What part of CIVIL did you not understand? What debt collector possibly has the authority to issue a warrant? DUH. The absolute ONLY thing a debt collector can do AT WORST is take you to court. And then a judge is going to listen to your case, your circumstances, and 9 times out of 10 (unless there are repeat offenses under your belt) is going to file a judgement against you to pay back the debt. The whole process costs more for the company filing than the actual debt is worth, seeing as how they buy the debt for pennies on the dollar, so it's not worth it to even take anyone to court. THERE IS NO DEBTOR'S PRISON IN THE US. These people are breaking a Federal Law by threatening legal action that is not theirs to take. Your attorney general can help you go after these people. Congress in acted the fair debt collections act to protect people like you, They have also violated the 3rd party disclosure act, and graham leach act. Always make sure you save any voice mails from the company in question they can be used in a court of law against them.

I have every intention of having my attorney deal with your company thru the court systems. First of all if the check was given in regard to a debt, it is not consider a bad check. A individual can not be sued for a check that was presented in order to pay a debt or bill that is owed. You need to check your laws. I encourage you to keep leaving your message just as you are. Your threats are idle in regards to using the police dept, good phrase siting fraud in your voice mail. The jury loves that, and by the way I believe a debt collector can be sued as an individual in the state of Georgia along with the company they are working for. I hope your company backs you up in court

IF your state Statute of Limitations HAS EXPIRED as well as the Federal Government Statute of Limitations you can tell these people or any other collection company to GET LOST! AGAIN Check The Statute of Limitations for your State, PULL THE CREDIT BUREAUS from Experian, Equifax and Trans Union (CHECK ON THE INTERNET IN CASE THE Credit Bureau's NAMES have CHANGED!) The reality of it all people, When it comes to Bouncing a Bad Check in Most states, it is a Civil matter, and you can be required to appear before a Municipal Judge or Arbitrator.Thats a FACT, not a threat.
****Can I set the record straight for most you persons on here who aren't collecotr's, don't know the collections laws, have never worked in a Payday Loan store, or ever collected on a bad check for a payday loan? Thank you.
1) If you don't pay your bills, they Will be sent to collection agencies
2) Collections agencies CANT send you to jail, they cant put a warrant out for your arrest, regardless of the type of debt
3)If the bad check goes to an Attorney office or Investigation firm, and the Payday loan was reported as check fraud - it gets a little more serious and tricky because these people are usually Retained by the Payday loan companies
4)In most states, aside from all your other debt, (mortage, car loan, credit cards, bad debt, etc) WRITING A CHECK TO A FINANCIAL COMPANY THAT BOUNCES CAN BE CONSIDERED 'CHECK FRAUD' IF THE FUNDS ARE NEVER RECOVERED AND IT IS A CIVIL MATTER THAT "CAN" BE EASILY DEALT WITH IN YOUR LOCAL CIVIL COURT
5) The consumer protection Gurus out there have all the right intentions to want to protect Americas wallets, but they should not go into battle unless they are prepared with the right information (Per State Law) not Federal law. Again, it can be considered CHECK FRUAD in the STATES laws and go to court if not paid or recovered. FDCPA has no relevance to matters not considered under its jurisdiction.
A prime example: If you break a non criminal traffic law in your city, you go to your local court. Even though you have FEDERALLY protected rights against illegal and unfiar searches from the police and rights once arrested, you dont go to the Feds for a traffic Citation case (a civil matter), you go to your local courts.
The same goes for Check Fraud. In certain States of the USA, [which ever state that is for you], if you bounce a check against a FDIC insured account (meaning the feds own the account so they can make laws about it) it is considered a CIVIL Matter (in that state where the check was bounced). All civil matters [$$$, monetary funds, Money, Mulah, Cash, Dough) are under the jurisdiction of your local municipal Civil court. PERIOD!
Maxing out your credit card is not a civil matter, going negative in your checking account is not a civil matter, not paying your car payment is not a civil matter[they just repo the car]
America, do your own research, do your own homework on the laws rules and regulations that affect you. Don't let the small print in Payday Loans contracts and the Gurus of Consumer protection, blind you from know the truth.
As a Collector in the collections industry, I challenge you to call that 800, 877, 866 number thats keeps poping up on your caller id, and pay your Payday Loan off. Get a settlement, make an arrangement to pay, because truthfully, we shouldn't have to threaten you with jail time and court appearances to get you to pay your debt. In your defense, I urge you to dispute your credit card charges, charged off credit cards and any other unsecured debt from now until kingdom come. More complaints on a Mel Clark working for this company. - Smarter than delanoreYes getting the same calls from some lady named Tracy Morgan. At first she was calling about check fraud from some payday loan she said I never paid, which by the way is NOT check fraud. When going thru my records, thank God I kept my reciepts I realized she was talking about a debt to which I have Paid In Full!! What it looks like is they bought my info and are trying to make me pay it again using these
scare tatics and harassing me. Well I took ur advice and sent a DV because this collection agency tld me to pay right now or will send out a warrant because they did not have "time" to validate. So I sent out a DV and I got a message from Tracy saying they got my letter and that I needed to talk to manager. I than got another voicemail from some guy Sergio , proceeded by 2 calls from autodialer. When I finally talked to them, Very RUDE, did not want to let me speak. I told them do not call me, ureciwved my DV letter in mail I expect the validation by MAIL in return. Than the "manager" told Tracy to hang up on me, but i fear it's not over. What else can I do to protect myself n to make sure this doestnt go on my credit report, which I included in my DV.. And2nd to those being called, u prob don't owe anything like me but they are trying to bully me into "settling" by giving me a bill TWICE of orginal amt.. These guys are scam artist!!!! - China| 1 replyInvestigator Mel Clark called my place of emplyment with this same mess. I was scared out of my mind because I did get a PayDay loan over two years ago and they had all of my information! Mel Clark said that he was going to send out his unit to pick me up at my job now if I did not pay. He also said that it was Check Fraud. But when I gave my information then he said he would stop them from coming and he was talking to people in the background and everything; so I was for sure that it was for real. I am glad I did find this site. I will pay but I do not appreciate their tactics and playing with people about their freedom! That is just wrong.

He states he is the lead investigator for a magistrate court and they have a warrant for my arrest for a debt I owe. He works for Delanor Kemper & Assoc. and they are under investigation themselves for unfair debt collection practices.

#1-THey need to provide proof of debt
#2-it is illegal to threaten you with Jailtime, you already have a case on them
#3-Payday loans are illegal because the interest is above what by law they can charge.
