They stopped taking payments because Borack and Associates (from what I was told) had a manual payment system, which every month, each account rep would go into a computer, punch in numbers, and it would take the monthly payment from my account.  I have never over drafted my account, I have been close, but never had a negative balance.  The firm went from a manual payment system to an automated payment system.  Marcus, a secretary, and Robert Rivera (who is no longer with Borack) told myself, and my lawyer that some of the people that were currently under agreements with them have had the same problems as myself.

yeah marcus is the most full of crap one of them all at this law office. he lies cheats and is as fake as the 4 layers of pants he wears. but have no fear everyone he no longer works there  and the business is tanking slowly but surely. david has law suits out his a$$ and all his clients have left because of some scam/fraud/illegal stuff he has done. and fyi, the only attorney in that office is megan and david. marcus is just a know it all who is gettig married and cheats on his fiance with prostitues in his own bed. you can ask any one of the guys who used to work there that "pretended" to be friends with him...they are the ones who set it up for him!!. giving facts is not talking crap!!

Yeah, these people are serious... Try to ask for a payment plan, they actually did one for me for about almost a year. As a matter of fact, today was my last payment! I am now officially debt free :)

Count me in also if you file a class action... They garnished my wages
and I didn't even have court dates or subpeona or nothing 25% of my pay,
from each pay check, and the company I work for even got 200.00 for processing....harassing calls from 8am - 9pm also the original debt was
800.00 now over 3k coz of court costs, atty fees,ect....it keeps on growing
and at a supposed 11.6% rate and another 5.00 monthly fee, tried calling
to set up arrangement but never get anyone on the phone...maybe a call to the local tv station is a answer?? Also I have been looking into bankrupsy, I just got in contact with a lawyer and they told me that they can get this
fixed for 400.00 maybe a worth while investment for me..

As much as I can't stand this scum bag, David, I do have to defend the lie you just spoke about. NO ONE in that office, until about a month ago, has worked past 5pm for almost a year. Even when we DID work at night, it was NEVER past 8pm. So, if you want someone to believe your sob story, please at least be decent enough to tell the truth. Now, as far as your garn goes, good luck with that. Everyone thinks they can just go in and get it dismissed because some other dumb [***] attorney said you could. Well wake up stupid, a judge would have NEVER approved of a garn if all the proper docs were not in place to begin with. Yes, he is right. With a judgment they can clean your bank accounts out. If you feel this may happen, then pull the money out of the accounts immediately. Use this cash to hire a bankruptcy attorney and defend yourself.

They may think they are serious but when it comes time to play ball in a court, they lose.  They attempted to sue me and I said sure, I'm game.  Even though I proved that the debt was paid to the original creditor and the account was sold in error, they persued and told me that I am "in big trouble" and better "beg, borrow or steal" to get what I need.  Granted, this was told to me about 2 years ago when they started this.  I was as nice as I could be in the beginning but the constant calling, letters, etc. got old.  Finally, I said to that that I will just see them in court.  It took almost two years from them filing to finally get in front of a judge.

We went to court... they lost.  Lesson to them or any other company:  don't try to collect when someone has proof in hand that the matter was taken care of 4 years ago.  Cost them the $500 in filing fees and whatever they paid to their people.  Cost me about 20 mins at pre-trial and in hour of my time for the hearing but made me smile when the judge gave the attorney that "duh" look.  I understand mistakes happen, but when it is pointed out and you don't follow up then that is your problem.

It's not a scam, i used to work for Borack & Associates for almost 2 years, they are actually a debt collection law firm and very very much legit. So if you receive a call from them stating you have a debt? you definitely do..I hope this helps everyone who is concerned about them being a SCAM...

Borack is getting all of his Amex accounts taken away from him.  Amex knows that he is unable to collect debts, and that his payment system is not what it should be.  He has on many occasions violated debt collection laws and is not getting the amount of collections that Amex wants.  They are being taken to other lawyers like a firm in Miami.  If you have problems with Borack, it won't be long until you get a new lawyer that is willing to work with you.. Just have faith people!!!

Been through all this crap. All is scare tactics. First of all don't even talk to them. On your cell phone set certain ring tones for calls you want to recieve, don't answer others. Same for home. In florida they can't take your home period!!!. They can seize a car, boat etc IF they pay the sherriffs office about 2500.00. They have to then sell the car at abosulute auction and HOPE they make back the 2500.00. Any other seziure of belongings is ussually $3000.00 to sherriff, non refundable and has to be sold at auction. THEY ARE NOT GOING TO SPEND THIS KIND OF MONEY TO SELL YOUR 23 INCH 10 YEAR OLD TV...ETC.!!!!!!!!!!. iF YOU ARE HEAD OF HOUSEHOLD THEY CAN'T GARANISH YOUR WAGES. DO NOT, DO NOT KEEP ANY FUNDS IN BANK OR CREDIT UNION PERIOD. tHEY CAN'T TAKE ANY IRA FUNDS, PENSIONS, WELFARE, SSI CHECKS SOCIAL SECURITY CHECKS. DO NOT BE INTIMINATED BY THEM......LIVE FREE.

I have to agree with you both. Marcus is full of crap, lies about everything, IS a cheater  and thinks his $hit don't stink. But this isn't about him, it's about David. And since David is/was being investigated for fraud & embezzling money, well it's no wonder a crook/thief/liar like Marcus works for him. Like attracts like in most cases. Anywho, this place is a dump now. Sad shame what it has been resorted to. No matter who works for them or did work for them doesn't matter now. Hopefully those that are not associated with it have moved on to bigger and better things and are at a much happier place in their life. I for one know I am!

I am actually suing Borack right now in Broward County court.  My attorney has been able to get David on the phone one time.  David admitted that he made a mistake and would be happy to take 1,000 off of the debt that I "owed" which has actually been paid in full.  So, David also admitted that he has a 5,000 per case insurance plan, so he was going to fight it until his 5,000 has been used up, and then basically just give up.  They have a few days left out of the 60 days to respond until their time is up and then I shall be asking for a dismissal with prejudice.  Thanks David.

SOCIAL SECURITY IS EXEMPT FROM GARNISHMENT FOR CONSUMER DEBTS!  Its illegal for them to take this money to pay a credit card debt even with a judgment.

I worked out a 30.00 per month payment plan with them and it was on a 600 dollar balance and....they were very nice to me.

I was served a summons from Borack and Associates about a year and a half ago. I decided to call and try to may some sort of payment arraingment with them. I dont know what these people are talking about, I dont remember the name of the girl I talked with but I do remember she was VERY nice to work with. We came to an understanding and I am now paid off. I thought the handled this situation very professional.

I have not been able to find them. Their website no longer exists. They do not answer the phone number I had for them. (Haven't tried mail). Maybe they are out of business???
