They called me too, every week for the last 3 months (1/10/2011) and there is not a single debt needing to be collected in my name, believe me. I even checked all three credit reports. If it was a real debt collector they would leave a way to get in touch with them so they could get the money. - A scam, that's legalPortfolio Recovery is a legal scam that the US government allows. Under the fair credit act, a debt can be collected even after written off by the original company. This opened up a new industry of zombie debt collection companies like PRC. And its growing. PRC donates a ton of money to politicians and lobbies hard to keep laws about collection to favor debt collections. Several times I have asked for proof of the debt they just hang up and the calls start back within a week. They pay their collectors on commission, so they don't want to deal with proper collection laws. Don't talk to these crooks, don't tell them anything. The law clearly states once you ask for proof of debt they mush furnish it within 30 days. If they don't the calls must cease. Try to explain this to them and they just hang up. They don't want to deal with the law. Again, they collectors get paid on collections, not sending out mail. I have filed several complaints, but they have so much influence with Congress they just pretend they didn't get the complaint. Laws must be passed that states, once you ask for the calls to stop they can only contact you by mail or take me to court. And if the debt is legal and substantial they won't take you to court in fear you file bankruptcy and they get nothing. The current law states debt never goes away, but after the statute of limitations expires in your state they can't sue or take you to court. The law states they may try to collect after the SOL expires, but may not harass a debtor. The question becomes what is harassment. I feel 2 or 3 calls a day after you asked to stop calling and to only contact you by mail is harassment. Too bad our corrupt politicians don't put an end to zombie debt collection. Lately I have been getting calls for debt for my brother. I tell them it's not me, but they continue to call. He uses my Florida address to apply for credit and they must think he lives with me. Just block their many numbers and if you do pick up the call, ask for proof of debt. It will give you about a week or two of no calls, but they will start back up.

- Anonym replies to NuyoRicanThanks for this list! Honestly, yes I do have some OLD (at least 10-12 years) debt. But I'd never pay a scum sucking company like this. If I could, I'd pay the company I owe directly. I have a Samsung cell phone that blocks any/all number(s) I want. I just get upset because they call relatives. If you can't block them, it's always fun to answer and just keep repeating "What? I can't hear you" every time they try to speak. Really, you can have fun with these loser, idiot, dirt bags if you're in the mood!
- James e McC.i have been receving calls about a debt that is from 1997 that is 14 years ago now that i no the people that call have no write what do we do the company that had the debt said that it was not on there records and did not care if i paid them any thing at all so i got them on the line and called pra and the people there told me they would sue me if i did this agin when i ask for what they said harassing them so i told them not to call me anymore and what happend 15min later the phone ring and it was them i am so tired of this

- BREW NINJA| 1 replyReceived a call from Portfolio today; just like many other days, in an attempt to collect on a time barred debt. They have been served with a court notice to cease & desist any contact with me and they have ignored it, they have made threats and violated my civil rights and now have earned themselves a law suit.
I am working with a MI based attorney to bring a class action suit against these idiots at PRS, anyone wishing to be added to it please send me a message with your name and number or email address and I will forward it to the attorney handling the case.

- Melissa replies to Kristin| 1 replyYou are not correct. A debt being charged off does not relieve you from having to pay it. You always have to pay it. All the statute of limitations does is run the time for which the debt may be enforced in court. You are technically still owing it forever. And the collectors can contact you forever. The only thing you can do is send them a notice to stop contacting you; at that point, they can sell it to someone else who can then start contacting you all over again - rinse and repeat. Any agreement you have to pay anything still exists once it is charged off, and may be assigned or sold to anyone else - just because one side of the agreement changes parties, that does not change anything except the address on the envelope where you send your payments. The only hope you have of defeating it legitly is to either pay it (what you owe, or some settlement they offer for less - and if you do those things, you get something in writing stating that it will then be gone forever, which means NOBODY can ever contact you about it again and it can't be sold, etc, and that they will remove it from your credit - must all be in writing, I repeat) or to wait for the statute of limitations to expire (in which case, you'll have the above scenario, where nobody will be able to enforce anything against you in court, but you still will technically owe it and may be contacted about collecting it forever from whatever company purchases your debt. I am an attorney and I help debtors with these things for a living - I know these laws very well. Many of the collection agencies break laws in their methods of collection - these things should be reported. Complaining is not enough, and will not help. Enough formal complaints (ones to the FTC, not ones on message boards online), and the company will be investigated. If you go to court and say "I do not owe this, it has been charged off," you will lose. If you go to court and say the company has been harassing you - let me tell you, it takes an incredible - almost unbelievable - amount of evidence to get harassment to pass muster. I have seen cases where you would read them and say "oh my god!" and the court has still not said that it was sufficient. The bottom line is that there are plenty of rules to protect debtors from these creditors, but the creditors also have some rights (in that - if you owe something, you still owe something, and the courts do not like to allow people to get something for free, so whining about the collections doesn't work). Do not GUESS at what your rights are. Look up what you can do on the Fair Debt Collections website @ http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf
- Melissa replies to phredWhether or not she has reactivated the debt depends on what state she lives in. Someone mentioned Florida, I do not know if this is Kristin's state, but it's a good example. A promise to pay a debt barred by the statute of limitations in the state of Florida must be in writing to be valid; if she's in Florida or any other state with similar laws, she did NOT reactivate the debt. This is why I repeatedly tell people to look up the laws - do not listen to people on these boards, because most of them are giving you incorrect information.

Why be nasty to someone who is paying what he owes? And geez, is it really surprising that the company was nice to him when he was offering to give them money? I think that make perfect sense... that's about the only thing that seems to make these people be "nice."

The only way they get fined is if you send them a cease and desist letter and they continue to call after that, and then you take them to court. Block list does nothing but block their calls...
- huh? replies to Tylercalling you on a debt you owe is not harassment. and winning in court on harassment charges is ridiculously hard. look up some of the cases. stop complaining if you're not doing anything about it! send a cease and desist letter to them and make them stop calling you. it costs less than $5. type it up (plenty of online samples), mail it via registered mail (you want the signed green card back in your hands, the postman will bring it back), and if they call again, they're sunk. that's all you can do to stop the calls (other than paying your debt, or maybe telling them you want a verification or validation request IN WRITING, which will stop the calls until they comply). good luck!
- Melissa replies to ConcernedI am sorry to tell you, but if you received a summons from a court, it is too late to request documentation. You had better go to court!!!! IF you do not show up, they win BY DEFAULT and they can then do whatever they want to you. Once they have that default judgment, they can attach it to your property, come after you and/or your employer to garnish you, whatever - you absolutely can not fight the judgment once they win by default. If you received a summons, then the court is already involved. I cannot stress this to you enough. I am an attorney, I do this for a living. The only way possibly out of a default judgment is to say that you never received the summons (due process violation). Since you said you received it and send them a response, you are almost certainly denied from even this. You can't later claim that you don't owe the money or that there was any problem with the amount, etc. You must go fight this NOW!!!! I hate to see this happen to people! a Judgment is bad news! you will have an entirely new statute of limitation on the judgment, and then even after it goes dormant, it can be revived - if you have nothing now to pay it, they can wait until you do, and THEN take your stuff to pay it. I hope you are still able to go to court to fight this because they enter a default judgment against you. Sigh. :(

They are allowed to contact you to collect debts, even ones that are time barred. Time barred just means that they cannot bring a suit against you for that debt; it doesn't mean you no longer owe it - and if you still owe it, they can still call you. Why do they keep calling? Because people don't do what the law allows us to do. SEND A REGISTERED CEASE AND DESIST LETTER! IT's the USPS, not the court, that does this. I'm not sure how they have violated your civil rights by making phone calls... that sounds pretty bogus to me.
I don't get why so many people complain a [***] and moan, the law gives us plenty of protection, we just have to get off our lazy [***] and do it. A company that violates the laws so blatantly as this one would sink under their fines if we all followed the protections we have been granted. But no, we just complain online. How about this: send the letter in writing; keep phone records of how many times they violate it; go to small claims court. Instant win. You get paid for it, and it comes out of their pockets. Stop being victims and start hitting back! - lady Tthis # keeps calling me.... i don't answer..... if i don't know the number, i don't answer. is there someway to block call on your cell phone? or forward them to the sheriff???
