- Big-D replies to ballzAnd not to mention that these debts that were a year or more old and even up to a decade ago that the statute of limations have run out on they were charged off by the original creditor,,and the Federal Gov.has gave them Billions of tax payer monies to bail them out, and they want to be paid back by you for the same Debt,,,It most be nice getting paid back by two different people for the same debt. DO NOT feel sorry for these scum bags.........They shouldn't of bought the Debt to begin with....God Bless !!!
- Anonym"Amanda Perkins" she said her name was. same folks on "Zombie debts" which I have a few due to our American Medical plan. 2 things, 1stI always ask who's calling and then in reference to? If it's a "personal matter" than just say "he's (she"s) not interested and hangup. Seems to work for me.
Dick'em like the Banks and Credit Card companies have been doing to consumers for years. They claim their rates are so high because of creditors bailing on them. Well I for one took advantage of that offering I was paying for in charges. Thank you and quit yer complain'n is what I have to say to them.

- CB| 1 replyI have been getting calls from Portfolio Recovery for this last three months. They use atleast a dozen different numbers to call from. They have never left me a message as to why they are calling me. To my knowledge I don't have any outstanding debts with anyone. I don't appreciate being harrassed this way. I have filed a complaint with the FCC but have not heard anything back yet. I just want the calls to stop. I will not answer their calls when I am home.

- BettyI received a call about an alleged credit card debt from 1997. There is NO way I even had a credit card then because I didn't EVEN LIVE IN THE COUNTRY. I asked what it was for, and they said some vague bank company but couldn't give me details. I said "send me details of the debt, I am not liable for something over 10 years ago that I wasn't even around to do!" They actually swore at me, and hung up on me. Then my husband called them and (they actually answered) said the same thing, confirmed our address to send info, and hung up. That was TWO years ago and I never got ANYTHING in the mail from them. For the past month they have started up again, but I never answer the phone, just block their number. I only ever get cell phone calls, so no one but telemarketers call our home number. They are scammers!

- CANT TAKE ITWhat idiots....They tried to tell me I owed on a debt that was over 15 yrs. & that they tried to reach me several times via mail & by landline. Amazing thing is I have lived in the same place & had same phone number for 22 yrs. But accordingly to them they could never reach me. Now for the kicker.....the original debt was supposedly for about $400 - $500 (which is news to me).... IT'S NOW UP TO OVER $20,000.00 according to them because of late fees, interest......What a bunch of BS. They asked me if I could pay at least $500 a month & wanted to know when I could start paying. I just laughed and hung up.

- NuyoRican| 1 replyPortfolio Recovery Associates, of Norfolk, VA is a purchaser/seller/collector/ of junk debts purchased in portfolios for pennies on the dollar. Upon purchase, these debts are inflated to where they attempt to collect on them from consumers at very high profit margins. They make thier money off of people not knowing the law because 99.99% of the time the debt is past its staute of limitations.
Make sure you check what those limits are as they vary state by state. Also note, if you pay them even a penny, that statute of limitation is null and void and the debt becomes good again!! hence DO NOT PAY THEM ONE RED CENT!!! I am in the process of finding out how I can stop them from calling, but at this time all I can say is that the debts they say you have have been written off already, if not paid off!!!

- AlfalfaThe fines (for violating the DNC laws) went up on Jan. 1st to 11,000 PER violation:
Legislative News: $11,000 Do Not Call per violation effective 1/1/2011
http://www.callcompliance.com/regulations/statelist.html
And, yes, the DNC laws DO apply to third party collection agency if they are harassing the wrong debtor:
Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.
This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc. NCO Group is a debt collector that uses automated prerecorded collection calls. In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc. Mr. Watson filed suit under both the FDCPA and TCPA.
David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors. Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call. Judge Davis wrote;
[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.
Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.
So what can you do if you receive "wrong number" calls from debt collectors?
1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

TCPA: What Is It & How Does It Affect You?
The Telephone Consumer Protection Act of 1991 (TCPA) does many things - including prohibiting debt collectors from calling your cell phone without your permission. Each unauthorized call could result in the debt collector paying you up to $1,500. Here's some helpful information on the Act and how it might affect you.
What is the TCPA?
The TCPA, which was signed into law in 1991 under the first Bush Administration and codified under 47 U.S.C. 227, prohibits calls using any automatic telephone dialing system or artificial or prerecorded voices to:
•Emergency telephone lines
•Telephone lines of any guest room or patient room at a hospital, health care facility, elderly home or similar establishment
•Telephone numbers assigned to paging services, cellular telephone services, specialized mobile radio services, other radio common carrier services or any service for which the called party is charged for the call
•Any telephone call to a residential telephone line
•Send unauthorized faxes
The only way that a caller won't violate the statute is if express consent has been given - and violations of the TCPA are steep. An unintentional call carries a damage amount of $500; an intentional call carries a damage amount of $1,500. That's per call and regardless of the purpose of the call. In other words, if they call you using an automated dialing system without your consent, they've violated the Act and you are entitled to damages.
How does it affect you?
Most debt collectors use automatic telephone dialing systems to contact debtors. You'll recognize this when you go to pick up the phone and there is a slight hesitation on the other end. In fact, most debt collectors are calling nearly 100 people at a time just waiting for someone to answer. Although many have stopped calling landlines, cell phones are another story. Since more and more people are using cell phones either instead of, or in addition to, traditional landlines, debt collectors are finding their cell phone numbers using skip tracers, calling them and hoping that they don't realize that the TCPA has been violated.

Keep a log and let them know if the calls continue, you will be taking them to court for TCPA and FDCPA violations. - Concerned| 1 replyI have been ignoring this number for awhile now, but I finally looked it up and found this page. Last week I received a court summons from Portfolio Recovery Associates that said they were suing me for $1200. No where in the documents did it say who the original creditor was or what it was for. I wrote a response to them and the court asking for documentation, which now I see they probably don't even have. I just wanted to let you all know the lengths these people will go to to get money that doesn't belong to them. If I had let the case go to court without any response from me then they could have attached my wages etc. Luckily I questioned it and now we will see what happens. Stupid [***].
