PS:a legitamite sexline or even pornsite askes for creditcard details to confirm age
I'm playing it out and they've pushed it amount up to R1500 now and a lady phone me on 0722023057 because I assume they can't get any details yelling at me and stuff If they continue phoning me within a month I will have to take legal actions of my own

There does not seem to be any regulations pertaining to the minimum requirements for age verification for these types of "services", for lack of a better term.
In order to answer you, I am going to have to lecture you on principles of contract and delict. Contract means, in this context, a service has been offered at a certain price by the chat line operator and your son accepted this offer. A contract exists, unless one of the requirements for a legal contract is absent. In this instance, it would be the capacity to contract, since minors (children under 18) are not allowed to enter into a contract without the assistance of their legal guardians. This has the effect that there no contract exists.
Delict deals in damage. In this instance, your son lied, running up damages of about R 2 500 for the chat line operator. He would be able to collect on a number of delictual and enrichments actions. No contract needs to be proved, only damage and a causal link between the damage and the actions of your child.
1. So, to answer your first question: No, the contract would not be legal, but the chat line operator may claim the R 2 500 on a number of other actions that has nothing to do with the contract.
2. I think that he will prejudice himself if he lay a charge of fraud, since uncomfortable questions might be asked of his business. Fraud is defined as unlawful and intentional making of a misrepresentation which causes actual prejudice or which is potentially prejudicial to another. If you applied what your son did to the definition, then, yes, fraud charges would be a possibility.

Are you people reporting these problems with this number all in South Africa?
That would make sense because Port Shepstone Court is in South Africa, and "R" (the currency symbol) would be used for South African Rands. Also, you talk about exchanging a SIM card, which is not often done in the United States.
If you are in South Africa, of course, none of the US-Specific information that people are giving you applies at all.

I actually took two chats :( I have ignored this now for more than a month, and even blocked their numbers. To my surprise a summons was delivered!!!! My cousin is still studying law, and he advised me to pay. You can argue this in court, but I did give up incorrect details!! Adding it all up in the end, it would have cost me tripple the amount to travel to Durban and legal costs. ( and on top of it the embarrassment of the recording). Think TWICE before you phone the chat lines!!

I will be paying also since i don't deny using their 'services'. Was told that if i had payed within 72hrs it would not have escalated to the R900. Hard not to blame the operator for not making clearer payment details...didn't even hear the ref. num or acc num at the begining of the call...if they even said it. They should realise we aren't thinking normally lol
Hope all our problems go away after this!and will know better for the next time haha
