    They keep calling me saying they are some law firm.  The woman is extremely rude. Threathened to garnish my wages take my car.She called me stupid. Had in correct information.  She is trying to,collect a debt from 2 years,ago. That is not on my credit report. Anyone know any more information?

    Debt wasn't in credit report (i owed money for lease termination years ago), but when i attempted to get an apt lease under my name, i was denied until i payed the amount owed to the old apt complex. Months later, i started getting calls from this #. For the most part, easy to deal with, though they can be a bit pretentious and often call a bit too much. Also, one of my friends with an old # i used to have got calls from them as well. Weird. Anyways, paid the debt and no more collection calls.

    These people are rude, They called about some apt. that my daughters signed a lease with and did not move in. The issue I have is that Latoya is rude and when I told her not to call my job, she continues to be rude and hang up. So I called back got some guy name Rob and he is just as rude. I was carefully explaining to him to not call my job and he hung up. Funny how it's okay to call my cell phone & work phone and I am suppose to listen to you but when I tell you not to call my work number you hang up. I am reporting them to the FTC. Also, I found where a law firm called Lemburg Law is helping people sue them for harassing phone calls.

    Going to an ambulance chaser that advertises on the internet like Lemberg Law is not necessary.  You can find a local lawyer to sue them just as well if not better.  They have already committed several FDCPA violations and both you and your daughter have cases.  So here is what you need to do.  First, send them a certified, return receipt cease and desist letter telling them to stop calling you.  You need to create  a paper trail as evidence for your case.  Also keep an accurate log of all calls (date, time, caller ID info, person you talked to etc.), photos of the caller ID would help.  Then have your daughter send them a certified, return receipt debt validation letter.  Everything else you need to know follows:

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    Just curious, exactly what happens if they don't give a written notice within 5 days of contact?  It's been a while now, but I can't find anything online about specific penalties or what happens if they don't.  Thanks

    Well everything is explained in the post and at the CFPB site.  The CFPB goes after repeat offenders and shuts them down.  There is no specific penalty for not sending the letter out.  It isn't like running a stop sign and getting caught.  Since the FDCPA gives you the right to private action against them though, by not sending that letter out it is one violation of the law that they have committed.  The letter must be postmarked within 5 days of first contact which is defined by either a voice mail message or an actual conversation.  The best way to punish them is for you to sue them.  If you have a decent lawyer is will be well worth your time.  Most lawyers will take this on a contingency basis so there is no money out of your pocket.  An hour with the lawyer, some phone conversations, and you are on your way.

    I received a call from them as well. What I've learned about my rights is that you can report them to the Attorney Generals office in the state that their main headquarters are in and your state, along with a complaint with the FTC. And if they are not a legitimate Attorneys office that's even worse for them. Also, check your state laws, because threatening to garnish your wages or take personal items from you is usually against the law and making such claims to do so is breaking those laws.

    Received a call from a female. She already had my name and social. She wanted me to confirm my address and date of birth. When I refused she said to look up the number and call back because she already had my info. And the call was in regards to "business." Sounds sketchy.

    Her business is "Monkey Business".   This sounds like an opening for phony debt collector who is hoping to trick you into paying a debt you do not owe.   Ignore and block.
        If you have a legit debt, a call is NOT legal notification.  Here is a link for you.  Do NOT call back or interact with these crooks.   They will just keep calling and making threats. Notice how they skate around the debt collector label by saying they are a notification service.  The language they use is pure bs, and is supposed to sound scary and legal.  There is no filing, no warrant for your arrest.  No one coming to you home of job with "papers".   Hang Tough.  Ignore and block the calls.

    You need to send them a certified, return receipt debt validation, cease and desist calling, or "not me" letter (think of it as the best $6.47 you ever invested).  Also send it first class mail in case no one will sign for it.  Make a notation of that fact at the bottom of the letter.  You also need to report them to the proper agencies to which I have provided links to.  Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment.  If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.  Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front):  http://www.consumeradvocates.org/

    I also got a call from this number asking me claiming to have a message for me asking me to verify my birthday and I told them that because I don't know them I'm not giving any personal information he then told me to look them up and hung up very abruptly with out telling me why he was calling

    It is illegal to "threaten" anyone, ESPECIALLY when it comes to garnishing of the wages. One can only tell you they are going to do it if in fact they ARE doing it. I would look in to that if I were you and use it to your advantage.
