- DebtGirlI wrote a response to "Glenn" that is currenlty on page 3 of this thread. I suggest you read it if you are pissed off at th people on here smashing on those who have had financial hardship and cannot afford to pay off their debts at the moment.
My fiance got a call from "Rob Davis" of USC the # they are using now is 877-913-2862. We will not be working with them, again the reason why is listed in my other post. I used to work for a debt settlement company (an ethical one, not a fly by night one). They are a collections agency who may or may not be working under the blanket of an attorney. Do not make any payments to them until you get documentation in wiritng of the debt, the amount owed, who it's owed to, and most importantly this company's info! If you read the other posts they are a very shady, rude and unprofessional company. They cannot scare us and we will happily wait for this "summons" in the mail.
Don't get me wrong we will pay the debt, but once it's sold to another company I am not paying any money to any company with this kind of reputation.- Caller: USC

What a joke! You would have received court papers from legit court & been served papers by a legit law enforcement agency. Courts notify people one way or another. These scam companies need to learn the system. They thrive on intimidation and fear but when questioned or referred to an attorney, they say they don't correspond with attorneys. Yeah right and that's legit? Ha ha! - Lee replies to sally jonesSeriously? You must be posing as a consumer because failure to pay a consumer loan, which is what a payday loan is, is a civil matter not a criminal one. Good grief. An on-line payday loan which is generally paid by automatic draft doesn't involve writing a worthless check. If you actually are a consumer and are just falling prey to illegal debt collection and scare tactics, simply call your county district attorney's office. They can ease your mind since the DA's office is the only agency to prosecute worthless checks, and they don't make phone calls, they send you certified letters. Bottom line this is an attempt to collect a debt. If you were actually sued, then a process server would provide you with a summons and the original petition (filed in small claims court). You have 20 days to file an answer. So there is no way in the world that you have a failure to appear and worthless check charge, much less doing jail time plus fines. There is nothing more bogus than that statement and is a perfect example of illegal debt collection practices. You may owe an oustanding debt related to an on-line payday loan, but you're not going to jail. Even if you were sued and didn't even bother to respond, the only thing that would happen is a default judgment would be issued, meaning you'd have a lien for the amount due which appears on your credit report.

But why are you assuming that everyone who is being conned by this company is guilty? I have NEVER taken out a pay day loan. I also only write check to legitimate companies that I am familiar with such as my mortgage company, utilities, car payment, etc until it was free to make all of these payments online through my own bank. Can you explain to me why I received this call? Why is it that when I stated that I thought it was fraudulent activity and I didn't want to pay it until after I filed a police report on what they claimed I owed the guy rushed off of the phone? Can you explain why he provided me with false past employment history and a false bank account number? And then I am told I will be served a summons an that a judgement will be placed on my credit yet this supposid company I owe hadn't already placed a collection on my credit? These things just don't add up. But you're on here yelling at everyone. Do you know what they say when people assume? If you truly do not have any other reason to be on here except to tell people what they already know...just go away
- kt| 1 replyI received the same call today. My husband and I are trying to purchase a new home so I panicked when they stated they were trying to locate me to serve me with a summons. I had never heard of the loan company they stated and I didn't recognize the bank account number they provided and to top it off they gave me some bogus names for my past employers. My husband said "just pay it and get it over with so it doesn't hit our credit" so I did. I was previously in 'in house' collector for a company so I am unfamiliar with thrid party collectors practices. I started trying to research the company to no avail. I called 'loan point usa' as well. I called my bank and informed them of the situation and it is now being investigated and I also filed a complaint with the general attorney. Don't get me wrong...if they show me that I truly did take out a payday loan sometime 4 years ago, of course I would happily pay the bill. I would never intentionally ditch out on a bill. But when you throw nothing but false info at me and tell me I have to pay even though it may be identity theft, there is something wrong. Don't let anyone take advantage people. Whether you paid them or not, you need to file a complain with the attorney general. I did mine online. I also contacted the FTC and tomorrow I will be filing a police report. the number they called from is 888-217-2930x342

- kt replies to ktUPDATE - Called Loanpoint this morning and inquired who their collector was. They state United Debt Holdings. They provided me with an account number and Phone number to contact them. I then called supposid "USC" back and told them I was filing the police report about the account opened without my knowledge and that it required the name and physical address of how it came to my attention. "Mark Andrews" gave me PO BOX 5757 Seattle Washington. I asked why the bank info says "USC CHANDLER AZ" and he said that it was their corporate office. I said I needed the corporate office physical address. He said he didn't know it off hand and put me on hold to figure it out. He instead transfered me to someone else. He sat in silence for 7 minutes since I stated I didn't want to be put on hold. He claimed to be looking for the corporate offices physical address. He started giving me a hard time about it and I said "I tried to fill this information out on my own but your company isn't searchable" he said to just type in USC. I said I tried that and it came up as the college only. He said "well what is it you're typing in, you need to type USC LITIGATION" so I did that while I was on the phone and told him I got the same response. he started to get upset and said "You must not be doing it right." I said "Just give me the complete web address" he said "just search USC" So at this point I lost my patience. I stated that I called Loan Point USA and they informed me that their collector was United Point Holdings. He argued that the information was a lie. I then said that I called United Debt Holdings and they confirmed it for me. He then started arguing that I must be a guilty person to have paid it. I stated that I would rather prevent something from hitting my credit and then use the law to track the person down. If it is Idenity theft, it doesn't stop things from going on my credit. He then said "well I think you're guilty" I told him It didn't matter what he thought because he was committing fraud. he then lost his temper and shouted "What do you want? You want a refund?!?!" I said, Yes, I want the transaction cancelled. I have already cancelled my card" and he hung up. I tried to call back and the message I get is that the extension is on the phone. Interestingly enough, I then started getting calls that hang up. I saved the message that their so called "court" official left. Anyone who gets a call from these people need to immediately request a Letter of Authorization. This letter states that they have an agreement with the original debtor to collect on your account. Without this, they legally cannot place any marks on your credit or demand money from you. Once you receive this letter VIA MAIL (not email) you then send a Letter of Validation which requires the collector to show proof of your debt. If they cannot provide you with proof of your debt IN WRITING VIA MAIL do not work with them. They are not legally able to collect money. If any of these false collectors contact you immediately file a complain with the Attorney General and the Federal Trade Commission. Contact the credit bureaus and put a fraud alert on your name and contact your bank to immediately put an alert on your account. PROTECT YOURSELF.

Ya real legit companies do that don't they? Message also gave a court case number. Really how can that be? The lady who talked so fast I could hardly understand here left 888-217-2930 with an ext number as call back number and ya it is USC. i dialed the number and got there answering machine. Oh and I have until 5pm tonight to contact the lady who left the message or I will be seved. She also stated that this was offical notification. Funny I thought by law you need to get something in writing, not e-mail or a phone message for crying out loud

- SamanthaTwo seperate "collectors" called me on the same day with different stories. The first lady was very nasty and demanding.. She claims at first it was FRAUD then she changed her story and said it was from a debt in a payday loan. She claimed I owed 1,000 + I said it was impossible I payed my loan off, she waited a minute then said I only owe them $250. I will be honest this has never happened to me so at first I was ready to give her my debit card info she brought up my home address, and even my mothers address. I told her she would have to call back in 2 hours while I was on lunch, she then spoke to her "supervisor" he granted me a 2 hour grace period. She mentioned how they tried to send me a letter but it was returned to sender, she also mentioned I was going to be "picked up at my job" . The second time I spoke to her I started asking more questions I asked for their fax number to show them proof of my payment history, and also asked her to fax me something about my debt, which she said she could not do and quickly changed the subject. Then asked me to put my H&R director on the phone( when she knew I had called her from my cell phone since I was at lunch) he was actually sitting right next to me coaching me as I had her on the phone. I gave her his extension and she proceeded to call him shortly after she hang up on me. She left him a vmail asking my work address, in the vmail she brings up my whole social number!! The second guy who called was clueless and just wanted me to call back to verify my address, never mentioned anything else!! Get name was Valerie Thompson and his was Calvin Murphy..

- MikeGot the same call as the other people here they called from 1-877-913-2562 which is a VOIP number. Idiots say that they will prosecute you for check fraud and theft. DON'T PAY THEM! Their collection practices are illegal. Something needs to be done to shut these people down.

The first person I spoke to was Kathrin Stevens, I asked to speak to her supervisor because the information she was giving me was incorrect and fraudulant.
She transfered me to a lady named Barbara, whom then transfered me to Jordan Simms.
Mr. Simms stated to me that they would serve him at work if we did not pay by a certain time today. They only accept valid credit debit or prepaid card.
Once, I stated to them that I am a legal aid, and what they are doing is not only a scam but against the law. I told them to serve my husband, I want to see the paper work- they hung up on me.- Caller: USC

- Aundrea| 1 replyI just recieved a call from an unknown number, they said that I had two counts of fraudulent checks, and the police was on their way to serve me with a court summons. They gave me a court case number, and the supposed law firm name of USC, and told me to call USC right away at a number of 1-888-224-8264, before the police got to my house to serve me. I called the number and it said it was USC, and if I didn't pay them with a credit card, that the police would arrest me for bad checks. I was stupid and gave them my debit card number, but when I called the county courts and found out that the court case number they gave me wasnt even legit, I cancelled my debit card. I have three kids and I am a single mom, this company had me scared and crying, thinking I was going to jail. It is a fraud and they just try to use scare tactics to rip you off, by the way, they would not give me an address or let me send them a payment in the mail, they had to have a debit card number, the supposed Attorney I spoke to was Mrs. Strong, Beth Strong, ( as she said to me). Please beware so they don't get to you. And as for "Glen", You have to be working for them to talk to people like that, I pay my debts, but everyone has hard times,and it does feel good to be out of debt, but it doesn't feel good to get scammed and ripped off, and pay out money that you don't owe. My kids need that $800 that I almost gave to this fraudulent company, just because I was scared of going to jail.

- MsTI have received multiple calls from a rob davis about a loan that i know i owe so i never thought of it as fraud.... I have been paying this so called debt collector like an [***] because i thought i was getting out of debt but instead it looks like im issuing out free cash....i am now contacting the tx attorney general after reading all the complaints not to mention the fact that ive recorded all my calls with him n saved all voicemails that threatened to send the cops to my job because of check fraud..... I have too many other problems to deal with besides this unprofessional so called company... If they r legitimate then i suggest they send my case to a better collection agency if they would like a payment....

- The Big HC| 1 replyI got a phone call on my cell from an unkown local number. I sent it to voicemail. They called back and I sent it to voicemail. This time they left a message - a Katy Anderson called stating a formal complaint had been filed against me for passing fraudulent checks. To complete service of process, she said she needed to verify my home address and place of employment. She said it was unfortunate that she missed me by phone, but that it was my legal right as the "defendant" to contact the "plaintiff" directly at 888-315-6585 and reference case number 1383081. As I hung up from the voicemail, she called back again! I asked her what company she works for, and she stated USC Mediation Law Firm. She also stated she was a process server in Texas and she had been contracted to "locate" me. Being a licensed process server in Texas, I asked her for Supreme Court issued Process Server ID number - she gave me 1383081, ironically, which is the same as my case number. I pointed out to her that she was certainly mistaken because process server ID's are much longer, as an example I gave her mine....awkward silence...so then I asked her to view the complaint and give me the docket number that the complaint was filed in...more awkward silence...I repeated my question and she stated she was transferring me to the legal department...in doing so she must have been flustered about my questions because she disconnected my call. Pity.
