A cease & desist letter doe NOT stop the legal proceedings! It only stops phone calls. But we can still enter judgement and still proceed with garnishments. - Annie| 1 replywell, I don't recall them calling me. Maybe they did at some point but i just don't recall. Today I had a mediation appt at the courthouse because they sued me. Well, supposedly on behalf of Capital One. I only owed 600 dollars and now with fees and interest they are trying to get me for 1600.00. I'm wondering, although I signed those papers and made some sort of payment arrangements, do I still have time to turn the judgement around? I don't think Capital one has anything to do with this since I called and they don't see anything on me in their system. It was charged off. I asked the attorney if he had my original contract and he said yes, that it was stapled along with the other papers. I didn't know what else to do at that moment. Now that I think about it, I feel that I should've been more persistent and not let them get away with it. Can someone help? I need some advise on what can I do now. I think they were trying to collect a debt illegally. Help??
- J replies to BethSending a cease and decist notice after you have been summoned to appear in court will not do you any good. At this time it is too late. You have been ordered to appear in court, this is however a civil matter. There is no debtors prison. But if you don't appear you will get a default jugment. In the state of Florida a jugment is good for 20 years and it gives the party who is suing you the right to collect the debt for that amount of time. In addition, a cease and decist will not stop a lawsuit. It only restricts the law firm (any law firm) from calling you or writting you, IT WILL NOT STOP A LAW SUIT. The best thing is to contact whoever has your delinquent debt and make payment arrangments on a voluntary basis. Often times you can get them to reduce your interest and pay a lesser amount. After all, all they want to do is collect the debt. It is much easier for you to pay them on your terms than to have your bank account garnish, or your pay check garnish.
If you never want to have any of these types of problems you need to adhere to the old saying, "if you aint got it, don't buy it". - Someone in South Florida replies to Annielol, David Borack lives out in Davie, Florida, I was contacted by them, but they had a cell phone number I had just gotten, so they were calling the old owner of it, I gotta say though, when I explained everything, the man on the phone could not have been any nicer to me.
- Deb replies to aha!!| 8 repliesYes, I'm currenty going to small claims court for a credit card scam I got caught up in and David E. Borack, of North Star Corp., is suing for the unpaid balance. I have another friend who, once he collected his Soc.Sec.Disability retroactive money, and had it directly deposited in his account, lost $5,000 (5K) to this idiot Borack who had his account frozen and withdrew the $5K from it! This guy has connections with a lot of banks and credit card scams. Once the credit card limit is raised to it's hightest limit (mine was $600.00) they told me I went over my monthly limit by $30.00 (I was pumping gas, they did not deny me the opportunity to pump gas as they had in the past if my limit was reached). I had gone over my monthly allowable credit limit every month for 8 months and each month they said, "Congratulations! Your credit limit has been RAISED! You now have 'such and such' an amount to spend each month." But, on my 9th bill/statement, they said, 'because I went over my allowable credit limit, my card was PERMANENTLY REVOKED, and the ENTIRE BALANCE WAS DUE IMMEDIATELY." Of course, I couldn't pay the entire amount, being on Soc. Sec. Disability, as they knew, and now, they continue to add exhorbitant interest amounts to the balance. I paid on time, mostly early, each and every time, and I always paid the minimum due, or, if I had gone over the amount I was credited, I paid that entire amount. David E. Borack said he took over my debt "for non-payment issues." Yes, but there was more to it than that, as you can deduce from my above statement. My belief is that he is in cahoots with the credit card company from the "get go". He seems to prey on people on Disability. Anybody else have this same thing happen to them? Hope this helps someone. By the way, it was a Mastercard, it said Imagine Gold at the top, and I didn't have to pay anything up-front and no annual fee. I was delighted to get it because I have NO SAVINGS ACCOUNT, NO CHECKING ACCOUNT, AND NO INCOME OTHER THAN MY SOC. SEC. DISABILITY. IF IT'S TOO GOOD TO BE TRUE, IT IS TOO GOOD TO BE TRUE. DON'T FALL FOR IT LIKE I DID!

But sometimes when you push a person too far, it is like pushing buttons at the nuclear plant without actually knowing what the do. And messing with peoples money is not something I would feel comfortable with.

I haven't included the women here because, they don't stoop this low, and certainly don't badger debtors, seems to always be a male with no morals. And I guess I could count out it being the first three, as they are too busy living it up on the money you are collecting for them, caller #12. So caller #12 it is, because even if you did enter a name, it would only be a fake one, like the ones you use on the phone. A request of validation of debt and dispute of the debt letter can be sent (via certified mail) and they must, according to the Fair Collection Practices Act, stop all collection action during this validation period. If you are lucky they can not validate it if you are not lucky you better go to the hearing and try to settle or go to trail. Otherwise you are giving them a "Default Judgment". they are happy and will not thank you.They will do all they can to provoque a default judgment.

I called them just hours prior to being served and worked out a payment plan with them... The guy I talked to is Marcus... So YES they can sue you and garnish your wages ot freeze your accounts...

- just another replies to Anonymous collector(1) Collectors need the judgment(that is why they try to serve the wrong person and get default judgment when the person does not appear in court). I went to trail hearing with these guys and the person from the company was very happy and marking the numbers for each no-shown that he got that day, he knew he commission was big that day. Collectors will also make difficult for you not to settle so they can get judgment and avoid the hazard of having to get the payments little by little.
(2)Collectors need court order to garnish wages(they can just scan your social security like a jacker can do it). If a collector get a court order which chances are very hight after the judgment is given to them.
Federal Law does not allow wage garnishment if your disposable income per week is less than $175.50. If your disposable income is above $175.50 but less than $234 a week, then the creditor can garnish either the entire amount over $175.50 you earn or can garnish 10% of your gross income. If this disposable income is greater than $234 per week, the creditor can garnish the lesser of the two – either 10% of gross income or 25% of disposable income. Disposable income is the income after deductions of federal taxes and social security benefits, whereas the gross income is the total income before the deductions.
If yo don't have a job they can not take it from any other source of income such as un-employment,or so.
If yo are a Head of Household they can not garnish your salary but you need to file a Claim Head of Household Exemption hearing.

You really don't have a clue do you...first of all we have NEVER referred to ourselves as caller # such and such, second of all I am a woman, and no one is "stooping" to any level. I am giving facts. Why would I give my real name on a blog site? You sure didn't! Give me your name and I will give you mine, after I locate you through Accurint. You are probably one of the unfortunate souls who got canned because you CAN'T collect!! I have been here for over 2 years and LOVE my job, the people I work with, and my profession. Then again when you are a "job hopper", you have no inkling of what satisfaction from a job really is. So, in closing, good luck hating on those who are good at what they do, and congrats to David for canning your sorry behind for not making any money for him!!
- Angry321-282-4111 Is the number for David E.Borack.He is one of the dirtiest and deceiving debt collection lawer out here in Florida.I had a debt with a credit card that some how David Borack took over. With out even a call I had someone come to my door (not with law enforcement) and hand me a paper telling me I had to be in court less then 48 hours from receiving it.I called there office and worked out an agreeement to pay it off monthly @ 11% interst.During that time they would never send me anything to let me know what my balance was after every payment.After 17 months of paying them I talked to there accounting dept.and ask what was my balance since my records showed I was close to paying them off. The lady in the account dept.told me the balance which was $100 more then what the starting balance was.I was outrage.The lady said they were charging me 29.83% intrest not the 11% which we agreed to and that I signed an agreement.They got me to sign it first and then they never signed there part.So they only take the parts of the agreement that beifits them such as taking a payment out of your bankaccount every month .This is why they never let you know what the balances. They don't want you to pay them off all they really care about is monthly payments.I am filing a law suit aganst him.If there is anyone out there that has been treated this way I would like to here from you cause I would Like to get others involved with this law suit.Every one who has not been treated fairly by David Borack should file a complant with the Florida Bar.

- JamieI actually called their office to ask some questions about a summons that was delivered to my parents house and was super annoyed from a prior phone call and had an attitude when I called in, a word of advice to anyone being sued by this office if you want them to help you be NICE! I spoke with a gentleman named Marcus who at first was willing to help me, but since I was rude to him, I am now unable to set up payments I must pay the balance in full. We did get ourselves into this debt on our own so there is no reason to call this office and get mad at a perfect stranger on the other line who in all reality we need to help us get ourselves out of the debt we caused on our own. Sorry if your out there Marcus.
