As to a "written copy of the bill", the actual FDCPA requirement is to send an initial dunning letter bearing specific disclosures soon after first contact with the alleged debtor. That letter verifies nothing. It establishes a claim and opens a 30-day window for dispute, which must be made in writing to trigger key FDCPA protections.

It's not a waste at all, but an investment. Nothing says "I'm as serious as cardiac arrest" like a notice decorated in green USPS labels. Having such a notice in play greatly eases the burden of proof in a prospective lawsuit against the recipient company which has failed to obey what that notice says. - CWG40| 2 repliesID themselves as First National Collection Bureau.

Some Tips:
*Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

Statutes of Limitations on debt do not limit "bill collection". They limit the time in which a creditor or debt buyer may sue to collect. Mere collection activity past SoL is legal in all but two states, and Texas is not among those exceptions. - William replies to CWG40| 1 replyAre they licensed to collect debts in Texas ?

They have a Statute of Repose which extinguishes debt when SoL runs. I don't mention these exceptions often, simply to avoid aggravating the widespread confusion. Most people have trouble enough discerning SoL from the FCRA reporting limit.

- B Man replies to WilliamThey posted the required bond, but that is different from a license. Licenses can be revoked when they are abused. Only about half the states require debt collectors to obtain a license, and Texas is not one of them.
Texas does require that companies using an "automatic dial announcing device" (ADAD) obtain a permit from the state. FNCB does not seem to have purchased this permit, and might have trouble obtaining one due to their well known history of non-compliance with the TCPA. This may be one of the reasons their robocalls now just hang up without leaving a message. That gets them through a loophole in the Texas ADAD rules, though the calls are still illegal under federal law when made to cell phones. - TiredCall went to voice mail, but no one spoke, & then hung up!
