    in debt
Two years in Ontario. That is news to me but what sweeeeeeeet news it is. Call me a lowlife but now that I know this nobody who's been harassing me rudely (there are some polite ones) will be getting a red cent from me. Nada. Nyet. Non.

The Federal Government and the Provinces have Limitation Acts which provide a limit on the time an unsecured debt survives. If an unsecured debt is not collected or payments are not made on the unsecured debt then after a certain time no legal action can be taken to collect the debt.

A March 4, 2003 decision of the Supreme Court of Canada, Markevich v. The Queen decided that limitations applied to CRA as well as other Crown proceedings. Section 32 of the Crown Liability and Proceedings Act and Section 3 (5) of the BC Limitation Act barred collection of the Federal and Provincial portions of the debt since the debt was more than 6 years old. This decision was "overruled" when parliament amended section 222 of the Income Tax Act to provide for a 10 year limitation period.
    Collins v. Canada, 2005 FCA 1431 CanLII.

Examples from various provinces and the Federal Government:

       * British Columbia - Section 3 (5) of the BC Limitation Act sets 6 years as the limit for debt.
       * Alberta - The Alberta Limitations Act sets 2 years as the term which is extended to 10 years if there is a judgement.
       * Ontario - The Ontario Limitation Act 2002 , came into force on January 1, 2004. It sets two years as the term (Section 4). This limitation will be reinstated where the debtor acknowledges the debt or makes a partial payment towards repayment of his debt. If the default occurred prior to January 1, 2004, the creditor will continue to have 6 years to pursue the claim. However, if the default occurred after January 1, 2004 then the 2-year rule applies.
       * Federal - Section 32 of the Crown Liability and Proceedings Act sets 6 years as the limit for debt.

I have received several calls from 1-800-256-8964
wanting me to call back at ext 278. The automatic
    message does NOT identify:
    (1) WHO is calling
    (2) WHOM they want to speak to
    (3) the reason for their call.
After goggling your number it appears to belong
to CBCCC. Unless they leave their name, the name
of the person they want speak to, and the reason
for their call, I am NOT about to call ANYONE!
The polite and LEGAL thing for them to do is to
    (1) IDENTIFY themselves clearly when they call someone
    (2) IDENTIFY the name of the person they wish to speak to
    (3) IDENTIFY the reason for their call.
We are NOT in the OLD SOVIET REPUBLIC, where
mystery calls might scare someone into calling an unknown
number! So I strongly suggest these MORONS stop their fear and intimidation tactics and STOP CALLING or PROVIDE THE ABOVE INFORMATION!

This credit agency does NOT follow the rules outline in the Collection act:
The Collection Agencies Act prohibits collection agencies from doing certain things. They seem to think they can call you whenever they want. They are permitted under the act from contacting you until six days have passed from sending you written notice of the following: • the name of the creditor • the balance owing • the name of the agency and its authority to demand payment

Here is the companies major contacts, send them an email and complain about the agent that is breaking these rules.

As a collector myself for over the past five years I am disgusted that you would even put your personal life online. Shame on you. Bragging online !!  People don't pay their bills for three reasons. Pay attention ok ...They "A" don't have the money or "B" they are disputing the matter or "C" you were are rude a$$hole and they now just won't deal with it.
So just for the future reference this is going to be some information that will help you in your job. Learn how to read people and know when to pull the a$$hole card and when not to. From what I read here you didn't do such a good job. You must think people wake up and say hey I am not going to pay that bill because I don't want to ... It doesn't work that way..
Also if I were your boss or co-worker I would be embarrassed to have you as an employee or a co worker who acts that childish and that unprofessional.
Good luck and hopefully you can learn to respect the people you do and don't know it will get you a lot farther in life...

I am not suggesting we not pay those bills we are responsible.

With that said - there are times where we cannot meet these obligations like long terms of unemployment.

The rule of thumb that I use is if the bill is less than 2000.00 I will explain to them the situation - if they can't deal with that and are persistent, I hang up... there really is not much they can do but call back.

However, I have found when honestly outlining the situation - these guys do not call 3 times a day.  If they are doing that it is because you promised them something, they know you are home and might answer it, or they have smelled fear and are acting on it like dogs in a pack.

It it not cost effective for these companies to chase after you through the courts.

if you are in such condition that you cannot pay your bills, then your credit score is the least of your worries - focus on paying the secured bills if you can, and rent or mortgage, unfortunatly - hydro, they aren't so easy to push off and the phone company is staffed by nazies.

Just lay out the facts to them honestly and they will give you a break - human beings in general are not [***] - that is the job left to those employed in the Oval Office.

    cheers

hello Mr. collector you should be one to talk as you replied to the message.  Further more this is not my name either.  Also some peolpe get farther in debt than they should that is correct by myself I did just that but lost my job due to the recent economy and went from 53K to  2oK a year which which put me in deficit.  I tried and could not handle all payments. and when a peson then has to go to a trustee and still get the calls from you people yes it hurts a little.  this is something no one likes to do but there are times when you have no choice. So you should be the embarrassed one.

Get real losers. Put a big black on my file with a note that reads

"Buddies been around the system for years and is quite willing to work on a resonable and managaeable arrangement  that works best for him so he can survive and continue a life but will not write a check to you for a lump sum ever so if you like eat red lobster or outback steakhouse please do not pick this file"
