    Ok, first of all, i want to start by saying that not everyone that falls behind or has debts are bad people.  Just people going through some hard times and with the economy, health problems leading to medical bills, or lost of employment it is really off the line to pass judgement on people like us.  We did not ask to be in this situation and we did not ask to get laid off!  Secondly, some of us are struggling families and find it even difficult to have food on the table at times. If collectors keep adding double the debt we owe, how are we suppose to pay back our debts. With all due respect, please have more of a professional staff training.  Last time i spoke with someone from your firm the woman on the other end told me to go back to my country. To which i responded was uncalled for. I took this as an offensive comment that had nothing to do with business and further more, she has no idea who i am to be making such stereotype comments.  I'm am a born and raised american, and the men in my family have serve the military to help protect this country. So please learn to speak with the public, reason for this is you are representing a business (Collection and Commercial Litigation Law Firm at that).  Also, I find it strange that all that speak up for Borack & Associates obviously you work there, so why do you not just show yourselves with a proper name and stop hiding under anonymous or Anonymous Collector.

    Yessie, I totally agree with what you said in response to someone telling you to go back to your country. That is very unprofessional no matter what the circumstance may be.

    I will say in a collectors defense, that we ARE NOT in customer service. I do believe there is a certain way to conduct yourself professionally without having to "bend" to the debtors every need. But just as you said that just because someone owes a debt they are not bad people, same goes for us. Just because you speak to one bad collector (who may just be having an off day), does not mean we are all rude or unprofessional. But sometimes we get on the phone with all intents and purposes to help someone out, and we get cursed out for something that is NOT our fault.

    In collections there is plenty of blame to go around. I am a firm believer that if you don't have the cash then it just doesn't get bought. I have never in my life had a credit card and I never will for this purpose. I would never want to be in the position to owe someone else. If I want to purchase something and I don't have the cash for it then I just don't get to buy it.

    Got a summons went to court, showed papers to attorney and judge proving  debt had been paid, both were happy and the attorney said "I'll get back to you.   He didn't. They still call.
    I tried to be nice to the people on the phone for they have a horrible job pretending to be mean, illegally taping phone calls in consent only states and the like.  They are not attorneys but have attorneys on retainer.
    Beware of anyone who calls asking questions but does not identify themselves or leaves only a first name and not the name of the organization.  Even municipal police identify themselves.  Real attorneys like the Ziff Law Firm here in NY always ID themselves up front.

    Garnishment laws vary from state to state.  In a few states you can't be garnished at all.  To determine the law is your state of residence look below.

    actually I am constantly getting calls from a slightly different number, 321-304-4870, which also claims to be Borack and Assoc.  I never get a message.  i never have anyone on the line.  I googled them and got their corporate website and a lot of sites like this that talk about them being rip off artists (which I believe)  I called them and they claim they don't even know why they are calling my number.  They say I need a file number to get more info.  So, not only are they likely rip off artists, but they are not even very good at that

    But who say's that even if you owe a debt or owed a debt.. you need to be treated like you are a piece of garbage? I have the bad credit report to show for my divorce many years ago. I now have Borak and Associates calling me telling me they have a judgement against me and wanting to know why I'm not paying on my judgement. I don't know of any judgement, the credit card was a charge off many years ago. Now, just as I'm starting to get my life back togeather, still paying 18% interest on a car loan, unable to buy a house, paying a higher rate for car insurance (yes, I'm a safe driver even... that doesn't matter)but getting it back together, I have some lady chastizing me over the phone. There was no attempt to be nice to me or anything. I understand debt collectors have a job to do. When does it end however? You get into a trap and then can't get out.. and then to be treated like garbage on top of it all? Explain to me where this beneits anyone? Of course no one likes these people... they are pit bulls and (at least from my experience) you are the pile of steaming *rap left behind. But it's not ok to be just as rude to them as they are to you??

    I got more calls from their office today actually, looking for another person besides me, I have never heard of the person, and the gentleman apolagized for calling and said that I might get a call or 2 in the future, but he would try his hardest to make sure that he didn't call me again.  It is funny to read all these stories of the people that had bad experiences with the people from this office, the guy couldn't have been nicer to me.  I have a friend that does this kind of work, and he is told me be pleasant when he calls in order to try to get partial payment that day, and to set up a plan to pay.  I think the people that are getting bad experiences from Borack's office are just doing it to themselves.

    People with outstanding debt don't owe the money to the collection agency!.....  You buy the debt for pennies on the dollar and go on a witch hunt for a payment that NEVER even gets to the original creditor!.....  NOT one person you target has any LEGAL binding agreement with the collection agency!  Who are the real thieves here?........  your post is as rude as your phone calls!......  that's why they invented caller ID....  Just don't answer the phone, collectors can't argue with air!..........

    The company is goin under! They just fired almost all their staff and it will be just a matter of time till he has to shut down. They can say all they want they will garnish you but unless they know where you work or your bank info they CANT! It cost them more money to goto court and file a judgement and since DAVID cant pay his own bills there and does not follow the FDCPA LAWS its just a matter of time till this "law firm" is closed down.

    Glad to hear that. I just checked my local counties website and found that they had filed a lawsuit or issued a summons, but nothing else, no cover, no complaint etc which is usually filed with the summons. I already have one Debt collector sueing me(no court date yet and yes I did file an answer). I would really like to see these people collect from as I have no job and the only income is my wifes which is exempt from garnishment and so is our account. Of coue=rse I'm sure if Borack goes under the account will go to another collector.

    I had an Amex, I got behind with payments, Amex wouldn't work with me. So it was sold to a collector, then sold to Borack.  They worked out a deal with me, so I was paying on the deal.  They stopped taking the payments from me, I was served about 2 months later.  I hired an attorney, I have filed an answer.  David is just the face/name of the firm, the firm uses associate firms around the state that they have deals with to sue people.  Robert Rivera of the Maitland office has admitted to my lawyer, who was on speakerphone, that they have lost my paperwork, had no idea how much I owed, nothing.  So Robert has asked me to send the paperwork that I have.  They tried to send me a new stipulation letter, didn't credit me with anything, so I obviously did not sign in.  He admitted that it is their mistake and he is talking to their accounting department to get the balance of my debt canceled.  I have file an injunction with my court in Broward court to prohibit them from taking anymore money from me.  We will most likely be taking this to court for unfair debt collection practices and counter suing, if Robert is not able to clear this up.  We are going to look into the other people during our discovery to see if we are able to start a class action lawsuit against Borack for this.  I will update you all about this matter.  I am sure that "anonymous collector" will state that I am full of crap, but if it gets to that stage, I will happily post my name, so that she can look into it for herself.  Be careful with these guys.

    Amex is the only creditor that does not sell their debt. They hire a collection agency (NCI) which in turn retains attorneys in the State the debtor lives. If the debtor lives in county that is far from the attorney's office(s), the attorney may request a telephonic hearing or they may pay a local attorney to attend on their behalf. Why would a company stop taking payments from you? It does not make sense... The only time when they do that is due to non-sufficient funds in the bank acct they are debiting or if the debtor decides to close the account without warning the attorney/collection agency...

    They have been harrassing and sending letters in reference to a debt my son had a long time ago.. It was about $800.00 Now they are threatening my son with a $4800.00 judgment. Also coming after me for a debt of about $200.00, also old, saying they will put a 1500.00 judgment.

    We have fallen into hard times but we would make payment arragements for the original debt. However, the judgments are high and will continue to accrue interest daily, how will we pay for this?

    If you decide to bring a court action suit againt Borack & Associates-count me in. They have been harrassing my son and I. From two old small debts, now they threathening to take our household possesions and place a $4800- and $1500 judgment upon. We could make payment arrangements for balanced owed, but they want to tack on these outrages judgments and these judgments acrrue daily interest.
