The caller id shows 623-492-6031 on top and below that it shows 602-537-9012. I received the call at about 8:30 toady (1/26/2010).

The woman on the other end had a heavy accent and did not speak very good English. She asked for a name I never heard of and I asked her twice to repeat it. Then I asked her what number she had called, and she said she was with American Express.

I SUSPECT SCAMMERS AKA IDENTITY THIEVES

This is one of the numbers for American Express Account Services.  I was able to call American Express and confirm it.  The problem is, these people are complete morons who will annoy every unfortunate soul in the country who happens to have the same name as someone who owes them money - EVEN AFTER THEY ARE TOLD BY THEIR OWN PEOPLE THAT THE PERSON THEY ARE HOUNDING IS NOT THE SAME PERSON WHO OWES THEM MONEY. The idiots are completely dumbfounded by the concept that there can be more than one person with a particular name. They made me late for work twice last week, so finally I got someone from American Express to contact them and tell them to stop pestering me.  They also put notes all over the computer that I'm not the person they are looking for.  I thought that would be the end of it -  but no.  They called me again today - and this time on my cell phone!!!  I completely lost it with them.  How can anybody be that stupid and still remember to breathe!!!???  Pathetic!

Dan-NYC: Can you sue even if you are a member, but you are not the person they are looking for?  So far they've called my home/cell phone at least 4 times over the past week trying to get me to make a payment on a "blue card" account that isn't mine, and I'm really starting to lose it with them.  I seriously don't know how you've endured 40-60 calls without going off the deep end with them! It wouldn't get my blood pressure up nearly so much if I thought I could get $1500 a pop for these calls!  Bring it!! :)

OK - here is what I found on Wikipedia:

Unless the recipient has given prior express consent, the TCPA and FCC rules under the TCPA generally require:

       * Solicitors may not call residences before 8 a.m. or after 9 p.m., local time.
       * The solicitor must maintain a "Do Not Call" (DNC) list, which must be honored for 10 years.
       * Solicitors must provide their name, the name of the person or entity on whose behalf the call is being made, and a telephone number or address at which that person or entity may be contacted.
       * Solicitation calls cannot be made to residences with artificial voices or recordings.
       * Calls cannot be made with artificial voices or recordings to cell phones or to any service in which the recipient is charged for the call.
       * Prerecorded or autodialed calls cannot engage two or more lines of a multi-line business or to any emergency number.
       * In a related section, unsolicited advertising faxes are also prohibited.
       * In the event of a violation of the TCPA, individuals are entitled to collect damages directly from a solicitor for $500 to $1,500 for each violation, or recover actual monetary loss, whichever is higher.

The major limitation of this law as enacted was that it was ineffective at proactively stopping unsolicited calls in that the consumer had to request of each telemarketer to be put onto that telemarketer's do-not-call list. This burden was lifted by the Do-Not-Call Implementation Act's establishment of the National Do Not Call Registry and adoption of the National Do-Not-Call list by the FCC in 2003

The CAN-SPAM Act made a minor amendment to the TCPA to explicitly apply the TCPA to calls and faxes originating from outside the US.

The portions of the TCPA related to unsolicited advertising faxes were amended by the Junk Fax Prevention Act of 2005.

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

    David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.

So what can you do if you receive "wrong number" calls from debt collectors?

    1. Sign up for the Do-Not-Call registry.
    2. Save the calls captured by your voice mail or answering machine.
    3. Contact a consumer lawyer.

Called, then hesitate for a pre-recorded message; if not able to answer they do not leave phones message - just hang up.

    Try this.

On your cell phone, save their number and on the same page scroll down to "ringtones" and set this to "no ring".  This way a call from this number will never disturb you again.

They did not probe me for any info (i.e. phishing) just wanted their money. They only care about their $$$, all the credit card banks are the same
