- JDA Mr. Simmons from Mann Bracken called this morning and said that he wanted to talk about a debt he said I owed. I explained to him that I had sent his firm a letter on 6/15/07 stating that I wanted the debt "validated" and that I was nolonger to receive phone calls. He said the letter was mailed sometime in August and that gave him the "right" to call me. I informed him that I had NOT received the letter. I asked him if he had proof of delivery ie: copy of cerified or registered mail? He said he did not. I told him I thought a law firm should know better than that! We will see if the phone calls stop.

They stated the they were hired by Capital One to collect a debt, I explained that I do not have the money as I live on Social Security only. They told me that they were having a marshall serve me with a subpoena to appear in court. Someone went to my prior address Saturday, 1/5/08 saying he was from the county, was very intimidating to my ex-roommate. I am weary of these people because they are so agressive, I cannot afford a lawyer to fight this and I would think that Capital One is paying more for this company, if in fact, they are attorney's that the amount that is owed to them.

Wouldn't tell me what they were calling about - asked for my social security number so I hung up. Going to report the call to the proper agencies.

First, this harassment is illegal.
Secondly, they cannot take social security.
Thirdly, get the legal forms to send to these vultures! - JGot a call from this company 4 times this morning...one after the other. I never answered the call. Left me a message to call them back and that it was of a "time-sensitive matter". If it was really urgent and they really needed to contact me, why haven't I received anything in writing -- especially from a law firm? Maybe this call is valid, but I need something in writing before I call anyone back.

- PatReceived a second call from this number and I called them back. The first time they asked for my social security # which I did not divulge. They then asked me for the phone # where I received the call and they asked if I had a Target acct. I told them no and they said it must have been a misdial. The second call came at 8:30am when I was at work. I called them back and this time they stated they had no record of my phone number in their system. I am going to ignore all calls from this #. I questioned them re: the "unknown" number on the caller ID. Of course they said it was legitimate but I told them straight out that it seemed very peculiar that the law firm # didn't show up.

- AliceCalled several times looking for a certain person leaving messges, today "Mr. Reed" from an attorney's office (yeah right)called.(After the conversation, I called the number on caller ID) I politely told Mr. Reed collecion agencies call too many times looking for that person. Told them that apparently collection agencies don't share information with each other and that this wasn't a good number. They said they would remove it. BUT this has happened before with the other agencies and I sought legal advice. My attorney told me to tell them that we are recording the call (must inform them for legal reasons), inform again of information on person they are looking for, then tell them they are being considered for a harrassment lawsuit if they call again. It stopped the others, but names and numbers are sold to different collection agencies, so that's why a new one calls every six months. They don't believe what you say. It's been five years and I have to go through this on regular basis. But once an harrassment lawsuit is mentioned they do stop immediately. Try it. Who says you have to be telling the truth? How will they know?

They are violating Section 805 of the FDCPA, which states:
Communication in connection with debt collection [15 USC 1692c]
(a) COMMUNICATION WITH THE CONSUMER GENERALLY. Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt --
(1) at any unusual time or place or a time or place known or which should be known to be inconvenient to the consumer. In the absence of knowledge of circumstances to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is after 8 o'clock antimeridian and before 9 o'clock postmeridian, local time at the consumer's location;
(2) if the debt collector knows the consumer is represented by an attorney with respect to such debt and has knowledge of, or can readily ascertain, such attorney's name and address, unless the attorney fails to respond within a reasonable period of time to a communication from the debt collector or unless the attorney consents to direct communication with the consumer; or
(3) at the consumer's place of employment if the debt collector knows or has reason to know that the consumer's employer prohibits the consumer from receiving such communication.
File a complaint against them with the FTC. The more complaints which are documented against them, the better!
