Portfolio is a bottom feeder debit colelction firm that try to collect on "TIME BARRED DEBTS" never talk to them, or accept responsibility for the debt.  They will try to convience you to make a partial payment or payment arrangements which they know will cancle the TIME BARRED status of the debit making it collectable once again and restarting the 7 year clock!

From the time the debt is defualted the creditor has 1 year to sue and can place it on your credit file for upto 7 years.  After the 7 year mark the debit is considered tibe a "TIME BARRED DEBT" and though you still owe the money it is not colelctable nor enforceable

They have many complaint filed against then nation wide.  If you tell them not to call you again by law they can not and once they do you have a chance to sue them under the FDCP Act.  They can not make threats including to sue you or attach/garnish your wages or assets.  To do so is also a violation of the FDCPA.  If you demand they proviede you proff of the validity fo the debit many times they will not.

Any time they conatct you after you have told them not to call again besure to record the date and time of the call and speak with an attorney specializing in debt collections also get registered on the Federal Do Not Call list and report them there everytime they call.  DoNotCall.gov The registry is not really set up for debt collectors but telemarketers; but, reporting them everytime to the FCC through the registry provides you with a compled list or dates and times for use in court when you decide to sue them.

I am working with an attorney here in Detroit MI to file a class action suite against them in Federal Court for violating Civil Rights and the FDCPA if you want more information please send a message yout your contact details to mediadetroit@gmail.com and I will forward it to the law firm handing the case,

These people do call from different numbers. They never leave a message. They have also called from area code (864) as well. One time this guy did leave a message and he tried to scare me, he made a comment stating that this is case number 5415 and went so forth trying to sound professional. I have kept it on my voicemail because what they are doing is trying to scare you and that's against the law. I actually looked up the case number online under my county records and nothing showed up. Don't answer their phone call, these are the same people that will do or say anything to get you to pay. They have even tried calling on christmas eve.

Thank You, They just tried to call me...
Portfolio is the worst bunch of bottom feeders out there. Absolutely correct, they try to renew ancient long ago exempt debts as new and even reports them to the credit agencys as such the minute they trick you into responding to their calls using this as evidence you have acknowledged the debt as such.
They even tried a year ago to take me into my local courts however I still had the original 9 YEAR OLD paperwork from the actual credit card company (Providian of course) so they never even appeared however I have to say the court sure gave them the benefit unjustly before finally dismissing the case and letting me leave. The Judge actually sent court personnel out into the building to find the representative attorney for these scumbags upon a no response from them when calling the case to the bench surly violating some rule or law. I waited 2 hours in that damn court before final dismissal!
    Don't Answer!!!!!!!!!!!!!!!

They are calling me on a 7 year old debt they must have bought...on something I never owed and had removed from my credit through 2 bureaus last time this came up.  jerks.

for the rest of you with problems with them calling your cell phone do this:
sign up for youmail.com  this is a call forwarding service, you can register your number and it sets up a new box, then when these jerks call from different numbers you set the call to ditch which means they can't leave a message...and better yet you can set the message they hear to "i'm sorry this number has been disconnected"

If you ever speak directly with a debit recovery firm use an air horn for every other work.  This will stop their calls and leave hearing damage to the person on the other end of the phone.  Oh, use ear plugs for yourself as the noise is very loud.

Telemarketers or Collectors have restrictions for when they can call. In most states they cannot call you before 8:30am or after 9pm.  I would check your states law on this matter.  If they are calling outside of those times get a copy of your phone records and take them to court.  You can collect up to $2000.00 plus they can be fined.

Unfortunately these bottom feeders out of the blue started calling me too. At first I didn't know the I refused to pick up. My theory is you don't leave a message then it can not be all that important.

Eventually I picked up and went through the whole thing who's calling blah blah. I finally said yes this is so and so and they proceeded to tell me about a debt (using an address I was at 12 years ago) for Capital One. I said nope do not owe blah blah.. I hung up and contacted Cap1 immediated to verify. I explained the situation and the person told me that she was going to let everyone know because this has happened before.

Long story short. Here is how you get rid of them. Get the account number they have. Research for your state the statute of limitations on debt collections. Then write a letter to cease and desists and referencing the account number. You can Google "cease and desists" letter examples. They will in fact have to stop. They do by law have one more opportunity to attempt to collect the debt. IF they proceed with a legal action do not worry, your defense will be you do not owe because statute of limitations has passed.
As stated above "DO NOT PAY ANYTHING!!!!  If you do it renews the debt collections. I hope everybody who wrote here comes back and see this AND anybody who comes afterwards will read this. It's time to get this scavenger debt collectors out of business.

Also retain any records of their calls. They do have to follow certain legal limitations for the time they call, how often they call, etc. If they continue you also can put in a complaint against them with the Federal Trade Commission. I know I did. If everybody does it then hopefully the FTC will collect enough evidence to investigate and shut them down.
Have a good evening and stay debt free :)!
