I just recently got out of the hospital again. I had my fourth heart procedure in five months. The doctors say that I am to avoid stress. Portfolio Recovery just called me AGAIN, about a super inflated debt that is seven years old or older. They are crazy.

Truth is, I am gonna have to use my own product. The Bankruptcy Intranet. I know it works because I myself created it, for "Working Poor Americans." Why? Because the game is rigged. Big corporations got bailed out by the government. But the everyday people who work twice as hard as anybody else were over looked as usual.

No wonder I have had four heart procedures. Everybody comes to me for help, including my family members. As if God gave me something extra. Whatever. I created the Bankruptcy Intranet after having to do a bankruptcy petition for my niece. It was a real pain in the ass. But I had to do it because she was up to her eyeballs in debt, and she was being evicted. So, I didn't do it for her sake, I did it because she has kids. I did it for the sake of the kids.

Besides. It makes no sense for a lawyer to charge a broke person $1,000 or more plus court fees to prepare a chapter 7 bankruptcy, when they know perfectly well that most working poor people qualify for a fee waiver. That's the Gods truth. A chapter 7 bankruptcy petition isn't worth $1,000. In fact, 95% of chapter 7 cases are no asset cases. That's why the court will waive the $299 filing fees, because the people are "really" bankrupt. The question is, how much does it really cost for a working poor bankrupt person to file chapter 7? The answer is $49. That's what the Bankruptcy Intranet costs. It contains everything, including a fee waiver for the $299 court costs.

No wonder I am under attack. I am in litigation in between surgeries. Fighting like a dog. And I have to do everything myself. I am a f _ _ _ _ _ _ heart patient. Of course Swedish finally offered me a spiritual counselor and an advocate, but they never showed up. Help never shows up. Only debt collectors and other angry hostile people. They don't give a damn. Instead of being able to relax, I am recovering now from producing an appeal on friday and getting it to the post office on Saturday to preserve the 30 day statute. What's that about? My Asian landlord attacked me over my bankruptcy website. What the h _ _ _ is up with that? Anyway, I filed a fair housing complaint with HUD, only to discover that HUD doesn't do the investigation. A local City Agency full of city employees does. Great, because I sued this same landlord AND the City six years ago! They work together. Thick as thieves. How is that possible? Easy. I live in low-income housing.

Look. Never mind. I feel like a dolphin stuck in a tuna net. Debt is easy to discharge. That's the least of my problems. I have said the above for your sakes. Because if you talk to an attorney I can almost guarantee that they will try to steer you into filing Chapter 13 - even though you probably qualify for chapter 7. It's a CONspiracy. Look at it this way. The rich were already bailed out. Who pays for it? The poor. Look at the back of a dollar. See that pyramid with the eye in it? What do you think it means? It means those at the bottom of the structure support those at the top. Therefore, those at the top (lawyers) do not want your debts discharged. That's precisely why when the founding fathers set up the original colonies - lawyers were banned. That's the truth. The system was NOT designed so that lawyers could become Presidents. If you think I am lying or trying to scam you, do your own research.

    Every Man His Own Lawyer
Lawyers were actually banned outright or faced tight restriction in many colonies ... over the colonies, England's common law system - complete with courts, ...

    P.S.

At Sargent Shrivers funeral yesterday, Bill Clinton said;  "many of us spend most of our time trying to either rewrite the past or positioning for the future, rather than living in the moment. And in the end it doesn't amount to a hill of beans."

Why waste time playing debt games? Either embrace it and pay it, or simply have it discharged  -  get rid of it.

I have placed a bucket of water in front of a horse. Rather than drinking it, the horse has been discussing water quality with other horses now for months. That's why some people eat horses....

    Well said, Rob.

Someone I am close to has also had their own share of issues with this "organization", who are hell-bent determined to collect on out-of-statute debts anyway they can. Anyway, to cut to the chase, THEY were the ones who wound up defaulting because THEY failed to provide the documentation to support the charge-off on a time-barred debt to the IRS, which had been disputed from the getgo. The worst that probably happened to them was they had to pay interest and penalties on the revoked 1099-C, which amounted to mere chump change in comparison to the billions of dollars they and the other junk debt buyers regulary rake in for their investors on Wall Street, in the process of ripping off unsophisticated and uneducated consumers. While I am happy with the outcome, I am NOT happy with PRA's attempts to coerce, threaten and intimidate someone I care about into paying for a debt they did NOT owe!

I was divorced several years ago, and had an attorney handle everything.  My debts  - then and now - were small in number and amounts, and all current.  The only reason for these folks to call me can only be mistaken information, or if my lawyer let some minor detail “fall between the cracks,” the latter very unlikely.  These weasels buy old, dubious, “debt” instruments, long beyond any legal period of collectibility, for ¢’s on the $’s, and then auto dial many numbers, hoping to reach someone “live,” where they might occasionally coax or intimidate them into paying something.  Apparently, though, if one does get involved in detailed discussion with them, it is possible to reestablish the debt as current - so simply ignore these scum bags in any event.  Besides, they mostly employ representatives who know little or nothing, and simply operate from a “boiler room script.”  These folks have been around forever, but now can use modern technology to dial hundreds or thousands of #’s from phones with a plethora of area codes, sometimes leaving a voice mail message, usually not, and get on-line for the first dialing they note was answered “live.”  Again, ignore these [***] completely!

Trying to collect 20 year old debts ?

There is a Statute of Limitations on debts.  In most states, using a Credit Card as an example, if one has not made a payment in 3 years, and the Credit Card company has not filed suit, such a debt cannot be collected.  Anytime a payment is made, the 3 year clock starts over.

So often times Credit Card collection companies will try to get you to "make just one small payment" just to restart the 3 year clock.

Such a debt will stay on your credit report for 7 years but the debt is no longer collectible.

This company is calling to collect on a debt that I all ready paid back to my origonal debtor years ago.
Yet these junk collectors are trying to collect on it again. They also say that there has been activity on this account in the last three months. I haven't paid on this account after it was paid off(2000).
That account was negotiated and paid through a third party(genius credit), and verified on my credit report(paid as agreed/paid in full/account closed)..
Every time I buy something(credit) or every three years some one is trying to collect on it again.
Even if you do pay off a credit that's been charge off it still never goes away.

I received these calls & I answered one. Nasty woman told me I had taken out a Discover card  & never paid anything on it & I owed $35,000.00. Now I'm sure I would have heard from Discover before they would let me rack up $35.000.00. I did actually have a Discover card once, but that was in my maiden name 20 years ago& I paid it in full every single month & then closed it. Since then I have had 2 marriages & some difficulties but I do not owe this money. I told her that. She said Can you pay $25,000.00? I told her I was homeless, living with my sister, on Medicaid & had no money at all. Do they know what food stamps are?!? She said she had to transfer me to their Special Agent. This woman asked if I could pay $10,000.00. I said I couldn't pay anything as I did not owe anything! She asked if I could pay $7.500.00. When I said no she said she would have Mr. Ragnooli call  me back.  He called a few days later & asked what I thought I could pay & I told him ZERO. He said he would call back. he didn't. I received a call  yesterday, 5 years later from some new bimbelina they hired at PRC. What meanieface stupidheads!!

Does any one on here know how the SOL is affected if you owed the debt in one state and made an agreement with the CC company and paid half off and they dismissed the other half over 7 years ago so you thought it was over with , but now live in a different state and are receiving calls  on every single case you paid on with an agreement with the CC company? Thanks for any info you can share with me.

Today there is one of those 1099-C IRS forms in my mailbox. These people must be alcoholic cocaine addicts, there is no other way to explain their behaviour.  They are under investigation for this scam, they have been sued, they have been found in violation, and yet...these a**holes continue!

Last fall, I contacted Pennsylvania Attorney General's consumer protection division. One of their staff talked to one of the PRA bottom-feeders, who assured him that the calls had stopped.  Since then, our household  has received no fewer than 45 calls, from who knows how many different phone numbers, (I have not taken the time to count, but they are all written down) no messages, none of the calls was ever answered, and now today my former self  received this phony 1099C for a debt these crooks have *never* verified I owe.

The debt is in the name I stopped using 8 years ago, when I married, and that alone is past the statute of limitations. At the time of my marriage, I had not used a credit card five years, since a catastrophic illness. These bottom-feeding pond scum bought *a* debt, to a bank (credit card?) I can't say for sure I ever heard of, for pennies on the dollar. Any credit cards I may have ever had in that period of my life had no balances over $1800, so these vermin would have bought the debt, if it even exists, for between $50 and $90, and now they are issuing a 1099C in the amount of nearly $5 thousand??????

They are obviously a sick, demented brain-addled bunch of vermin in that outfit, but the real shame and scandal is that apparently, the so-called *laws* of this country allow these scams as perfectly legal.  How can one "buy" a debt that no longer exists?  If it has been removed from the bank's list of assets, and the bank has received all kinds of tax write-offs for laying it to rest, how can the bank turn around and "sell" what no longer exists to bottom-feeders like PRA.? How can these PRA vermin then be allowed to creatively re-fashion a "debt" they "bought" for $50 into something they re-invent as being $5000 of debt, owed to them?  And then, the ultimate fantasy, they claim a "loss" of $5000 to the IRS when the victim of this scam fails to pay up???

Raising the B.S. Flag on this one. icalledthemback Do you work for them?

Do not give them any part of your SS number. If you must answer the phone don't ever admit to anything. It's pretty safe to say that they wouldn't be the ones calling you if you actually owed any money. In other words. If Portfolio calls it means you don't owe any money. They are just trying to scam you.

Oh and it's not a person calling you. It's a robot dialer. It dials down the list of numbers they have all day long until it hears you pick up. Then it quickly transfers you to a live person who looks up your info based on the number associated with you. So it's not even a person on the other end until you pick up. That's also why sometimes there's nobody there when you do pick up. It means all their operator/jerks are busy with other unfortunate uninformed people.
