause the gov. to take action and close them down. HEARSHE KEMP IS JUST DOING BUSSINESS AS. THEY ARE OWED BY ANOTHER COMPANY. STATE OF NEW YORK BBB HAS GIVEN THEM AN F RATING. THE NEW YORK ATTORNEY GENERAL KNOWS OF THIS COMPANY

    I had the same call, but it was from 1-877-787-4717 (Steve Grevace).  The message said it was"Urgent" and that I was being sued.  I called the number and got a recorded message.  Then I looked up the company and found all of this information.  I called the above number 1-888-217-2701 and was connected to Steve.  The first thing he did was ask me to verify my social security.  I told him that I would not verify any personal information over the phone and he hung up.  I called back on the 1-888-217-2701 and he stated that I should not call him on this number, but the number he left...-1877-787-4717.

    How can I find out what this is about?  If anyone has answers, please adivse.  i do not have any outstanind obligations.

    IF you receive a summons - YOU MUST SHOW UP!  otherwise they will win be default and that causes more problems,

    Keep track of all calls and if you can record them for proof in court of harrasment

    Many Collection Agencies will falsify court documents and hope you do not show up to dispute them.

    Sadly, I think Gary needs a hobby. Just because someone owes a bill does not make them a deadbeat. People fall on hard times all the time. There are right ways of collecting debt and wrong ways. It seems to me this company is an example of the wrong way.
    What does Gary solve my making snarky comments here anyway? You're making yourself look foolish. tsk tsk

    Alfalfa - very good information especially about the letter.  However, NEVER sign a debt validation letter as your signature can then be copied by unscrupulous collectors onto court documents and such.

    Hi there I would definitively suggest you to ask them to validate the debt, give em your mail adress and ask them to send a letter so that you can verify the debt, under NO CIRCUMSTANCES AGREE TO PAY AND DO NOT SAY YOU ARE RESPONSIBLE FOR THE DEBT, first you need to validate it, if you have the access please record the conversation. Once you receive the letter if you are the owner of the debt, negociate with them for a deal and remember to include in that negotiation for them to remove any records from your credit report.     My friend used me as a refence on one of the Payday loans she obtained. Miranda Lewis started calling me and looking for my friend. I advised MIRANDA numerous times that this is not her phone and that i will pass the messege to my friend and asked her to stop calling me.She would call me at 12, 3, 5 and one night she actually called me at 9:08pm, i know because i get off at 9pm,and have cell phone records that will show that!!!Thats a FDCPA violation as well - they cannot call before 8am and after 9pm. Any debt collection agency. She stopped for 2 weeks. I get another call, again from Miranda, this time she told me that my friend has gotten herself in quite a bit of trouble and that she needs to hear back from her IMMEDIATELY, i told Miranda that she was violating the FDCPA by disclosing personal information to someone who;s not the DEBTOR she's looking for. She then began to argue with me that they are not a collection agency, to which i replied that it did not matter if they are or not, YOU are still trying to collect on a debt so you still have to FOLLOW the FDCPA regulations. Again i advised her to not call me AGAIN. Three days later she called again, this time asking for my friend directly, as if it was HER cell phone that she was callling. I told her again that this is not her phone, she doesnt live with me and how many times do i have to tell them to not call me anymore? She then said that she spoke to her on MY phone on May 1, 2009. At that point i got pissed off b/c i havent seen my friend in 3 months and there was no way in hell that she was using MY phone to call these people, they have been harrasing ME!!!!
    So i hung up on this Miranda character and called the office back at 513-257-0181 and asked to speak to a supervisor because it was becoming outrageous. A man by the name of Steve got on the phone and was very rude telling me that they will no longer call me and that i need to tell my friend to contact them asap, as there are criminal charges pending against her for trying to DEFRAUD A FINANCIAL INSTITUTION. Again, i told Steve that it was NONE of his BUSINESS to disclose that PERSONAL information to me and i demanded their adress so i can send them a cease and desist letter! He declined and told me to grow up and hung up on me. I called back at least 5 times demanding for their adress and they kept hanging up on me.
    So i called BBB, FTC, Attorneys generals office to see if they have any record for this company so i can get their address and handle it the legal way, because i am a PARALEGAL, i know how things operate. Neither one of those agencies had ANY record AT ALL for this company!! That puts a question mark in my head, how can they collect on a debt and call and harass people and the higher agencies have no clue who they are.... I filled a complaint with the FTC, and i have spoken to my attorney about it and he advised me that i need to have my friend call them and get their physical address, as i was told by Hearshe and Kemp that since i am not a debtor they cant give me their address. So what do i do? How do i stop them from calling a innocent bystander. From the 3rd call that i received from them, i started recording all of the calls that i receive from them!!! My friend called them and asked them for their adress and they told her that she needs to pay the debt first - before they send her anything!!! What kind of [***] is that? A person owes the debt and is required to pay for something before she can figure out what it is originally for!!?? That is another violation of the FDCPA - they have to send you something in the mail and you have the right to dispute within 30 days. Well if she never received anything and they wont send anything to validate the debt, makes me assume that there is not DEBT and they are a scam, trying to rob people!!!
    SO one day, just for fun me and my friend decided to call them. Now get this - it was Mothers day, Sunday at 8pm. Hearshe and Kemp's voicemail states that they operate M-F from 8am to 5pm, and they are closed on saturday and sunday. Those exact words. So we call at 8pm on mothers day- and some man picks up the phone and says "HELLO". ?????????? Why are they answering the phone on a sunday? and saying Hello??? WTF?! So we called right back 10 minutes later and the same man answered the phone and said "Hearshe and Kemp, how may i help you>? Once again WTF, why are you answering the phone when your voicemail says you are closed!?!? So i say " Can i speak to Miranda, please" and the men replied" Oh, well the office is currently closed, we will be open tommorow at 8am." So i said " And you are answering the phone because.....?" This is the funny part- he said oh this is the Instant Service! in other words ANSWERING SERVICE. Why do they have answering service if they have VOICEMAIL???? So i told him that i would call back later and hung up. Then we decided to call back, and when i called back i said " Could you connect me to your voicemail please?" LOL this man said "Why dont you call back and i wont pick up, so you can get the VOICEMAIL." WTF WTF WTF!?!?! What kind of [***] company is this, i have to call back to leave a message.. Thats when i realized that this company is full of [***], they present themselves as officers, collectors, speacial claims agents and so on, but really they are NOTHING.... They work out of someone HOME, the number that we call is a HOME NUMBER - they are not a legit businesss.. SO BEWARE- these people call and phish for info so they have some grounds to collect on a debt that doesnt even exist...

    So my friend called my lawyer and he faxed something to their office and funny [***], 3 days later she gets something in the MAIL from this company describing the debt. So that should tell you something, they are scared shitless of attorneys because they are not legit, but DEBTORS who are not represented by an attorney get scared into paying a debt by telling people that there is legal action pending against them - when in real REALITY its not....

    There are some of you who critise the people who have been contacted by these people, but you have no right to, these people are not legit, they violate numerous FDCPA violations - and trust me i know because i used to be a COLLECTOR myself and i had to make sure i FOLLOWED these regulations. Miranda that has been harrasing me - never once told my friend that "This is an attempt to collect a debt and any information obrtained will be used for that purpose only!" Thats a MAJOR violation - if i was still a collector i would NOT only lose my job, but could be held responsible for that debt because i didnt read the debtor their rights.. Same as if you were getting arrested and the police officer did not read your rights to you - they cannot keep any charges on you because they never read your miranda rights!!!

    The only way to stop these scammers, is for everyone who is affected by this company to file a complaint with the FTC. If there is enough complaints against this company they will start a CLASS ACTION SUIT. Thats exactly what they need. This was not my debt but i was harrased as it was.....

    NOT FAIR!!!! Please file your complaints with FTC, for the sake of everyone's well being.
