    Tired of These People replies to Michelle
    Called regarding a debt that had already been paid.  But argued with me saying that even though I orginally owed $150, I now owe over $2500 due to interest.  The first phone call I got was in January of 2009 stating that I have 48 hours to pay what I owe or else they are taking me to court.  It is now October of 2011, and needless to say, my 48 hours were up a long time ago and they continue to call twice a day and leave the exact same robo-message stating that I have 48hrs to reply.  They obviously don't have any legal rights to do anything or else they would have by now.

    Send a signed and dated cease and desist letter by certified mail to them telling them why you dispute the debt, demanding that under section 805c of the Fair Debt Collections Practices Act, you are asserting your right to no longer be contacted by them by phone, email, at work, or through the illegal harassing act of contacting friends, relatives, and other unrelated parties which is punishable by law (tell them you have proof of this harassment and are informing the Better Business Bureau, Federal Trade Commission, State Attorney General, and other appropriate regulatory authorities).  If they have made threats over the phone, make clear what those were.  Also, make it clear you have consulted an attorney, and not only is it illegal for the company to harass you and contact others in relation to you, but individual collectors can be help personally liable according to the law.  If you know the name of who you spoke with or who sent you a letter, include this contact's name (although it may not be real).

    You may also request a copy of any claims they allegedly have be mailed to you and demand that any future communication be in writing.  Include no identifying data in this communication such as SSN, account numbers, etc., only details of the claim they allege and the address or phone they have been contacting you at.  

    Put cc's in bold at the bottom of the letter, and send a copy of your letter to the Better Business Bureau IN THEIR REGION (let agencies know they are masquerading as CDR as an added note on their letters, since a search for CDR on the BBB web site does not reveal them), to the State Attorney General (www.nydebthelp.com), and to the Federal Trade Commission.  

    CDR has provided fax numbers in the past of 716-833-4356 and 716-218-1501 that came up registered to a Boris Vidovic (related to a Vesna Vidovic) once listed at 82 Leonore Rd., Buffalo, NY 14226 (not sure if current address).  He is listed as living in both Buffalo and Amherst, NY, as well as Richmond, VA.

    As such, there is a good possibility he is also related to the following collection company, using both an Amherst address above and Buffalo address for similarly named collection companies:

    5500 Main St., #224
    Buffalo, NY  14221 (also uses same name, address, & zip but as Williamsville, NY)

    You may wish to send a copy of the letter to both locations and inform the authorities of this also.

    Even if you have a valid debt, make them provide proof, and they should NOT be excessively harassing -- it is especially illegal for them to contact relatives and friends in an attempt to threaten you, and there are multiple fines and possible legal punishment.

    Here we go again…another slimy, illegal bottom feeder operation has popped up in Buffalo, NY trying to collect on old, worthless, out of statute debts. Owner Jamie P. Belstadt, a retread of the collection business is trying to collect on debts that are 8+ years old. The documents we saw appear to have been produced by a second grader.

    John D. Yim, 36, of North Tonawanda, NY, Vice President of another junk debt buyer called CNE Associates; LLC is churning out the phony documents. Vision Credit Solutions, LLC and CNE Associates, LLC show NOT to have any debt collection license or Surety Bond in any state we checked.

    In his phony paperwork, collector Yim refers to the consumer as a ‘defendant’ which appears to violate federal law. His ridiculous form would be better suited as toilet paper than anything worthy of validity. It is pure garbage, nothing he states is true, he makes statements that false, misleading and appear to violate federal law, the Fair Debt Collection Practices Act.

    All of these bogus organizations are nothing more than smoke and mirrors to intimidate, harass, lie and mislead consumers into thinking they owe money on worthless accounts. This is typical ‘Buffalo Style’ debt collections that we’ve seen dozens of times.

    These organizations are operating illegally, the accounts have no validity, and the statements they make are false, misleading and ripe with lies. John D. Yim has no idea of what he is doing; Vision Credit (started April 2008) and owner Jamie P.     I also received multiple messages from CDR.  When I spoke with them, I was "uncooperative" because I would not pass along a message from them to my sister-in-law.  The man I spoke to was very rude; I called back to ask to have my phone number removed, but I still received a call the next day from a woman that I again told I would not take a message for someone that did not live in my home.  She told me I was "just wrong."  I called back and was finally passed on to a higher-up that gave me the address of where to mail a cease and desist letter:  CDR, PO Box 1275, Orchard Park, NY 14127.  Hopefully this helps someone else.

    I really don't understand why all the complaints from everyone??
    My experience was great with resolving my claim. I spoke to manager Peter Sumter and he wrapped my claim up with zero issues. I'm sorry I'm going to have to disagree. Thanks to CDR I'm on the right track to fixing my credit.

    These people are debt collectors for cash net USA. Peter Sumter will tell everyone he is a attorney, but he is NOT. He barely made it out of high school. If you don't repay a payday loan it is not criminal, it is civil. They prey upon peoples fears to collect debts,which is against the law. If they try to intimidate you please contact your attorney generals office in your state and file a complaint

    BBB has seen a major increase in collection agencies setting up businesses in the Upstate New York area over the past several years.  In an effort to keep consumers informed about which collection agencies are operating in accordance with Federal Law,  we are asking for specific information from all collection agencies operating in our service area.  The requests includes the following:
