- JMAgain, everyone please read my earlier posts. My ex used to work at financial (he was a cold hearted liar so he fit in well) so I am very aware of all the tricks these scammers pull. It seems like one of their collectors found this page and has posted a real judgement to convince you guys to pay. Listrn, Mac financial will sue, and I do know of them winning a judgment against debtors, but they will only attempt to sue in something like 1 of every 10,000 accounts. The debtor needs to own property, he can't have a lot of other outstanding debts, and the mac fin debt has to be well over $5000 for them to even consider suing you. Again the first thing you should do is check your credit bureau to see if debt is still on. Since they buy very old debt (very very cheap) 99 out of 100 times, the debt has already fallen off or will fall off within a year. If you make ANY type of payment, your debt is now a new debt and you just screwed yourself. Read earlier post about a cease and desist letter. Again, it has to be sent through registered mail.

Technically, the statute of limitations in Ontario for debt collection is two years (Update: The act provides that if the defaulted debt occurred before January 1, 2004, the creditor can collect on this debt for up to 6 years but effectively this period has now expired on most old debts).
Regardless of what the Limitations Act may say there are a few things you should know:
Debt collectors may still pursue you for the money. Any acknowledgement that the debt is yours or you owe the money or any payment on the principal or interest owed (even one penny) can reset the two-year limitation period.
Debts remain listed on your credit report for six years from the date of the last collection activity, so this debt will impact your ability to borrow in the future.
There are certain circumstances that can extent the limitation period of a debt (such as debts pursuant to the Family Law Act) as well as exceptions to the Limitations Act surrounding certain outstanding judgments, fines, taxes, student loans, environmental claims, and other specified debts set out in the Limitations Act. - Brenda replies to MONTREAL GUYLost my job because of a guy name Jim their saying I owe 1800 never bored that much ever want to sue them

- Donna B replies to JBThey can't put a debt on your credit report that you don't owe. If the debt has been removed from your credit report its because its pass the statute of limitations they can't take you to court or force you to pay a debt that is pass the statute of limitations. Tell them you don't owe it and send a letter to them through reg mail that saying you don't owe the debt and that you don't want them to contact you anymore and that if they continue they must take you to court, since they can't they won't. If they continue to contact you file a complaint with the Ministry of Consumer Services. Paying these people is not going to fix your credit the creditor sold the debt to these debt buyers for penny's on the dollar the creditor won't get the money the debt buyer Mac Financial will and make a pretty profit from harassing you. Tell them to hit the road. I am not suggesting that people don't pay their debts but Canadian Tire charges are predatory and so are Rogers for the most part and its hard for people not to get into trouble dealing with these Companies my father had issues with them, he was in Hospital dying and they still continued to call his cell phone that I had with me asking for the money when I told them my father was dying and we didn't know if he was make it they said, make sure you pay us after he dies before you pay anyone else. I won't write here what I said because he wasn't very nice and involved bad language. I father is fine and these people continue to try and get money and I have told them they will never get a penny from my father.
These debts are sold for penny's on the dollar, so the company like Canadian Tire writes it off a tax write off then they sell the debt to Scum Bags like Mac Financial who try to collect a larger amount when they might of paid $200 or less on a $4000 debt. They add interest claiming you agreed to it when you had no contract with them. When they had a enough they write it off and get the tax break also and the next company will try and collect. This needs to stop but our rules only protect the dishonest Scum Bags like Mac Financial.
When they do sell the debt they provide very little info to the company they sell the debt to so even if they could get you in court they wouldn't have any info to prove the debt. As long as you don't claim the debt and say you don't owe them they can't start the debt over. They also can't phone your house until they sent you a letter in writing first but most companies break the rules you can file a complaint with the Ministry if they don't do this also. Do internet searches and don't give out any info including where you bank, tell them that you will file a complaint if they continue to harass you. - Paul D replies to JBHahah this otther people are suffering?? Once they buy your debt, let's say Canadian Tire card, you owe nothing to the Canadian Tire! The crazy guy at Mac is out of line and extremely rude. Ignore them they have no legal ground to stand on, that's why the threats! Over 2 years, good to know!

- CGAgain DO NOT MAKE ANY PAYMENT. This is coming from a former employee. You will not get sued. All the legal threats are pure rubbish. Fake judgement letters were sometimes sent to people to convince them we might sue them so I am not surprised one of them is posting it on here.
