I called back to the 1 (866) number and the operator said that this was an attempt to collect for a bad a check and that all the representatives were busy or out of the office and that I should leave a short message with my name, number, and my case #. I tried calling 5 times. Then I tried calling the direct line and Investigator Beckham called. I haven't written any bad checks. They are in no more compliance with the FDCPA than I can fly, if they are calling and threatening someone with a warrant and with NO proof that the debt is legitimate, which is in violation of Sections 807:
§ 807. False or misleading representations [15 USC 1962e]
A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
(1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.
(2) The false representation of --
(A) the character, amount, or legal status of any debt; or
(B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.
(3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.
(4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.
(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.
(6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to --
(A) lose any claim or defense to payment of the debt; or

(9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.
(10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.
(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.
(12) The false representation or implication that accounts have been turned over to innocent purchasers for value.
(13) The false representation or implication that documents are legal process.
(14) The use of any business, company, or organization name other than the true name of the debt collector's business, company, or organization.
(15) The false representation or implication that documents are not legal process forms or do not require action by the consumer.
(16) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 603(f) of this Act.

They have violated Sections 805 and 807 of the FDCPA by calling you before 9AM local time and threatening to have you arrested:

And that I had 48 hours from the message to call, and they also left a case number. My mom I both lost sleep over this. My mother was very terrified. My mother and I don't have they same address or phone. But they managed to her call her and left that terrifying message. These people need to be investigated immediately.

This company located me through my sister who lives in the Southern part of the United States. I live in California. They informed her that they would be sending the police department out to pick me up for check fraud. My sister then contacted my mother who almost had a heart attack. I've had contact with them however it took it least 10 attempts to reach anyone on the telephone. A Mr. Jackson (so call investigator) is a real piece of work. This company is very unprofessional and use bully tactics. The cost of my payday loan in question was $300 which went up to $800. I've only paid them $100 with 2 more payments to go. I'll be very happy when I'm done with this people. The threats I just can't deal with any longer. Beware. Never do payday loans - PDT replies to ccjjOMG!!!! that is terrible. Do these people really think that someone is going to send money directly to them. and how is that they can track you down through all of your relatives. the exact same man left a message with my elderly mom. Can these people really get by with this?

- RME WYFI recieved a call from "Inv. Humphries" as well. He was saying that my husband (who is in the military and was not home at the time) was going to have a warrent issued for his arrest if he did not pay some collection. I was at the salon at the time and began freaking out. He called my cell phone REPEATEDLY at all hours. I was terrified that my husband was going to be arrested because of something I had no idea about. He called today and gave them his account information but stated several times for them not to take any money out of the account until he had further contact with my husband's lawyer. I just told my husband to check his account and not even 10 minutes after telling them not to take it out, it was gone. What ever you do, do not give them your information!

If you have someone contacting you in regards to a debt that you obviously owe then just pay it....there is no need to seek info on how to get out of paying a debt that you owe....the same company contacted me in regards to my ace cash express account and NO i didnt like the things they said to me but the fact still remained that i owed the debt and i took care of it!!!!!!!! majority of us have the nerve to get offended by a debt collector calling us about a monies we owe!!!! stop trying to find a way out of taking care of a debt you created and either cant afford to pay now or just dont want to pay and ACCEPT RESPONSIBILITY!!!!!!!!!!!!

BTW, "payyourbill", the collection of debts (whether they are owed or not), is a CIVIL and NOT a CRIMINAL, matter! - m&mMy sister in law received a call from an "Investigator" Young regarding my 14 year old son. According to them he owes several thousand dollars in bounced checks...all written in the Atlanta/Georgia area. This so-called investigator informed my sister in law there is a warrant issued for his arrest. Interesting...since he lives in the North Suburbs of Chicago and isn't old enough to shave much less drive to Atlanta and open a checking account!!!

They will send out a warrant and then asked me where I want to be served my place of employment or my residence. I told them I have bank statements showing the payments. I told them I could fax it to them and they still call and threaten me.

And yes, many of us owe debt, but at the same time, none of us have committed fraud. Even when you make arrangement with these idiots, they still harass you.
