Most of these places just disregard it. The one thing that seems to work pretty well is to write a cease-and-desist letter to anyone calling about debt. Of course, they also sometimes just start using a blocked number or a personal cell phone, but if you catch them at it a few times you can sue them and possibly win $1000 per infraction in court. Look up the FDCPA and educate yourself. Knowledge is power!

It is not that you are not willing to pay (which would be illegal) it is that you need a lower payment. Check on that! Also, each State has its own consumer protection agencies (government administered) and laws, check those too! "May the wind blows again on your back and the road rises up to meet you"...

In Puerto Rico is the same and I state it clearly when they call: cannot tape calls, cannot call to work, cannot call before 9:00a.m. or after 7 pm, nor on Holidays or weekends, etc. It is the local law and that's the law to where they are calling. Also, check because I get this type of calls more or less and 9/10 times and I do not owe a thing. So they might even be phishing scams.

This is the address for those of you who want to write a cease and desist letter to them. I have told them repeatedly to stop calling my house but they call me all day long about 15 times a day. I am writting them a letter now and informing them to cease and desist and I will be dealing with the debtor themselves. 2 years of them calling me even thou I have changed my number and had it made private. - Justice4allPortfolio Recovery isn't in the debt collection business, they're in the harassment business. Ask them to mail documentation of the alleged debt or detailed verification paperwork of claimed amounts owed and they won't. They only want to frighten people into mailing them money. The govt should take a look at all the complaints, and send in the DOJ and IRS to scrutinize PR's books, THEN we'll see how big a bully they are.

- Jack replies to AnaHere in Oregon, you let them serve you and you go to arbitration. If underemployed or unemployed you could offer them a dollar a month and provided you do not break the promise all legal action and contacts cease. Of course, you still get a judgement on your record for the full amount which allows the collection agency to move on your assets and liquidate them. One other things, do part time jobs only, like two 20 hour jobs. That way each employer is below the federal threshold for garnishments, so they cannot garnish your money. Get a checking account with someone you have not had loans with. Then they can't find your bank account to garnish. I worked for a collection agency. Want to force a judgement? Just tell them to cease and decest calling you at home and you force them to leap forward and have you served. Dumb idea. Collectors are on commission and get paid more for every suit they file in one month because most agencies are either attorneys or have one on staff. They charge the client if they collect and you are forced to pay legal fees. Big Profit for them, big mistake for you.

Any creditor who refreshes the balance in an attempt to challenge the law is in violation of the Oregon law you spoke of. Here in Oregon, it is the consumer that is protected. Someone mentioned downloading some software for their phone and I assume that is a cell phone. Automated dialing systems such as collection agencies use cannot dial cell phones by law. They must be dialed by a human which rules out collectors.
