- HoraceThis number comes up as Gordon Daniel N. Do an Internet search, it's apparently an attorney in Oregon that buys debt for pennies on the dollar. He's beat the DOJ in court despite his shady practices. Best advice...do not speak to him or his associates. Ever. If you actually owe money make him serve you, and if you don't owe anyone money and he serves you, make sure you go to court because he specializes in default judgements. Absolute scum of the earth.
- Total Justice replies to JamesDaniel Gordon PC and his partners have a terrible reputation! Looked them up on the Internet and found they have had trouble with the bars of at least two states. Frankly , it is a wonder that he and his partners aren't in jail or prison! Here is additional info on just a few illegal and unethical actions they have taken: DANIEL N. GORDON OSB #782255 Eugene Public reprimand.
On Feb. 23, 2009, the disciplinary board approved a stipulation for discipline reprimanding Eugene lawyer Daniel N. Gordon for violating RPC 8.4(a)(4) (conduct prejudicial to the administration of justice). In April 2006, Gordon filed a lawsuit in circuit court in which he alleged that the defendant owed his client some money. Thereafter, Gordon received full payment of the outstanding debt from the defendant. Despite this payment, Gordon filed with the court an affidavit in support of an ex parte motion for an order of default in which he represented that the defendant still owed his client money.
At the time Gordon prepared the affidavit and filed it with the court, he failed to check his records and determine that the defendant had made payments and had satisfied her debt. Based on this motion and affidavit, the court entered an order of default and general judgment against the defendant. In April 2008, upon Gordon's motion, the court vacated the judgment.
Note: In the past decade, Gordon has had 17 ethics complaints filed against him with the Oregon State Bar, and 55 consumer complaints with the Oregon Department of Justice.

I send copies of my orders to prove I wasn't in the country at the time and they "take care of it" by selling it to a different collection agency. I pay my bills if they're mine.

The new one is well we "bought" the loan. But yet they can't tell me who the original debt was from or how much or any information.

- Jj| 1 replyWhy are they calling me, about a debt that has been charged off?

- BigA replies to JjBecause it was sold to a junk debt buyer for pennies on the dollar and now the junk debt buyer wants to get whatever he can out of it. However, they need to follow the FDCPA. You need to assert your rights. There is a high probability that this JDB cannot prove chain of title to the debt and has no right to collect on it. simply owning a piece of paper with your name and an amount on it does not give them that right.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Read up on your rights here, get template letters to send and also make a complaint at this government site: http://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.

- Gigi| 1 replyThey called but hung up on my answering machine. Seems like a spoofed number or possible robo caller, since that's what they have been doing a lot, lately. I've been getting those from Comcast too, and a few from Microsoft saying that my computer was compromised, always from someone who doesn't speak English very well. LOL!
Glad I have a call blocker. I hate robo callers. And if it's not a robo caller, tough luck! I never give out any personal info over the phone, no matter who's calling, legit or not. You can't see they are legit over the phone!- Caller: gat lawfirm
