If you are in the same situation as everyone above do the following.
*Be responsible for your actions if you have done the deed , then pay the price. Just to get your side clean.
*If you can rather prefer email communication. BECAUSE I can promise the guy that is sitting on the other side is recording you as you speak with him to maybe blackmail you again in the future.
1- If you did use the chat line , it would be a good option to pay them. BEFORE YOU PAY - Ask them to email you a statement that shows you how much you owe them. Then your side is clean.
2- Ask for as much details as possible , adresses , names , numbers , banking details etc.
3- After paying insist on a slip/ reciept / proof of payment.
4- You will then notice that there is no Vat reg. Number. If you ask them about this they will tell you they do not charge vat as they are only debt collectors. Note that this is a reciept from the debt collector that you will recieve.
5- so thank them for the reciept that you have recieved. Then tell them you would rather prefer the chat line to send you a reciept. You just want to make sure that the chat line recieved your money and that all balances are paid in full_ You are doing nothing wrong by asking all these questions, you are simply being a concerned consumer.
6- they will tell you that they are going to charge you for all the extra work you are making for them. Dont be affriad - you can ask as many questions as you like - You are just being a concerned consumer.
7- I got the guy (Robert) pretty worked up. So he phoned me , he sounded very intimidating and told me that he never wants to hear from me again. This was pretty funny though. So now these Debt collectors are telling me I am not allowed to know exactly what I paid for.
8- Also tell them you are concerned about your privacy. ( even though the chat line also didn't have the permission to record you ) Tell them you would like a legal letter , that either says that your recording has been deleted from their system.- Caller: social network investigations
- AnonymI know it is a scam ..... BUT hammer them for a proper reciept from the chat line I bet you the chat line and the debt collector is one company.
The debt collector may get away with not having to pay VAT. But I that doesn't mean the chat line doesn't have to pay vat. They are providing a service aren't they?
Ps. SARS does have a report line that you can phone anonymously if you suspect a company not paying their taxes.
Also if you can get the debt collector very mad and he intimidates you then you have a foot to stand on. My son has also been caught up in this scam. Please don't be intimidated by these fraudsters! I consulted my lawyer and he says to absolutely ignore everything they throw at you. I am also considering going to Wendy Knowler and getting this topic discussed on East Coast Radio. I am also considering going to the police and getting them to track these criminals down.
So rest easy, you have done nothing wrong. Every second person has phoned a sex chat line at least once in their lives. You're perfectly normal, young man. Just continue to ignore them. If you cannot avoid talking to them, say you want their physical address. If they refuse, then you can say that you are within your rights to refuse to pay. Let us know what physical address they give you. I called to ask, can arrangements be made, and they flat out refuse. In debt arrangments they need to at least provide 30-90 day arrangments. So they are not even fully legal from debt recovery point of view. I will keep checking in here guys to see if we can make some progress together. - unemployedI recieved the same call and sms from the same number threatening me about legal actions but refused to give me their details. on BEELD newspaper they wrote a story about some in westen cape who is affiliated to ANC that he made a 9 minutes sex call that cost R900. how could sex be so expensive especially over the phone. and at the same time they don't tell you that wen u call.

I was contacted a few times by the company Social Network for money I owed to a sex chat line account and decided not to answer there calls and ignore them.
About a month ago I received a summons to be in court in Durban I live in Middelburg. This was a shock so I did what any other person does I ignored it and thought this will go away. Well the day I got summonsed at work I knew something was up so I went to see my Lawyer.
The company that summonsed me was called by my lawyer and this is the whole story.
I was making use of the services of a adult sex chat line, I made a stupid mistake know I am being summons to be in court for what I did. Well I denied it to my wife and said it was a scam I would never do this, so my wife I believed me. Was I wrong. On the day we went to court the recordings off these sex chats was played in court and my heart exploded off pain.. I tried to make her believe that these people were trying to scam me out of money and the truth came out.
I am so upset with myself I do not know if we have a marriage left I do not know how to feel. We managed to settle the matter out of court and I will have to pay these people this money.
I will never make this kind of mistake again it costed me my marriage I should have just paid the dam money and no one would have know.
This is just a friendly warning to my fellow brothers out there do not get caught with your pants down, rather pay the dam money. I should have listened to my friend but I decided to ignore this thinking they were bluffing and it came back and hit me like a brick.
Damage has been done know I just need to fix it.

There does not seem to be any regulations pertaining to the minimum requirements for age verification for these types of "services", for lack of a better term.
In order to answer you, I am going to have to lecture you on principles of contract and delict. Contract means, in this context, a service has been offered at a certain price by the chat line operator and your son accepted this offer. A contract exists, unless one of the requirements for a legal contract is absent. In this instance, it would be the capacity to contract, since minors (children under 18) are not allowed to enter into a contract without the assistance of their legal guardians. This has the effect that there no contract exists.
Delict deals in damage. In this instance, your son lied, running up damages of about R 2 500 for the chat line operator. He would be able to collect on a number of delictual and enrichment actions. No contract needs to be proved, only damage and a causal link between the damage and the actions of your child.
1. So, to answer your first question: No, the contract would not be legal, but the chat line operator may claim the R 2 500 on a number of other actions that has nothing to do with the contract.
2. I think that he will prejudice himself if he lay a charge of fraud, since uncomfortable questions might be asked of his business. Fraud is defined as unlawful and intentional making of a misrepresentation which causes actual prejudice or which is potentially prejudicial to another. If you applied what your son did to the definition, then, yes, fraud charges would be a possibility.
3. You are not liable for this money. Your son is. The chat line operator would not be able to collect from you, but he would be able to collect from your son through civil action as explained above.
