    I was notified that I had criminal charges that were being filed against me (class E felony for defrauding a credit card compeny) and that I was being sued in civil court.  When I notified them that the credit card company in question was discharged 2 years ago in a chapter 7 case they then told me that I would still be summoned & would have to appear in court.  SHADEY!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!  I told them that this account was included in the bankruptcy & they said that the client did know, and then the 2nd person that I spoke to there said that the client had not accepted the chp. 13 bank.  WELL THEY DID NOT FILE A MOTION IN MY BANKRUPTCY HEARING!!!!!  They didn't do it during the chapter 13 nor when it was converted to a chapter 7.  This is VERY fishy that I had to fight a collection agency with Providian once before this (Unifund) about not owing as well.  MAKE SURE THAT YOU CONTACT YOUR BANKRUPTCY LAWYER IF YOU HEAR FROM THESE OBVIOUSLY CLUELESS "INVESTIGATORS".  They said that they had tried to call me multiple times & had left a voicemail - guess what I DO NOT HAVE AN ANSWERING MACHINE!!!!  SO am NOT sure who they called!!!!

      Nothing else can be done if you filed a Bankruptcy. Its close. That's it. A company dosen't necessarly have to "not accept" the case or the banmkruptcy, it just is. I wouldnt worry

    Nicole Morgan said that there was a civil complaint against ____ (my son's name). A class three felony.  She said that it was an action in _____ (the city where he lived.)  She gave a case number and said that Robert Goldstein was the lawyer handling the case.  I said that I thought she had the wrong person. I wanted more information.  She said she would give it to me but I had to give the last four digits of his SS# before she would.  I gave her four random digits.  She said that it wasn't him and would not call again.  

    About eight years ago, he had a dispute with his telephone company that showed up on his credit report.   I assume that they got his name connected to that.  

    When I called my son, he quickly found this site.

    Dont be fazed by these calls from 216-393-0455, or any other number. Check to see what your state time limit is on unsecured lines of credit. For me all my bad debt is past the statute of limitations so I choose to ignore any calls or letters. I should also note that I made one attempt many years ago to settle with a collection agency. The agreement was they would take partial payment then remove the item from my credit report. That never happened and they still tried to collect the additional money. If you're to the point where collection agencies are calling and it's below the "SOL" I would either do credit counseling, file bankruptcy, or wait it out against the statute of limitations. What I would never do is deal with a collection agency, or even call them back.

    Here are the questions I had about these guys and have since answered

    1) Are they really suing me? A: I'd say no. They've been calling me for over a year. So have others on old debt that cant be collected.

    2) What if they did sue?         A: If the statute of limitations has run out then you would appear in court with proof of the orginal date on deliquency
                                A: If they wasted valuable time and money in court and somehow got a verdict entered against you. You'd file to have the verdict dismissed based on the same thing.
                                A: If they garnished you wages. That is done through law enforcement channels. You will get plenty of notice and be able to have the verdict dismissed before they take out one penny.

    3) What if they report me to the credit agency?  
                               
                                A: If the original debt is delinquent less than 7 years then it will stay on until 7 years is reached
                                A: If it's over 7 years you send a dispute letter to the credit agency. Include proof of the original debt, letters connecting the collection agency to the original creditor, and send it certified mail. My experience is once you send a couple of these the credit agency gets to know you and takes them off fairly easy.

    All in all you would spend some time getting these things done if they really did sue, but they wont.

    If your debt is under the "SOL" for your state I would see how judgement proof you are. In my state they can only garnish you wages up to 25% off you take home pay. That's total between all your creditors and after they take into account your living expenses.

    I think the best thing to do is be responsible with your moeny and learn from your mistakes. That's what I did and now my credit is "Prime" status. Took 10 years but it's a nice place to be.

    Just someone's mom... and angry!
    "Investigator Hillary Bower" was how she introduced herself to my voicemail.  She was really very rude.  I can't wait to get ahold of her ear on the phone!   In her message, she was talking about affidavits, criminal charges, etc.  The last words of her message were "Good Luck", in a very smart-ass tone of voice.  She threatened.   She went on and on about me getting picked up on warrant(s).

    These calls are from a criminal operation by the name of CMC Recovery that's based in Georgia. They also masquerade as working for the a law firm called "Robert Goldstein & Associates" and probably other aliases. As consumer law expert Bud Hibbs notes, there is no such attorney Robert Goldstein & Associates. These people are not only breaking federal debt collection laws, they're also committing numerous other felonies (impersonating law enforcement officials, fraud, impersonating an attorney, extortion, etc.) They are criminals and you should NEVER give them any information about yourself.     Remember, the only difference between these CMC/Goldstein callers and thugs on the street is that they mug people over the phone.

    I suggest you and everyone else who's received these calls contact your local police, your local FBI office, and that you file a complaint online with the Federal Communications Commission at http://www.fcc.gov/cgb/complaints.html (The FCC enforces the federal Telephone Consumer Protection Act.) Also, since this batch of calls originate in Ohio, so you should file a complaint with the Ohio Attorney General by calling 877-244-6446 or going online to http://www.ag.state.oh.us/citizen/consumer/complaints.asp
